RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN ACCESSORY BUILDING
GREATER THAN 1 ,500 SQUARE FEET IN THE RESIDENTIAL ONE (R-1)
DISTRICT - TED AND SHEILA BAESSLER
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners held a public
hearing on the 18th day of July, 1984 , at the hour of 2: 00 o' clock
p.m. in the Chambers of the Board for the purpose of hearing the
application of Ted and Sheila Baessler, 2226 27th Avenue, Greeley,
Colorado 80631 , for a Use by Special Review for an accessory
building greater than 1 ,500 square feet in the Residential One
(R-1) District on the following described real estate, to-wit:
Lot 17 , Sonny View Estates, first filing,
Weld County, Colorado
WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance
provides standards for review of said Use by Special Review, and
WHEREAS , the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the re-
quest of the applicants and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented
in this matter, and having been fully informed, finds that this
request shall be approved for the following reasons:
1 . The submitted materials are in compliance with the
application requirements of Section 24 . 7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners
that the applicants have shown compliance with Section
24 . 4 . 2 of the Weld County Zoning Ordinance as follows:
a. The accessory building in the R-1 (Residential-
One) District is consistent with the Weld County
Comprehensive Plan. The structure will be con-
structed, occupied, operated, and maintained in
accordance with the requirements and procedures
set forth in Section 24 , Use by Special Review,
listed in the Weld County Zoning Ordinance.
b. The accessory structure will be compatible with
existing and future residential uses in the neigh-
borhood. The size and style of the structure do
not appear to have a negative impact on the neigh-

c. The City of Greeley Planning Commission recom-
mended conditional approval in a meeting held
June 12 , 1984 .
d. No overlay districts affect the site.
e. Use by Special Review Operation and Design Stand-

safety and welfare of the neighborhood and County.
NOW, THEREFORE , BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application for
a Use by Special Review for an accessory building greater than
1 ,500 square feet in the Residential One (R-1) District be, and
hereby is , granted subject to the following conditions:
1 . The attached Standards for Use by Special Review be
adopted and placed on the Use by Special Review plat
prior -to recording.
2 . The prescribed Use by _Special Review activity shall
not occur nor shall any building or electrical permits
be issued on the subject property until the Use by
Special Review plat has been delivered to the Depart—
ment of :Planning Services Office and the plat has
been recorded in the office of the Weld County Clerk
and Recorder.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 18th day of
July, A.D. , 1984 .

OPERATION STANDARDS

1. The permitted use shall be a five thousand six hundred (5,600) square
foot accessory structure for the purpose of storing antiques, antique
cars, show cars, recreational vehicles, and a canning kitchen.
2. The structure shall be constructed according to the design and style
requirements approved by the Seeley Lake Architectural Control Committee.
3. The structure shall not be used as a business for gainful employment of
the family residing on the property.
4. The accessory structure shall not be used as a permanent residential
dwelling unit.
5. The applicant shall comply with the design standards for the Use by
Special Review, Section 24.5 et seq. , of the Weld County Zoning
Ordinance.
6. The applicant shall comply with the Operation Standards for Uses by
Special Review, Section 24.6 et seq. , of the Weld County Zoning
Ordinance.
7. Representatives or members of the Weld County Health Department and Weld
County Department of Planning Services shall be granted -access onto the
site at any reasonable time in order to insure the operations carried out
on the site comply with the Operation Standards stated hereon and all
applicable Weld County Regulations.
8. The Use by Special Review area shall be limited to the plans -shown hereon
and governed by the Standards as stated above and all applicable Weld
County _Regulations. Any material deviations from the flans and/or
Standards as shown or stated above shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the
Board of County Commissioners before such changes from the plans and/or
Standards are permitted. Any other changes shall be filed in the office
of the Department of Planning Services.
9. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Standards. Noncompliance with
any of the above st-ated Standards may be reason for revocation of the
Permit by the Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated June 27, 1984, and duly published
July 5, 1984, in the La Salle Leader, a public hearing was conducted to consider
the application of Ted and Sheila Baessler for a Use by Special Review for an
accessory building greater than 1,500 square feet in the Residential One (R-1)
District. Lee Morrison, Assistant County Attorney, read this application into
the record. Mike Mullen, Planning Depai.Latent representative, read the favorable
recommendation of the Planning Canmission into the record and stated that nine
Operation Standards have been recommended in connection with this application.
Mr. Baessler was present and came forward to explain his request and answer
questions of the Board. He stated that they had no problem with the proposed
Operation Standards. Following discussion, Commissioner C. Carlson moved to
approve this Use by Special Review for Ted and Sheila Baessler with the proposed
Operation Standards. Commissioner Brantner seconded the notion which carried
by a unanimous vote.

the subdivision.
This will -be our personal home, no uses regarding
wastes, _retention facilities or stockpile areas.
The -acreage is going to be used for our personal living
residents—not commercially used_ It will be compatible
with the Comprehensive Plan of the County and
subdivision and will in no way interfere with any future
development of the surrounding land. Our plans have
already been approved by the Architectural Control
Committee of Seeley Lake. The house will have
approximately 7 ,O00 square feet.
The -proposed structure will -be used for storing our
hobbies which are antiques and antique cars, show cars,
also recreational vehicles. A canning kitchen beings we
are avid cooks, bathroom and office for easy clean up.
We have a number of vehicles which we don' t want our
yard looking like a car dealership. -The garage -will
protect against weather and vandalism! We intend to
have the acreage look like enestate-a very formal
(French) setting.. The separate garage is designed in
such a way that it will give the appearance of a guest
house, beings only one garage door will be visible.
Also the house garage doors will not beseen.
Landscaping will be arranged is such a may to protect
our solar, all will be professionally designed having
gazebos, conversation and play areas
