This use may soon be allowable under the Canfield Water User Association's(CWUA)water augmentation plan, case #2005C W061. The well for this business/home location is included in this augmentation plan. The CWUA permanent augmentation plan is expected to be processed in the District 1 Water Court sometime in the year 2008. The CWUA is currently operating under a Substitute Water Supply Plan(SWSP),which is renewable yearly until the permanent augmentation plan is complete(up to 5 years). Specifically,the CWUA is operating under the 2006 SWSP at this time. The 2006 SWSP was submitted to the Office of the State Engineer in March,2006,and given final approval in September of 2006. The 2007 SWSP was submitted in March, 2007. A revision of the SWSP for 2007 requests approval for the use of In-Home Businesses. Here it must be noted that the property at 24657 3M Ave.,Eaton,CO 80615 owns 2 shares of CWUA water,which allows for another 9200 square feet of irrigation above the regular given household consumptive use. So this property has ample augmented water to support the little additional use that the business would incur. As it is only April,it is hard to tell when this 2007 SWSP might be reviewed and possibly approved by the State Engineer's Office. Although the well on this property has been re-permitted to allow for the augmented use as per the 2006 SWSP,we cannot re-permit the well to allow for In-Home Business Use until which time the 2007 SWSP might be approval As soon as the opportunity presents itself,we will again re-permit our well(currently permit#65457),this time to allow for the In-Home Business Use. Of course,the SWSP is a temporary,and not a permanent plan. The permanent augmentation plan for the CWUA will ask for the same operations as the SWSP, however. And if then approved,all well permits,including this property's,will reflect the allowable uses on a permanently decreed basis. Until then,it is of utmost importance to us to be in compliance with county ordinances and laws. We are really trying to do everything we can to achieve this,but unfortunately this well-permit aspect is something that is just going to take time. Melanie Scott is the President of the Camfield Water Association,incidentally,so be assured that every effort is being made to advance the case to its conclusion. However,we hope there may be 2007-1967 some temporary solutions that would adequately address these issues,and we are willing to do whatever is necessary to be allowed to operate while these issues take their course. I should like to point out that the use at issue here amounts to approximately 10 extra toilet flushes(total)by employees per month,which is done within the home(domestic use?)as there is not a separate restroom facility for the business. Employees are furnished bottled water or soda,as they like,so there is no additional use of water/well there. If this really is big issue however,we feel there may be some reasonable solutions to get by on until. For instance,employees could walk 100 yards to their homes and flush their own toilets. Or perhaps we could install a"Port let". Or maybe the Planning Commission would have a suitable alternative. We really want to do right by the County,and by our community,and by our family. Please understand that this is our livelihood,and also that of others here in Camfield. Anything that the Planning Commission and/or Planning Department can do to assist us in our quest to be allowed to operate our business and work really hard would be greatly appreciated. As we have discussed, your well with permit number 236584 is currently permitted for ordinary household purposes within one single family dwelling. This permit would not allow water to be used for an in-home business. However, your well is part of a Water Court application for a plan of augmentation (Case No. 2005CW061) and is included in a State Engineer approved substitute water supply plan to allow additional uses of water withdrawn by certain wells within the Camfield town site. Condition of approval number 5 of the substitute water supply plan requires that all the wells included within the plan obtain wells permits in conformance with the uses of the well_ I have examined the engineering documentation related to projected water use in both the Water Court application and the substitute water supply plan application. This examination indicates that each home was projected to pump 269.5 gallons per day (0.3 acre-feet per year)for in-home purposes with a 10%consumptive use. if you: (A)limit your water use for all in-home purposes, including the in-home business, to no more than 0.3 acre-feet per year with no more than a 10% consumptive use; (B) obtain a well permit that will allow your well to be used for these purposes; and (C) amend the Water Court application and substitute water supply plan to allow these uses, the Division of Water Resources would have no objection to the use of your wall in an in-home business. This additional information is required before we can proceed with the evaluation of the application. the application is for an expansion of use of an existing well, permit no. 236584 located in the NE1/4 of the NE1/4 of Section 18, Township 7 North, Range 64 West of the 6th P.M. You indicated that the proposed expansion of use will be used for in-house use, home business use, livestock watering and lawn irrigation in accordance with the terms and conditions of the substitute water supply plan approved for the Camfield Water Users Association Water Court Application in Case no. 2005CW61 is pending before the water court. The State Engineer's Office approved a temporary substitute water supply plan for the Camfield Water Users Association in accordance with 2005CW61, however the proposed expansion of use of well permit no. 236584 is limited to in-house use and 4,200 square-feet of lawn irrigation. The home business use and the livestock watering is not included in the above case, thus is not taken into account in the substitute water supply plan. Therefore, a well permit for the expansion of use of your existing well permit no. 236584 could only be approved for the uses identified in the supply plan (which are the household purposes inside one single-family dwelling and the irrigation of 4,200 square feet of lawn and garden). Please note that a permit for the other uses applied for will not be issued unless those uses are included in a plan for augmentation or a temporary substitute water supply plan approved by the State Engineer pursuant to CRS 37-92-308. In a letter dated December 5, 2006 (enclosed) Mr. Dave Nettles, Assistant Division Engineer indicated that if you desire a well permit for all the uses applied for the Water Court application in case no. 2005CW61 and the substitute water supply plan need to he amended to allow for these uses (for in-house use home business • use, livestock watering and lawn irrigation). Accordingly, a well permit for the uses applied for cannot be issued until the above requirements are satisfied. Furthermore according to the State Engineer's new guideline 200314 for well permit applications please be advised that the aforementioned criteria must be addresses and received by this office by April 16. 7007 to retain active status of the new application.
