FROM: Jacqueline Hatch, Planner III COLORADO SUBJECT: 3rd AMPF-431 Western Dairymen Cooperative PUD Frontier Companies LLC c/o Wendell Gene Pickett has applied for an Amendment to the final plat (redesign) of the Western Dairymen Cooperative PUD. The applicant is wanting to redesign the final plat by consolidate Lots 8 and 9 of Block 2 into one (1) lot comprising of approximately 2.22 acres. Western Dairymen Cooperative PUD is located south of and adjacent to highway 119 and approximately '/ mile east of CR 7 %. The proposed site is located within the Regional Commercial—Medium Intensity for the Mixed Use Development(MUD) area. The proposed PUD will be serviced by Left Hand Water District and St. Vrain Sanitation District. The Department of Planning Services is recommended that the applicant provides utility easement in compliance with Section 24-7-60 and 27-9-40 of the Weld County Code. Thank you • EXHIBIT I 2008-1101 MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE • A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday, February 14, 2008 at 10:00 a.m., in the Conference Room of the Weld County Planning Department at 918 10th Street, Greeley, Colorado. Members Present: Don Posselt, Robed Fleck, Jerry Adams, Don Magnuson, Dave Snyder, Members Absent: Doug Melby, Don Somer, Lyle Sheeder, and Al Trujillo. Also Present: Roger Caruso, Jacqueline Hatch, Department of Planning Services, and Kris Ranslem, Secretary. Don Posselt moved to approve the January 10, 2008 minutes, seconded by Robert Fleck. Motion carried. CASE NUMBER: PF-1050 APPLICANT: P & A Turkey Farms, Inc. PLANNER: Roger Caruso LEGAL DESCRIPTION: Pad of the NE4 of Section 36, T5N, R65W of the 6`h P.M., Weld County, Colorado. REQUEST: Planned Unit Development Final Plat for nine (9) lots with (E) Estate Uses (126.19 acres)and one (1) common open space outlot (6.71 acres) and two (2) agricultural outlots (101.11 acres). LOCATION: South of and adjacent to CR 52 and West of and adjacent to CR 49. Roger Caruso, Department of Planning Services, stated that P &A Turkey Farms Inc., in care of Todd Hodges Design, has applied for a request of final plat for a nine (9) lot PUD with (E) Estate uses comprising of one (1) open space and two (2) agricultural lots for a total of approximately 123 acres herein referred to as Ridgeview Estates PUD. • Ridgeview is located west of and adjacent to County Road 49 and south of and adjacent to County Road 52. The detention pond is located in an area designated as open space. Two fire hydrants will be installed—one at or near Lot 1 Block 2 and the other near Lot 3 Block 2. The proposed PUD will be serviced by: Central Weld County Water District Individual Septic Disposal Systems Gas =Atmos Energy Electric = Poudre Valley REA Phone = Owest The Department of Planning Services recommends that the applicant provide a utility easement in compliance with Section 24-7-60 and 27-9-40 of the Weld County Code. Mr.Caruso reminded the Board that this case was continued from January 10,2008 to address concerns that the Board had. Todd Hodges commented that they have addressed everything that the Board had requested. He stated that they resubmitted the drawing to show the entire property as it seemed that was part of the problem. He added that on the plat you can see that they have labeled the perimeter utility easement on the outlots as requested and it also shows a drainage easement on the open space. Mr. Hodges said that they have made sure that the utility easements are consistent with the criteria and in some cases have gone above with the additional easement due to the need of drainage and utilities. • Dave Snyder entered meeting at 10:05 a.m. Robert Fleck commented that it appeared that they have everything covered as was requested by the Board. Don Posselt concurred with Robert. Don Posselt moved to approve PF-1050, seconded by Rob Fleck. Motion carried 5-0. REQUEST: An Amendment to a PUD Final Plat Redesign; consolidating Lots 8 & 9 of Block 2 into one lot in the Western Dairymen Cooperative PUD. LOCATION: South of Hwy 119 and approximately 1/4 mile east of CR 7.5. Jacqueline Hatch, Department of Planning Services, said that Frontier Companies LLC, in care of Wendell Pickett, has applied for an amendment to the Final Plat, which is a redesign of the Western Dairyman Cooperative PUD. The applicant is wanting to redesign the final plat by consolidating Lots 8 & 9 of Block 2 into one (1) lot comprising of about 2.2 acres. The Western Dairyman Cooperative PUD is located south of and adjacent to Highway 119 and approximately% mile east of County Road 7.5. The site is located within the Regional Commercial Medium-Intensity for the Mixed Use Development Area. The proposed PUD will be serviced by Left Hand Water District and St. Vrain Sanitation District. The Department of Planning Services is recommending that the applicant provide utility easements in compliance with Section 24-7-60 and Section 27-9-40 of the Weld County Code. Ms. Hatch stated that currently in the Western Dairyman there are no utility easements running between the lots. She added that the easements are running on the North and South sides of all the lots. They are proposing to keep those and remain with the original plan. She said that the only thing missing is the • middle lot line between Lots 8 and 9. Robert commented that the sewer runs up the middle of the subdivision, therefore he doesn't see any need for an additional sewer easement. He mentioned that if the rest of the Board wanted to get some easements on the lot lines he would be okay with that. Robert asked Ms. Hatch if this is going to be one lot with one building. Ms. Hatch replied that it is. She added that they have submitted a Site Plan Review for the lot and it is one large building that goes over the lot line between Lots 8 and 9. Jerry commented to Ms. Hatch that she had indicated that the Department of Planning Services asked the owner to add easements as per Weld County Code. Ms. Hatch apologized and wished to omit that correct the recommendation to leaving the utility easements as originally approved through the Western Dairyman Cooperative. Jerry said that he doesn't see the need to bring in additional easements beyond what he sees on the original plat. Don Posselt said that he is happy with what he sees on the current plat. Don Posselt moved to approve 3r° AmPF-431, seconded by Dave Snyder. Robert referred to the lot that is surrounded by the lakes and asked why it was on the plat. Ms. Hatch replied that it was just part of the entire Western Dairyman Cooperative and she submitted the entire subdivision to review.
