RE: APPROVAL OF RECORDED EXEMPTION NO. 446 - MELVIN BLAKE, ET AL.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 30th day of April , 1980 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of land, as shown on the plat known as Recorded Ex-
emption No. 446 , being the property of Melvin Blake, et al. , de-
scribed as part of the Southwest Quarter of Section 12 , Township
4 North, Range 66 West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows does not come within
the purview of the definition of the terms , "subdivision" and
"subdivided land, " pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended:
That part of the Southwest Quarter (SW4) of
Section 12, Township 4 North, Range 66 West
of the 6th P.M. , Weld County, Colorado, lying
North of U.S. Highway 85, EXCEPT therefrom
a parcel of land described as follows :
Beginning at the SW Corner of said Section
12; Thence North 1020. 8 feet to the True Point
of Beginning of exception; Thence continuing
North 246. 11 feet; Thence South 65°14 ' East,
33. 03 feet; Thence South 65°14 ' East, 220. 23
feet; Thence South 153. 9 feet; Thence West
200. 00 feet to the True Point of Beginning
of said exception.
Said described parcel of land contains 74 . 44
acres , more or less, and is subject to any
rights-of-way or other easements as granted
or reserved by instruments of record or as
now existing on said described parcel of land.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from
the definitions of "subdivision" and "subdivided land" pursuant
to its authority under Section 30-28-101 (10) (d) , CRS 1973, as
amended, and Section 2-lA(3) of the Weld County Subdivision Reg-
ulations.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Melvin Blake, et al. , be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 30th day of
April, A.D. , 1980.

Re: Recorded Exemption #446
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Melvin Blake, et al for a recorded exemption. The parcel of
land on which this request has been made is described as part of the SW1
Section 12, T4N, R66W of the 6th P.M. . Weld County Colorado. This pro-
perty is located mile south of La Salle. The property contains approxi-
mately 78 acres of Class I and II irrigated soils. The request is to
split the property into parcels of 1 acre and 77 acres.
Mr. Blake wishes to convey the one acre parcel to Bruce Sandau in order
that he may build a residence. Mr. Sandau currently farms the property
for Mr. Blake and will remove the existing house on the one acre parcel.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends the request be ap-
proved for the following reasons:
1. The proposed split conforms with Section 9-2 of the Weld County
Subdivision Regulations (intent clause of the recorded exemp-
tion procedure) , Section 3.3. A of the Weld County Zoning Resolu-
tion (intent clause of the Agricultural Zone District) , and the
Weld County Comprehensive Plan in that the uses will be compatible
with surrounding agricultural uses. The request will allow agri-
cultural and related uses to be the predominant land uses. There
will be no reduction in the amount of land currently being used
for agricultural production. The proposed house will replace an
existing house on the one acre parcel.

3. The parcel is located within the comprehensive plan area of
the town of La Salle. The Town of La Salle Planning Com-
mission had no objections to this request for a recorded
exemption.
3. This request complies with the provision of Section 9-4 A.
of the Weld County Subdivision Regulations.

Dear Sirs :
My name is Bruce Sandau. I am 21 years old. I'm planninr to be
married in November 1980, and in need of a place to live.
I am farming Mr. Melvin Flake's farm south of La Salle and he has
offered to sell me an old house and one acre of ground to clean-up and
build a house on. The acre of ground hasn't been in production nor will
it ever be due to its location, with trees and other buildings in the
area.
I feel a house with improvements would up-grade the area and there-
fore I am requesting a recorded exemption on this parcel of land.
