• A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
January 11, 2007 at 10:00 a.m., in the Conference Room of the Weld County Planning Department at 918
10th Street, Greeley, Colorado.

CASE NUMBER: RS-1136
APPLICANT: Jason & Lisa Slater
PLANNER: Hannah Hippely
LEGAL DESCRIPTION: Lot 12, Black Hollow Acres, 1s' Filing, Section 33, T8N, R67W of the 6th
P.M., Weld County, Colorado.
REQUEST: Resubdivision for the creation of an additional lot.
LOCATION: North of and adjacent to CR 86; approx. 1/4 mile west of CR 19.
Hannah Hippely presented case RS-1136. The utilities will be provided by North Weld County Water
District, septic, propane, Poudre Valley REA. The applicant will maintain the existing easement in
compliance with the Weld County Code.
Jerry Adams asked if there could be some adjustments made to the final proposal to be in compliance
with the code. Those would include: Lot 1 a 15 foot front lot easement adjacent to Weld County 86, along
the property line; a 20 foot perimeter easement going north and south; everywhere lot 1 & 2 share a
common boundary there should be 10 foot side easements; Lot 2 a 20 foot utility easement instead of the
10 foot noted on eastern property line; northern 10 foot easement to a 20 foot easement. Ms. Hippely
asked about the northern boundary of lot 12 the abutting lot has a 10 foot easement along the line so is
there the need to increase the easement to lot 2 to 20 feet. Mr. Adams stated they would need to since it
• is the perimeter for this subdivision. Ms. Hippely stated the applicant would like to use the existing 30 foot
utility easement for an access as shown not increase to 60 feet. Mr. Hein, Department of Public Works,
stated they could use the drain for access.
Jerry Adams added the board recommends the applicant adjust the easements to come into align with the
code. Those include expanding the eastern utility easements in lot one and lot two from 10 foot to 20 foot;
a 20 foot easement along the eastern boundary of the subdivision; a 20 foot on northern boundary; a 10
and 10 foot easement between lot one and two and change flag pole portion of lot two from 60 ft to 30 ft.
Don Somer moved to approve the case with the proposed changes. Don Posselt seconded. Motion
carried.
CASE NUMBER: PF-1048
APPLICANT: Weld 45 Acres LLC
PLANNER: Jacqueline Hatch
LEGAL DESCRIPTION: Lot B of RE-2812; part of the S2 NW4 of Section 2, T2N, R67W of the
6th P.M., Weld County, Colorado.
REQUEST: Moorea Manor North Planned Unit Development Final Plan for eight (8)
lots with (E) Estate Uses (36.4 acres) and one (1) non-residential outlot
(6.8 acres) for open space.
LOCATION: West of and adjacent to CR 21-1/2 and approximately 1/2 mile south of
CR 26.
Jacqueline Hatch presented case PF-1048. Weld 45 Acres LLC c/o Jeffery Couch has applied for a Final Plat
for Moorea Manor North Planned Unit Development Final Plan for eight (8) lots with (E) Estate Uses (36.4
• acres) and one (1) non-residential outlot (6.8 acres)for open space.
The site is located West of and adjacent to CR 21 1/2 and approximately 1/2 mile south of CR 26. The site is
located directly north of the existing Moorea manor and the intent is to utilize the existing access. The
surrounding property consist of agricultural land to the north,east and west and a 9 lot minor subdivision to the
south(Moorea manor) The site is primarily level with the Lupton Bottom Ditch running north-south towards the
2008-2735
west side of the lot. The proposed PUD will be serviced by Central Weld County Water District Individual
sewer disposal systems Gas Excel Energy United Power Qwest.
• The Department of Planning Services is recommended that the applicant provides utility easement in
compliance with Section 24-7-60 and 27-9-40 of the Weld County Code.
The applicant has suggested using the entire open space A above Harpton Court, as a utility and drainage
easement.
Don Somer asked how utilities will get across the ditch and he recommends getting an agreement. Ms.
Hatch stated there is an existing crossing but it is just for the road. Ms. Hatch stated the agreement could
be modified to include utility easements. That could be in the Conditions of Approval prior to recording the
final plat.
Doug Melby suggested that the fire hydrant locations be consistent. They are located differently in
different plans so please review.
Jerry Adams indicated the open space will be listed as a utility and drainage easement and modify the
agreement for the ditch crossing.
Don Somer moved to approve with the proposed changes. Don Posselt seconded. Motion carried.
CASE NUMBER: PF-600
APPLICANT: John Zadel - Distant Thunder PUD
PLANNER: Michelle Martin
LEGAL DESCRIPTION: Part of the S2 Section 10, Ti N, R67W of the 6th P.M., Weld County,
Colorado.
REQUEST: PUD Final Plat for nine (9) lots with (E) Estate uses and one (1) common
• open space outlot(48.63 acres) and continuing Oil and Gas Production,
Distant Thunder PUD
LOCATION: East of and adjacent to CR 19; 1 mile south of Hwy 52.
Michelle Martin presented case PF-600. The services will be provided by Central Weld County Water
District, individual Septic, United Power and Qwest. The utility easements will be in accordance with Weld
County Code.
Don Somer asked if the open space easement could parallel lot 19 to match what is in Lot 1 & 9 to be
continuous. Mr. Hein added he would like to see an access easement for maintenance purposes around
the open space. Ms. Martin stated this has been included and is listed between lots 4 & 5. Mr. Adams
suggested extending the 20 foot drainage and utility easement across the open space as it is adjacent to
CR 19.
Rob Fleck added he would like to see-no fences on property line between lots that address the access.
Ms. Martin stated those will be addressed in the covenants.
Jerry Adams concluded that there be an extension of the 20 foot drainage and utility easement both north
and south across the entire width of the project and add to the covenants that no fences will be built along
the access easements.
Robert Fleck moved to approve with the proposed changes. Don Somer seconded. Motion carried.
