HomeMy WebLinkAbout830016.tiff RESOLUTION RE: APPROVE REQUEST OF BELLWETHER EXPLORATION COMPANY TO WAIVE BIDDING PROCEDURE CONCERNING AN OIL AND GAS LEASE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , Bellwether Exploration Company, through their representative D. L. Percell, has requested that the bidding procedure be waived concerning an oil and gas lease on the NE Corner of W/2 NW/4 NW/4 of Section 26 , Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: A triangular tract or parcel of land in the Northeast corner of the West Half of the Northwest Quarter of the Northwest Quarter (W/2 NW/4 NW/4) of Section Twenty- six (26) , Township Six (6) North, Range Sixty-six (66) West of the Sixth Principal Meridian, being more particularly described as follows , to-wit: Beginning at a point on the South ' line of the County road on the North of said W/2 NW/4 NW/4 , thirty (30) feet more or less South of and 426 feet more or less , east of the Northwest corner of said Section 26 , said point being 50 feet Southwesterly of when measured at right angles to the center line of the Denver, Laramie & North- western Railroad, as the same is now located, surveyed and staked out over and across the W/2 NW/4 NW/4 ; thence South 47°21 ' East, 50 feet from and parallel to said center line 320 feet more or less to a point on the East line of said W/2 NW/4 NW/4 ; thence North on said East line 212 feet more or less to the South line of said County road; thence East on said South line 235 feet more or less, to the place of beginning. WHEREAS , after review, the Board of County Commissioners found that Bellwether Exploration Company did show good cause for waiving the bidding procedure on said oil and gas lease. Re: Oil and Gas Lease, 0.57 acres lying within NE corner of W/2 NW/4 NW/4 Section 26-6N-66W, Weld County, Colorado, Bellwether Exploration Company. Dear Sirs: The undersigned is presently representing Bellwether Exploration Company who is the present leasehold owner of W/2 NW/4 Section 26-6N-66W except for a 0.57 acre tract which we find the mineral ownership to be in the name of Weld County by virtue of a tax foreclosure. Please consider this our formal offer and request to lease said 0.57 acres from Weld County for a bonus consideration of $75.00, said lease to provide for royalties in the amount of 1/6th and for a primary term of one (1) year. We further respectfully request that the bidding procedure be waived insofar as we feel Bellwether would be the only party interested in obtaining such a lease due to the small acreage content thereof. For your information and advisement I have enclosed herewith a separate sheet showing the correct legal description of the property involved.
