HomeMy WebLinkAbout20070462.tiff MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday, February 8, 2007, at 10:00 a.m., in the Conference Room of the Weld County Planning Department at 918 10`h Street, Greeley, Colorado. Members Present: Jerry Adams, Doug Melby, Don Sommer, and Jesse Hein 1. CASE NUMBER: AMPF-632 APPLICANT: GKD LLC (Gary DeJohn) PLANNER: Chris Gathman LEGAL DESCRIPTION: Cottonwood Falls PUD (PF-632) located in part of the E2 of Section 34 and part of the W2 of Section 35, T5N, R63W of the 6th P.M., Weld County, Colorado. REQUEST: Amended PUD Final Plan application to relocate an existing residential lot(Lot 13) and to reconfigure existing open space for Cottonwood Falls PUD. LOCATION: West of and adjacent to CR 69; approx. 2 miles north of State Hwy 34. Also Present: Chris Gathman, Donita May and Kris Ranslem Jerry Adams, Chair, began the meeting at 10:15 a.m. and introduced Case AMPF-632. Chris Gathman, Department of Planning Services, said the applicant, Gary DeJohn, was proposing to move existing Lot 13, which was originally in the southeast corner of the site, and was approximately 1.7 acres, to the north and west, across Cottonwood Lane into the open space area. The size of Lot 13 (1.7 acres)will not change. No other changes were proposed except reconfiguration of the open space. Mr. Gathman said that on the original plat there was a ten foot designated setback off of Cottonwood Lane on the north side of Lot 13 border and the plat does not show a ten foot side easement. The other difference from a standard PUD is that either side of Lot 13 will be open space which includes a gazebo but other than that is non-buildable. Mr. Adams asked Mr. Gathman if approval was contingent upon adding a notation for an easement of 15 feet adjacent to Cottonwood Lane and said he had no problem staying at the ten foot easements if everything adjacent was at ten feet and aportioned equally, if the Board was agreeable. Mr. DeJohn had no objections to the ten feet easement recommendation. Don Somer asked if there were homes on the site. Mr. DeJohn said there were originally thirteen homes and they were subdivided to be sold off separately. The purpose for the change in lot was because Wind Energy was running a transmission line over current Lot 13. That was the reason for the vacation and they would be trading foot for foot open space so the transmission line could go over existing Lot 13 unobstructed. Mr. Somer asked if they had gotten phone service in the area and were the homes sold, rented or unoccupied. Mr. DeJohn responded that he believed there was phone service and that seven homes were sold and are occupied at present. Mr. Somer said they needed a sign-off of all utilities if amending this plat. Mr. DeJohn asked if that had not already been done. Mr. Gathman said a sign-off was standard. Mr. DeJohn said all utilities with input had been put on notice. Doug Melby asked if they changed the setbacks from ten to fifteen feet, did they need to change all of the lots. Mr. Adams said he was proposing not changing setbacks from ten feet to fifteen feet. Jesse Hein was also agreeable to the ten foot interior lot line easements for Lot 13. Mr. Adams summarized that they were requesting a ten and ten interior lot line easements for lot 13, and, as a Condition of Approval, get a signature block for existing utilities added to final plat. Mr. Somer asked if there was an agreement with the ditch company for utilities to cross on CR 69. Mr. Gathman said he would have to look into that but assumed they could go down Cottonwood Lane to 2007-0462 the north and south easements. Mr. Adams asked Mr. Gathman to check for permission to cross ditch company easements and update them at the next Utility Board meeting March 8, 2007. Mr. DeJohn commented that if memory served, phone service was brought in by Qwest. Richard Sitzman, accompanying the applicant, said the lines were installed when the homes were originally built in 1989-90, but were shut down when National Hog Farm relocated, though he thought service had been resumed. Mr. Somer said the phone lines were out of the easements and running across the property and needed to be placed back in the dedicated easement. Someone needs to go back out there and install all new cable for each home in the easements. Mr. DeJohn said the owners were not likely to bear that cost. Mr. Somer said the owners need to be put on notice that Qwest will not serve them and that they would have to put in their own phone lines and that information should be disclosed at the time of property sale. Jesse Hein moved to approve Case AMPF-632, to relocate an existing residential lot(Lot 13) and to reconfigure existing open space for Cottonwood Falls PUD, to include a twenty foot lot line easement (ten feet on either side of the west and eastern lot lines for Lot 13)and, as a Condition of Approval, get a signature block for existing utilities added to final plat.
