PURPOSE OF MODIFICATION The purpose of this modification is to correct typographical errors regarding this permit, and to extend the compliance schedule dates for TRC and dissolved oxygen. The permit states in Part I.A.2.b that if a WET test is failed that Swift provide written notice to the Division of the failure. including a statement regarding whether a Preliminary Toxicity Investigation/Toxicity Identification Evaluation(PTI/TIE) is being performed. Part I.A.2.c of the permit states that a PTI/TIE is required whether or not the WET limit is in effect. Currently the permit requires WET monitoring until 12/31/07, with the WET limit being in effect starting 01/01/08. Ammonia has been identified as the constituent in the effluent discharge that has been the cause of WET test failures. The permittee is currently under a Compliance Order on Consent(IC-050603-1)to upgrade the facility to reduce the ammonia concentration in the effluent discharge. This request is made to eliminate the need for a PTI/TIE after a WET failure, until the permit limit is in effect. MODIFICATION ISSUED AND EFFECTIVE NOVEMBER 30,2005 EXPIRATION AUGUST 31, 2010 There is a conflicting limitation between the permit and the rationale regarding a 7-day BOD5 limitation of 45 mg/1. The permittee's limitation for BOD5 is designated under a Federal Effluent Limitation Guideline(ELG)found under 40 CFR 432.20. The limitation of 45 mg/1 as a 7-day average is based upon the State of Colorado Regulation No. 62, Regulations for Effluent Limitations. Statewide limitations do not apply when an ELG exists. The permittee has requested an extension to the compliance schedule for TRC and dissolved oxygen. The request is to extend the final dates for the submittal of plans and specifications, and the dates for the start of construction by 120 days. This will not effect the final completion date of this compliance schedule. IV. CHANGES MADE AS A RESULT OF THE AMENDMENT After review, the Division has made the following changes to this permit: 1) The WET language regarding a required PTI/I'IE has been changed to show that this is not required until a WET failure has occurred after the limitation becomes effective(01/01/08). This was done as the constituent of concern has been identified, and a Compliance Order on Consent is already in place to address this issue. 2) The 7-day limitation for GODS in mg/1 has been eliminated. This limitation has been changed to report only as a State limitation does not apply due to the presence of a Federal ELG for this constituent. 3) The compliance schedule for TRC and dissolved oxygen has been changed to allow an additional 120 days for the submittal of the plans and specifications,for the beginning of construction, and for the submittal of the progress report.
