RE: APPROVAL OF LOT SIZE VARIANCE NO. 109 : 80: 6 - LARRY AND JEAN
REID.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 5th day of May, 1980, in the
Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain tract of land is owned by Larry and
Jean Reid, which land is more particularly described as follows:
That portion of the North Half of the
Southwest Quarter of Section 14 , Town-
ship 1 North, Range 67 West of the 6th
P.M. , Weld County, Colorado, which begins
at the West Quarter Corner said Section
14;
Thence North 89°15 ' 45" East along the
North line said Southwest Quarter a dis-
tance of 2635 . 5 feet to the Northeast
Corner said Southwest Quarter;
Thence South 00°07 ' West along the East
line said Southwest Quarter a distance of
740. 1 feet to a Point on the Centerline
of the Brantner Ditch;
Thence along the Centerline Brantner Ditch
the following courses and distances:
South 70°45 ' 53" West a distance of
99. 12 feet;
South 80°04 ' 53" West a distance of

WHEREAS, the owners of said tract of land desire to obtain
a variance from the minimum lot size requirement so that said
applicants may make application to the Board of County Commis-

sioners for a recorded exemption, as set forth in Section 9-4.A. (6)
of the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado feels that the applicants have shown good cause for
granting a lot size variance under Section 9-4 .A. (6) of the Weld
County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that a variance from lot
size requirements be, and hereby is, granted to Larry and Jean
Reid for the above described parcel of land.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 5th day of
May, A.D. , 1980 .

Dear Commissioners:
The attached letter and related materials are in reference to a request
for a lot size variance from Larry and Jean Reid. The property on which
this request has been made is described as part of the N1 SW4 of Section
14, TINT, R67W of the 6th P.M. , Weld County, Colorado. This property is
located 11 miles South and 11/2 miles West of Fort Lupton. The property
under consideration contains approximately 40 acres of Class II and III
irrigated soils. The request is to obtain a variance from the minimum lot
size requirement, Section 9-4. A. (6) of the Weld County Subdivision Re-
gulations so that they may make application for a recorded exemption.
Mr. and Mrs. Reid wish to sell the existing home and 10 acres and build
a new home on the remaining 30 acres.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends the request be denied
for the following reasons:
1. The proposed request does not comply with the Weld County
Comprehensive Plan because it would promote nonagricultural
use of agricultural land and it would encourage urban en-
croachment on rural land use. The Plan urges residential
development to be closely connected to and served by municipal
utilities with towns being encouraged to service new develop-
ments within a reasonable service area from its incorporated
boundaries. The Plan further indicates subdivision of land
should conform to the overall development goals and policies
of the Comprehensive Plan.

2. The request is not in conformance with the intent clause of
the Agricultural Zone District, Section 3.3.A. of the Weld
County Zoning Resolution. This request would not be encour-
aging agricultural uses as the highest and best uses, it
would not be providing for the orderly expansion of urban
growth, it would be promoting the division of agricultural
land into smaller, less economic parcel sizes, and increasing
the residential density on the property. The parcel contains
only one set of improvements. This request would allow another
residence to be built on the 30 acre parcel. Furthermore, the
request would place a greater demand on the services which
residential uses require.
3. This request is not in compliance with the intent clause of
the recorded exemption procedure, Section 9-2 of the Weld
County Subdivision Regulations. The parcel has Class II
and ₹V irrigated soils. Additionally, the nature of the re-
quest is not providing for the orderly expansion of urban
growth in accordance with the Comprehensive Plan. The De-
partment of Planning Services Staff feels that if residential
development increases in the area, inefficient development
will result.
4. The minimum lot size in the Agricultural Zone District for
irrigated parcels is 80 acres and for nonirrigated parcels
is 160 acres. The intent is to maintain tracts which are
large enough for farm purposes, and to assist in the encourage-
ment of agricultural uses as the highest and best use of the
land. This request is in conflict with that intent.

Dear Sirs:
The attached letter comes before you on a request by Larry 0. Reid
for a Lot Size Variance. The petitioner owns approximately 40 acres
located in the SWa of Section 14, T1N, R67W of the 6th P. M. , Weld
County, Colorado. The desire is to split approximately 5 acres from
the property.
Section 9-4A. (6) reads as follows:
"That the original tract or parcel of land to be divided
under this Section meets the minimum lot size require-
ments established by the Weld County Zoning Resolution;
variance from this requirement being allowed only upon
good cause being shown to the Board of County Commissioners .
or where said tract or parcel of land lies within the
comprehensive plan area of an existing incorporated town
of Weld County. (Rev. 4/17/74)
Based on the information submitted and Weld County Regulations, the
Planning staff recommends the request be denied for the following reasons:
1 . The proposed split is not in compliance with the Weld County Compre-
hensive Plan inasmuch as it does not promote agricultural use and
would not be compatible with surrounding agricultural uses.

2. The proposed split does not conform to Section 9-2 of the

is not of a low soils capability.
3. The SCS does not have mapping complete in the area but has given
an estimate of Class II and III irrigated soils.
4. Good cause, as required in Section 9-4A. (6) of the Subdivision
Regulations for Recorded Exemption, has not been shown as to ,
why the variance to allow a Recorded Exemption should be approved.
