exists at this time on the parcel identified above by the parcel number and/or legal description,and further states that the system
IS/IS NOT in good working order and to the best of his/her knowledge IS/IS NOT failing to function properly.
The property owner/agent further understands that any falsification or misrepresentation may result in the revocation of any permit
granted based upon this information hereby submitted and in legal action for perjury as provided by law.
The Statement of Existing Record relies on information the property owner or his/her representative provides,under oath,indicating
current status of the system and representing to the best of his/her knowledge that the system IS/IS NOT failing to function properly.
Issuance of the Statement of Existing Permit for any system does not constitute assumption that the site was evaluated or inspected
during any phase of construction by this Department to meet regu tions.

Subject: Kathy Cunningham Unregistered Well
Brad,
I am writing to confirm that the unregistered well owned by Kathy Cunningham located in the Section 32, T12N,
R62W of the 6th P.M. currently does not require a commercial well permit. In a signed statement by Mrs.
Cunningham, she claims that the unregistered well in question was constructed before May of 1972 and is only
being used for domestic purposes (household, lawn and garden, domestic animals), and water from the well is not
being used in the commercial business in any capacity.
While Mrs. Cunningham does have a small business on her property, at this time the Division of Water Resources
does not require her to permit the well for commercial purposes because the subject well is not being used for
commercial uses. Furthermore, Mrs. Cunningham has been informed that if she uses the well water in her
business she must apply for a new commercial well permit. For instance, if she constructed a bathroom for
employees, this would be cause for a commercial well permit and she would need to make application with this
office. Mrs. Cunningham did mention that her son, who lives at home with her, works in the business, but
because he lives onsite, this would still be considered domestic use.
At this time, the Division of Water Resources does not require the well to be permitted for commercial use.
