• TAP FEE AGREEMENT
THIS AGREEMENT, made and entered into this day of TY;t .•. , 19 t? -j,
by and between the CENTRAL WELD COUNTY WATER DISTRICT, hereinafter caged the District,and
Leeane Brenner _-_--and
hereinafter called Customer, WITNESSETH:
WHEREAS, District has been organized as a legal body and is known as the Central Weld County Water
District, and
WHEREAS, Customers are taxpaying electors within said District, or desiring to join said District,or
and,
WHEREAS, Customers are desirous of acquiring one water tap of 5/8 inches in diameter from the said
District,
NOW, THEREFORE, in consideration of the premises and the terms of this agreement, it is mutually
agreed as follows:
1. Customer agrees to pay the tap fee of S 3,500.00
• Three Thousand Five Hundred and 00/100 Dollars.
2. In the event it is not economically feasible to extend the water to the property line of Customer, which
• matter is in the entire discretion of District, then all sums paid hereunder shall be returned to Customer and the
agreement shall be null and void.
3. The description of the premises for which this tap is being purchased is as follows:
Lot B Recorded Exemption No. 0963-32-4-RE779 being part SW 1/4 SE 1/4 Section 32,
Township 5 North,Range 64 West of the 6th P.M.,Weld County Colorado,per map recorded
March 13, 1992 Book 1328 Reception No. 2280805 with easement for roadway and utility
20' wide shown on Recorded Exemption map recorded under Reception No. 1602398.
4. This agreement, when approved by the Board of Directors, shall become a legal and binding contract
upon all parties hereto.
5. Customer further agrees to execute any and all easements needed by District at no expense to District,
across Customer's property for the purpose of installing any pipelines constructed by District. District shall be
responsible for restoring surface area back to reasonable condition at District cost.
6. It is further mutually agreed that this agreement shall extend to and be binding upon the heirs, executors,
administrators and assigns of the parties hereto.
7. Customer further agrees to the following special provisions:

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDITIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2,unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
3) Approved pursuant to CRS 37-92-602(3)(b)(il)(A)as the only well on a tract of land of 44.35 acres described as a part of
• the SE 1/4 of Section 32,T5N, R64W,6th PM,Weld County,and more particularly described in the attached Exhibit A,
Recorded Exemption Plat.
4) The use of ground water from this well is limited to fire protection,ordinary household purposes inside not more than
three(3)single family dwellings,the watering of poultry,domestic animals and livestock on a farm or ranch and the
irrigation of not more than one(1)acre of home gardens and lawns.
5) The total depth of the well shall not exceed 330 feet.which corresponds to the base of the Laramie-Fox Hills aquifer. At a
minimum,plain casing shall be installed and grouted through all unconsolidated materials and shall extend a minimum of
ten feet into the bedrock formation to prevent production from other zones.
6) The depth to the top of the Laramie-Fox Hills aquifer is approximate. To ensure the exclusion of poor quality waterfrom
zones immediately above the aquifer,plain casing and grout shall extend through the lowermost coal and/or carbonaceous
shale that overlies the Laramie sand portion of the aquifer.
7) The maximum pumping rate of this well shall not exceed 15 GPM.
8) The return flow from the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
9) This well shall be constructed not more than 200 feet from the location specified on this permit.
NOTE:To ensure a maximum productive life of this well,perforated casing should be set through the entire producing
interval of the approved zone or aquifer indicated above.
NOTICE:This permit has been approved for standard residential uses (Condition 4)instead of livestock watering only as
was requested on the application. You are hereby notified that you have the right to appeal the issuance of this permit,by
filing a written request with this office within sixty(60)days of the date of issuance, pursuant to the State Administrative
