Dear Mrs. Smith:
• As per our telephone conversation a few days ago I have been working on trying to piece together
Northern Colorado Constructors, Inc. septic tank permit No. (SP—0300479) application and what
transpired after the permit was issued. The following is what I have been able to document.
• On December 15, 2003 Chris Zadel applied for a repair septic permit (SP - 0300479). This was
intended to repair the existing septic tank and leach field at 8249 CR 25, Fort Lupton, Colo.
• On January 27, 2004 we received notification that Permit No. SP-0300479 (New) had been
approved and the notification was signed by Mr. Charles Baum, Chairman Weld County Board
of Health
• On January 27, 2004 we received a letter from you stating that Permit No. SP—0300479 had
been approved.
• On January 27, 2004 we received the issued Permit No. SP -0300479. My copy has a hand
written note in the lower left hand corner "abandoning old system". I have not been able to
determine who wrote this on the permit.
• We have in our file an engineered septic tank vault done by Rollin Consulting and dated
2/14/2005.
• We have in our file Building Permit No. BCS—040527 dated 3/2/2005 with final approval
signed and dated 7/11/2005
• We have in our file a Certificate of Occupancy that is dated and signed 7/11/2005.
I have enclosed copies of all of the above referenced documents. What has happened at this point is the
existing residence that was on the property has been demolished and the debris removed. The existing
• septic tank and leach field have been abandoned. An 8' X 20' Williams Scotsman Trailer has been
installed as per Building Permit No. BCS - 040527 and the Certificate of Occupancy issued.
Additionally, the 1000 gallon septic tank vault has been installed as per Rollin Consulting engineered
drawing. In talking with Chris Zadel, he stated that the decision was made to demolish the old house

and abandon the existing septic tank and leach field. He was of the opinion that Permit No. SP —
0300479 was for the 1000 gallon septic tank vault as designed by Rollin Consulting. I can not find any
records of inspections by Weld County Department of Public Health. Chris was confident that they
• were called in and that inspections were made. The issuing of a Certificate of Occupancy by the Weld
County Building Inspection Department tends to support approval by the Health Department. It has
been my experience with the Inspection Department that they would not issue a CO if that had not been
signed off. This is as best that I can piece together the sequence of events and what transpired.
I would like to bring this to some resolution as soon as possible. I would be available to get together
with you and discuss the events and see what needs to happen to clear this up.
There is an existing residence on the proposed expansion property. The address of this residence is 8593
WCR 25, Fort Lupton, Colorado, 80621. The records that I have been able to obtain indicated the
residence was built in 1948 and may have under gone some remodel and addition after that time. It is
my understanding that septic tank and leach field permits were not required at the time the house was
built. We purchased the property approximately three years ago and I have not been able to find any
records relating to the size of the septic tank or size of the leach field. As I understand NCC would need
to do an evaluation of the system to determine if the system meets current regulations. I would request
that we be able to have a meeting with you to discuss the evaluation process and how we need to
proceed toward meeting this requirement.
The permanent water supply for the above residence is supplied by well water. I believe that the well
permit for this residence is No. 224180.
I look forward to being able to meet with you and discuss all of the above referenced comments and
• supplied documents that we have on file. We are wanting to devise an appropriate plan with you to
proceed and resolve any issues there may be.

NOTICE
This permit is granted temporarily to allow construction to commence. This permit may be revoked or suspended by the Weld County
Department of Public Health and Environment for reasons set forth in the Weld County Individual Sewage Disposal System
Regulations including failure to meet any term or condition imposed thereon during temporary or final approval. The issuance of this
permit does not constitute assumption by the department or its employees of liability for the failure or inadequacy of the sewage
disposal system.
This permit is non transferable and non refundable. Before issuing final approval of this permit the Weld County Department of
Public Health and Environment reserves the right to impose additional terms and conditions required to meet our regulations on a
continuing basis. Final permit approval is contingent upon the final inspection of the completed system by the Weld County
`Patent of Public Health and Environment. This ermit ex ires one ear from the a lication date.

On behalf of Northern Colorado Constructors, Inc., Clear Water Solutions, Inc. is
submitting a well permit application for the NCCI Pit #1, M-2001-107. The substitute
water supply plan renewal for the NCCI Pit #1 is being submitted concurrently under
separate cover. A check for the $100 fee is enclosed.
• The Well Look database was researched to identify all wells potentially within 600 feet
of the NCCI Pit #1. A 600-foot field inspection was completed by Mr. Bob Stahl, District
2 Water Commissioner, on August 3, 2006.
Signed waivers for wells within 600 feet are enclosed in the 2006-2007 substitute water
supply plan.

CONDITIONS OF APPROVAL
1) This well shall be used In such a way as to cause no material Injury to existing water rights. The issuance of this permit does not assure the
applicant that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking relief in a civil
court action.
2) The construction of this well shall be In compllanoe with the Water Well Construction Rules 2 CCR 402-2,unless approval of a variance has
been granted by the State Board of Examiners of Water Well Construction and Pump Installation Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37.90.137(2)and(11)for the construction and operation of a wet(gravel pit)in accordance with the temporary
substitute water supply plan approved by the Slate Engineer On October 27,2006,for the NCCI Pit#1,Division of Minerals&Geology Permit
• Number M•2001.107. The well(pond)shall not be operated unless It Is included in a substitute water supply plan approved by the State
Engineer or a plan for augmentation approved by the Water Court. The water supply plan for this pit is currently valid through December 31,
2007 and If It Is not extended or it a court decree Is not entered for a plan for augmentation,this well permit Is null and void and diversion of
ground water from this well must cease immediately.
4) This well Is subject to administration by the Division Engineer in accordance with applicable decrees,statutes,rules,and regulations.
5) The average annual amount of ground water to be appropriated shall not exceed 22.6 acre-feet with the total surface area of the proposed
ground water pond limited to 1.6 acres.
6) The use of ground water,In addition to dewatering is limited to 4.6 acre-leet of evaporative loss,6.2 acre-foot of water used for dust control
and 11.8 acre-feet of water lost with the mined product. No other use of water Is allowed unless a permit therefor is approved.
7) The owner shall mark the well(pond)In a conspleuous place with well permit number(s)and court case number(s)as appropriate. The owner
shall take necessary means and precautions to preserve these markings.
(1) Pursuant to Policy 2000-4(as amended October 1,2002)of the State Board of Examiners of Water Well Construction and Pump Installation
Contractors(Board),the minimum construction standards In Rule 10 of the Water Well Construction Rules shall be waived for gravel pit wells
except Rule 10.1 and its subsectlons10.1.2,10.1.4, 10.1.6 and Rule 10.2 and its subsecllon 10.2.1.The owner of the gravel pit shall take
necessary means and precautions to prevent contaminants from entering the gravel pit well.
9) Pursuant to Policy 20004(as amended October 1.2002)of the Board,the disinfection standards of Rvlo 15 of the Water Well Constucton
Rules shall be waived and the water well construction report requirement of Rule 17 shall be waived,except compliance with Rules 17.1.4,
17.3 and 17.4 is requIred.
10) The boundaries of the gravel pit pond shall be more than 600 feet from any existing well constructed In the same source,that Is not owned by
the applicant except for wells 47204.47415 and 157913 for which the well owners submitted 600 root spacing waivers.
11) Pursuant to Policy 2000-4(as amended October 1,2002)of the Board,no pumping equipment shall De installed In the gravel pit well to
withdraw water for any beneficial use,unless a separate written request for a variance has been approved by the Board.

This permit is granted temporarily to allow construction to continence: This permit may be revoked or suspended by the Weld County
Department of Public Health and Environment for reasons set forth in the Weld County Individual Sewage Disposal System
Regulations including failure to meet any term or condition imposed thereon during temporary or final approval. The issuance of this
permit does not constitute assumption by the department or its employees of liability for the failure or inadequacy of the sewage
disposal system.
This permit is non transferable and non refundable. Before issuing final approval of this permit the Weld County Department of
Public Health and Environment reserves the right to impose additional terms and conditions required to meet our regulations on a
continuing basis. Final permit approval is contingent upon the final inspection of the completed system by the Weld County
