CORNELL WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 1st day of February, 1984 , considered the re- quest of Lewis Wesley and Barbara J. Cornell to place one mobile home to be used as a principal dwelling, and to be occupied in an A-Agricultural Zone District, on a parcel of land more par- ticularly described as follows: Lot 11 , Block 2 , Jo Ann Subdivision; Part of the SE4, Section 26 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS , the Board of County Commissioners, having heard the testimony, finds that said request should be granted sub- ject to the following conditions: 1) the applicant applying for a building permit for the mobile home within thirty days from the date of approval by the Board of County Commissioners; 2) the Board of County Commissioners setting a reasonable time period that will allow the Cornells to finish their permanent residence. The Planning Department ' s staff recommends that this time period not exceed one year; 3) the zoning permit for a mobile home shall not be transferable to any successors and/or interests; the zoning permit shall expire automatically upon conveyance or lease of the property; and 4) this permit shall be subject to review annually on the anniversary of the permit' s issuance. The Board shall re- view the progress of the construction of the permanent residence to determine if construction is being diligently pursued. SEA, Section 26, TIN, R66W of the 6th P.M. , Weld County, Colorado Location: Approximately 3/4 mile northwest of Lochbuie; north of Weld County Road 4. The Department of Planning Services staff has reviewed this request and recommends that the request be approved for the reasons: WILL WILL NOT X Be compatible with the Weld County Comprehensive Plan X Be compatible with the surrounding area X Be in harmony with the character of the neighborhood X Adversely affect the immediate area X Be adequately served by water and sewage disposal facilities X Adversely affect the general health, safety and welfare of the inhabitants of the area and the County COMMENTS: On June 15, 1977, Mr. and Mrs. Cornell applied for a Zoning Permit for a Mobile Home to be used temporarily during construction of a permanent residence. The permit expired on June 16, 1978 and it was never renewed. The Weld County Building Inspection Department issued a zoning violation complaint on August 20, 1981. The complaint noted that little progress had been done on the permanent residence within the past two (2) years. The Cornells are now requesting a change in classification for their mobile home from temporary to principal dwelling. The Department of Planning Services has received several telephone complaints concerning the Cornells. The Department of Planning Services staff recommendation for approval is conditional upon: 1. The applicant applying for a building permit for the mobile home within thirty (30) days from the date of approval by the Board of County Commissioners; 2. The Board of County Commissioners setting a reasonable time period that will allow the Cornells to finish their permanent residence. Staff would recommend that this time period not exceed one (1) year; 3. The Zoning Permit for a Mobile Home shall not be transferable to any successors and/or interests; the zoning permit shall expire automatically upon conveyance or lease of the property; and 4. This permit shall be subject to review annually on the anniversary of the permit's issuance. The Board shall review the progress of the construction of the permanent residence to determine if construction is being diligently pursued.
