LEGAL DESCRIPTION: Lot B. RE-3581; being part of the SE4 Section 4, T6N, R64W of
• the 6th P.M., Weld County, Colorado.
REQUEST: Final Plat approval for 8 lots in the Lawley Estates PUD
LOCATION: North of and adjacent to CR 72; west of and adjacent to CR 55.
Brad Mueller, Department of Planning Services, presented Case PF-1043. The standard easements have
been adhered to. The only concern is with outlot 4 and the need for easements on that lot.
Don Somer added that the center island at the entrance needs to be made a utility easement since the
utility companies cannot cross if the follow along CR 74. There needs to be utility easements in Tract A
which is the entrance island. Mr. Fleck asked if lot 4 is part of this. Mr. Mueller stated it was. Mr. Fleck
added that it will need to be addressed with easements for possible future needs. Mr. Mueller stated it is a
buildable lot and it may need access to another subdivision. The standard 20 foot perimeter easement will
be added. Mr. Mueller added the lot is bisected by a ditch easement. Mr. Adams indicated they would
recommend the 20 foot. Jeff Couch, representative for the applicant, added that would not be a concern.
It is typically added. The intent for lot 4 was to be serviced from the end of the cul-de-sac. The idea was
an estate lot for the applicants. The 7 lots will be for sale. There is a great source for water. The
applicant had gone around the ditch as to not affect them.
Robert Fleck asked about the driveways. Mr. Couch stated there are some driveways but no one is sure
of the location of the homes. The homes will need to be closer to the cul-de-sac due to the location of
services. Mr. Mueller asked if the easement needed to be along the westerly 2/3 of the property so its
border is along the western border of the ditch rather than cross the ditch on the eastern side.
Jeff Couch stated the entire lot will be wrapped with the 20 foot easement.
Jerry Adams added that there was a utility easement adjacent to the ditch. Mr. Couch stated that would
be done.
• Jeff Couch stated that Tract A will be a utility easement. The ditch will only be crossed in the county road
right-of-way and the easements will go to the ditch but not across.
Jerry Adams summarized the request from the Utility Board. The board is asking that the Tract Abe
called out as a utility easement. There also needs to be a perimeter easement around lot 4 of 20 feet as
well as 20 foot easement adjacent to and on each side of the ditch.
Doug Melby moved to approve with the recommended changes. Don Magnuson seconded. Motion
carried.

Road 55 in the Southeast Qu of Section 4, Township 6 North, Range 64 West was prepared

Special Utility Districts.
