NOTICE OF PUBLIC INFORMATIONAL HEARING
BEFORE THE
COLORADO WATER QUALITY CONTROL COMMISSION
To receive written proposals and. brief oral statements recommending
changes to the Commissions current regulation titled:
"Regulations Establishing Basic Standards And An
Antidegradation Standard And Establishing A System For
Classifying State Waters, For Assigning Standards, And For
Granting Temporary Modifications"
which is section 3.1.0 of Article 3, Water Quality Standards, of
the Policies, Regulations, and Guidelines of the Water Quality
Control Commission.
Section 3.1.0, normally referred to as the "Basic Regulations", was
adopted May 22, 1979 and became effective July 10, 1979. In
accordance with C.R.S. 1973, 25-8-202(1)(f) the Commission is
holding its triennial review of the "Basic Regulations". The
announcement of this review was approved by the Commission in May,
1982, as an item on the June 1982 agenda. At its June, 1982,
meeting the Commission determined that it should not revise the
"Basic Regulations" until it had completed classifying and
assigning standards to the stream segments of all river basins in
the State. This action will have been completed by the time of the
hearing announced by this notice. Subscribers to the Water Quality
Control Division Newsletter were advised of this process by
Commission Memorandum dated July 14, 1982.
This is not a Rulemaking Hearing. The purpose of this hearing is
to obtain recommendations from the public, the Water Quality
Control Division, and operators of regulated facilities discharging
into the waters of the State concerning amendments to the "Basic
Regulations", or the advisability of retaining them in their
present form. All recommendations will be considered by the
Commission in developing any proposals for amendments to the "Basic
Regulations". It is anticipated that a rulemaking hearing, if one
is necessary, will be held in the future, to consider any proposed
amendments. It would be announced by sixty (60) day notice of
rulemaking hearing.

Pursuant to section 2.1.10(d) of the "Procedural Rules For All
Proceedings Before The Water Quality Control Commission And The
Water Quality Control Division" (The Procedural Rules) :
Notice is hereby given that the Colorado Water Quality Control
Commission will hold a public informational hearing on the
following date and time at the location indicated:
DATE: February 14, 1983
TIME: 9:00 A.M.
LOCATION: ROOM 150 DEPARTMENT OF HEALTH BUILDING
4210 EAST 11TH AVENUE
DENVER, COLORADO
The hearing may be reconvened at such times and places as the
Commission may announce.
The hearing shall be solely for the purpose of gathering
information. It will be informal; there will be no parties and no
one will bear the burden of proof . However, the Commission will
consider all oral and written statements or other evidence
presented at the informational hearing before this Commission.
The Commission encourages all interested persons to provide their
views on changing or maintaining the "Basic Regulation" in its
present form. In an effort to reduce the length of the hearing,
the Commission, in accordance with section 2.1.10(d) of the
Procedural Rules is limiting the time for oral comments to ten (10)
minutes per speaker. The Commission encourages the submission of
written comments before the hearing, and all written comments must
be received in the Office of the Commission on the date of the
hearing.
The Office of the Commission requests that you submit twenty (20)
copies of all written submittals and suggests that additional
copies be made available at the hearing for attendees.
It is proposed that no additional recommendations will be accepted
after the close of the hearing; however, if the Commission
determines there is a justifiable reason, it may choose to leave
the record open for an additional period of time, for further
written recommendations generated by the comments of other
attendees at the hearing. Oral concluding remarks will not be
accepted so as to reduce the length of the hearing. The hearing
will remain open until all persons present and desiring to make
statements have been heard.

Full and complete transcripts of the proceedings will be made and
copies thereof will be available to any party to the hearings upon
requesting the same from the reporter and payment of his/her fee
therefor. Transcripts of any hearings and summaries of motions
made in general meetings are always available for public inspection
during the hours of 8:30 A.M. to 5:00 P.M., Monday through Friday
(holidays excepted) in the Office of the Colorado Water Quality
Control Commission located in Room 319, Department of Health
Building, 4210 East 11th Avenue, Denver, Colorado.

THE
COLORADO WATER QUALITY CONTROL COMMISSION
CONCERNING:
The consideration of the need for any change in the unionized ammonia water
quality standards for segments 14 and 15 of Clear Creek of the South Platte
River Basin, and for a determination of whether treatment to a level beyond
secondary treatment is economically reasonable for the City of Golden and
Adolph Coors, Inc. , when discharging into those segments. The segments are
described on pages 10 and 11 of the tables of stream classifications and water
quality standards, section 3.8.6(2) of the Commission's current regulation
titled:
"Classifications and Numeric Standards, South Platte River
Basin, Laramie River Basin, Republican River Basin, and
Smoky Hill River Basin" ("South Platte Regulation")
effective May 16, 1981 (SCCR 1002-8) and
contained in Article 3, Water Quality Standards, of the Policies, Regulations,
and Guidelines of the Water Quality Control Commission.
The Colorado Water Quality Control Commission, by Notice published in the
Colorado Register on October 8, 1982, announced that it would conduct a public
hearing to commence at 9:00 A.M. on December 13, 1982 in Room 150, Department
of Health Building, 4210 East 11th Avenue, Denver, Colorado. Said hearing was
for the purpose of considering the matters stated above.
Subsequent to the date of giving notice of said public hearing, Adolph Coors
Inc. , and the City of Golden requested postponement and continuation of this
hearing pending the outcome of an adjudicatory hearing concerning the Adolph
Coors Inc. , discharge permit. The Water Quality Control Division and the Cities
of Westminster and Thornton did not object to this continuance. Based on these
facts the Commission agreed to cancelation and postponement. Accordingly, in
accordance with section 2.1.5(E) of the Procedural Rules, the Notice of Public
Hearing previously referred to is hereby cancelled, said public rulemaking hearing
is postponed.
