RESOLUTION
RE: ACTION OF THE BOARD OF COUNTY COMMISSIONERS CONCERNING THE
AMENDING OF DEVELOPMENT STANDARDS FOR SPECIAL USE PERMIT
402 :79 : 24 - STANLEY AND LINDA RECH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado , and
WHEREAS, on the 27th day of August, 1980 at the hour of
2: 00 o'clock p.m. , the Board of County Commissioners of Weld
County, Colorado considered the information presented by the
new owners of an oil field fluids disposal site, which site
was formerly owned by Stanley and Linda Rech, and
WHEREAS, the new owners of said oil field fluids disposal
site wish to modify the operation, and
WHEREAS, the Board deems it advisable to return said applica-
tion to the Weld County Planning Commission for review due to
said modification.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application of
Stanley and Linda Rech for Special Use Permit 402 :79 : 24 be, and
hereby is , returned to the Weld County Planning Commission for
review due to modifications proposed by the new owners of the
oil field fluids disposal site.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 27th day of
August, A.D. , 1980.

The following business was transacted:
I hereby certify that Pursuant to a notice dated July 21, 1980,
duly published July 24, 1980 and August 14, 1980 in the Johnstown Breeze,
a public hearing was held on the request of Stanley and Linda Rech for an
amendment to the development standards for Special Use Permit #402:79:24. •
Mr. F, Mrs. Rech were not present. Clinton P. Swift, legal counsel for
Robert Willingham and John A. Edmiston, was present and informed 'the Board
that these two gentlemen are the new purchasers of Mr. Rech's -facility.
Mr. Swift asked that todays hearing be continued, referred back to the
Planning Commission, and then be reheard by the Board at a later date.
Mr. Swift briefly commented on their plans for the facility. Commissioner
Earlson made a motion to approve the amendments and to refer this matter
back to the Planning Commission. Only the actual fees incurred by the
County on the revised application shall be assessed to the new owners.
This motion died for lack of a second. After much deliberation, Commissioner
- Carison made a motion to return this application back to the Planning
Commission for their review due to modifications proposed by the new
owners of the oil field fluids disposal site, and further the new application
shall be submitted on or before November 1, 1980. Commissioner Dunbar
seconded the motion and it carried unanimously. It was a consensus
of the Board that the new owners need not pay the full fee for a special
use permit but.that they pay only the actual costs incurred by the County.

1. The attached Development Standards being recommended and adopted for the
Special Use Permit.
2. No building or electrical permits shall be issued on the Special Use Permit
area until the attached Development Standards for the Special Use Permit
have been placed on the Special Use Permit plat and said plat has been
delivered to the office of the Department of Planning Services .
3. The applicant amending the Special Use Permit plat as follows : •
a. The Operations Diagram shall be amended to reflect changes in processing
of the oilfield fluids including the deletion of the gel pit stage.
DEVELOPMENT STANDARDS
STANLEY AND LINDA RECH
1. The water and oil fluids recycling and disposal site granted by this Special
Use Permit on the hereon described parcel is limited to the facilities shown
hereon. Said facilities shall be:
a. Emergency Lagoon - lined with bentonite with dimensions as shown hereon;
b. Main Lagoon #1 - lined with bentonite with dimensions as shown hereon;
c. One 200 barrel tank for use by Amoco Oil Company;
d. Five 400 barrel tanks for use by Amoco Oil Company;
e. Three 300 barrel tanks;
f. Parking area with dimensions as shown hereon;
g. Skim Pit (Pit #2) with dimensions as shown hereon;
h. Settling Pit (Pit #1) with dimensions as shown hereon;
i.. One circulating pump and motor;
j . One 8' x 10' structure for use by operator.
Additionally, all uses permitted by right in Section 3.3 of the Weld County Zoning
Resolution are allowed within the Special Use Prmit area.
2. Access to the Special Use Permit area is limited to one access point shown
hereon. The access shall have the approval of the Weld County Engineering
Department. The access shall be constructed in accordance with the recom-
mendations and/or requirements of the Weld County Engineering Department.
All private interior roads shall be graveled. Any damage caused to Weld County
roads due to seepage created by this request shall be cause for immediate re-
vocation of this permit and repairs shall be the financial responsibility of
the owner and/or operator.
3. All phases of the operation shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality, noise
emission, and sanitary disposal systems. Representatives or members of the
Weld County Health Department, Weld County Department of Planning Services
Zoning Inspectors and/or Colorado Department of Health shall be granted access
onto the site at any reasonable time in order to insure the operations car-
ried out on the site comply with all applicable Weld County and State Health
Regulations.
4. Upon cessation of operations at the site all structures shall be removed to
30" below grade and all ponds or pits shall be filled and graded so as to
conform with the surrounding terrain. The Special Use Permit area shall be
reclaimed to a farmable state upon completion of the operations. The property
shall be seeded in wheat or alfalfa or other appropriate ground cover approved
by the Soil Conservation Service.
5. Storage of oil field drilling and associated equipment shall not be permitted
within the Special Use Permit area.
6. Parking on County Roads 18 and 31 will be prohibited. Parking will only be
allowed within the property described hereon.

7. Construction of the lagoons and bentonite blanket embankment shall be in
accordance with the designs as shown on the Special Use Permit plat and the
recommendations as contained in the Chen and Associates Subsoil Investigation
Report, Job No. 19,083, dated August 29, 1979. Capacity of -the pond shall be
constrained by the designed capacity and actual size of the ponds as constructed
in accordance with the designs as shown on the Special Use Permit plat and the
recommendations as contained in the above report t19083 by Chen and Associates.
8. The settling pit and skim pit as shown hereon shall be screened with a one-inch
wire mesh to prevent wildlife gaining access to the pit. If at any time the lagoons
as shown hereon contain oil , the applicant shall be required to screen them in a like
manner as the settling pit.
9. There shall be a groundwater well to monitor possible leakage from the evapora—
tion ponds and other pits on the property. The Weld County Health Department
and the State Health Department shall have access to this well at all times
to determine possible contamination of the groundwater. This well shall be
installed as per Weld County Health Department guidelines for depth to ground—
water table.

10. The Weld County Health Department shall be given notice within a 24 hour period
of use of the emergency lagoon by the operator of the site. Such use must be
a true emergency and not for normal -storage of water or normal operations of
the site. This provision does not exclude the operator from keeping 12 to 18
inches of water in the emergency lagoon to prevent the bentonite lining from
drying out.
11.- The freeboard allowance for all dikes designed to retain water or other fluids
• shall be as specified by the Weld County Health Department.
12.-A11 pits, lagoons, and other excavations containing water at any time shall
be lined with bentonite or.other impervious material as per State and County
Health Department guidelines to prevent seepage to the groundwater.
•
13.-The operator shall provide measuring devices in all lagoons which will not damage
the bentonite lining. Said device shall be easily accessible and easily visible
to the Colorado Department of Health and Weld .County Health Department.
14. The lagoons may be fenced with a barbed wire security fence which shall be placed
no closer than 30 feet to the lagoon.
15. The Special Use•Permit shall be limited to the plans shown hereon and governed
by the Development Standards stated above and all applicable Weld County Regula—
tions. Any material deviations from the plans and/or Development Standards
as shown or stated above shall require the approval of an amendment to the
Special Use Permit by the Planning Commission and the Board of County Commissioners
beford such changes from the plans and/or Development Standards shall be per—
mitted. .Any other changes from the plans and/or Development Standards shall
be filed in the office of the Department of Planning Services.
16. The property owner and/or operator of this operation shall be responsible for
complying with all of the above stated Development Standards. Noncompliance
with any of the above stated Development Standards shall be reason for revocation
of the Special Use Permit by the Board of County Commissioners.

All private interior roads shall be graveled. Any damage caused to Weld County
roads due to seepage created by this request shall be cause for immediate re-
vocation of this permit and repairs shall be the financial responsibility of
the owner and/or operator.
3. All phases of the operation shall comply with all County and State Health
Standards and Regulations pertaining to air quality, water quality, noise
emission, and sanitary disposal systems. Representatives or members of the
Weld County Health Department, Weld County Department of Planning Services
Zoning Inspectors and/or Colorado Department of Health shall be granted access
onto the site at any reasonable time in order to insure the operations car-
ried out on the site comply with all applicable Weld County and State Health
Regulations.
4. Upon cessation of operations at the site all structures shall be removed to
30" below grade and all ponds or pits shall be filled and graded so as to
conform with the surrounding terrain. The Special Use Permit area shall be
reclaimed to a farmable state upon completion of the operations. The property
shall be seeded in wheat or alfalfa or other appropriate ground cover approved
by the Soil Conservation Service.
5. Storage of oil field drilling and associated equipment shall not be permitted
within the Special Use Permit area.
6. Parking on County Roads 18 and 31 will be prohibited. Parking will only be
allowed within the property described hereon.

7. Construction of the lagoons and bentonite blanket embankment shall be in
accordance with the designs as shown on the Special Use Permit plat and the
recommendations as contained in the Chen and Associates Subsoil Investigation
Report, Job No. 19,083, dated August 29, 1979. Capacity of •the pond shall be
constrained by the designed capacity and actual size of the ponds as constructed
in accordance with the designs as shown on the Special Use Permit plat and the
recommendations as contained in the above report #19083 by Chen and Associates.
8. The settling pit, skim pit, and lagoons as shown hereon, shall be screened
with a one-inch wire mesh to prevent wildlife gaining access to the pit. -
9. There shall be a groundwater well to monitor possible leakage from the evapora-
tion ponds and other pits on the property. The Weld County Health Department
and the State Health Department shall have access to this well at all times
to determine possible contamination of the groundwater. This well shall be
installed as per Weld County Health Department guidelines for depth to ground-
water table.
10. The Weld County Health Department shall be given notice within a 24 hour period
of use of the emergency lagoon by the operator of the site. Such use must be
a true emergency and not for normal storage of water or normal operations of
the site. This provision does not exclude the operator from keeping 12 to 18
inches of water in the emergency lagoon to prevent the bentonite lining from
drying out.
11.. The freeboard allowance for all dikes designed to retain water or other fluids
• shall be as specified by the Weld County Health Department.
12. All pits, lagoons, and other excavations containing water at any time shall
be lined with bentonite or other impervious material as per State and County
Health Department guidelines to prevent seepage to the groundwater.
13.-The operator shall provide measuring devices in all lagoons which will not damage
the bentonite lining. Said device shall be easily accessible and easily visible
to the Colorado Department of Health and Weld County Health Department.
14. The lagoons may be fenced with a barbed wire security fence which shall be placed
no closer than 30 feet to the lagoon.
15. The Special Use Permit shall be limited to the plans shown hereon and governed
by the Development Standards stated above and all applicable Weld County Regula-
tions. Any material deviations from the plans and/or Development Standards
as shown or stated above shall require the approval of an amendment to the
Special Use Permit by the Planning Commission and the Board of County Commissioners
before such changes from the plans and/or Development Standards shall be per-
mitted. .Any other changes from the plans and/or Development Standards shall
be filed in the office of the Department of Planning Services.
16. The property owner and/or operator of this operation shall be responsible for
complying with all of the above stated Development Standards. Noncompliance
with any of the above stated Development Standards shall be reason for revocation

Dear Mr. Rech:
We again observed pond construction at the subject site on
May 30, 1980. We have previously observed and tested construction of
the bentonite-sand liner and reported our results on several
occasions. In our opinion, the bentonite has been uniformly mixed to
a sufficient depth and the resulting bentonite-sand liner material
properly compacted. A permeability test previously conducted
indicated a permeability rate for the bentonite-sand liner within that
specified in our original soil and foundation investigation, Job No.
19,083 dated August 29, 1979.
Lagoon No. 2, located north of the subject evaporation pond, is
currently in use. Since a compacted soil layer has not been provided
above the bentonite-sand liner material, we recommend that a minimum
amount of water be kept in the pond to prevent cracking and shrinkage
of the liner.

1 . All slopes on Lagoon No . 1 and on the emergency
Lagoon have been constructed to a slope of 5 : 1 .
The slopes os shown on the plan of 31 Water
Disposal are 3 : 1 . The 5 : 1 slopes as constructed
will improve the operation of the system by making
the planting on the slopes easier to maintain and
will improve the erosion control of the slopes .
2. The entire sitecgraded to provide adequate drain-
age and with the high percolation quality of the
site, very little runoff will occur during a nor-
mal rain storm.
3. The slopes of the lagoons have been seeded as re-
commended in my letter of May 22, 1980 . Manure
and topsoil mixture were applied to the planted
area and mixed with the existing soil prior to
planting to provide a good seed-bed .
I further certify that the lagoons have been constructed ,
according_ to the plan and are in substantial compliance with
the approved plans and specifications outlined on the plan of
31 Water Disposal .

DEVELOPMENT STANDARDS
1 . The water and oil fluids recycling and disposal site granted by
this Special Use Permit on the hereon described parcel is limited
to the facilities shown hereon. Said facilities shall be:
a. Emergency Lagoon - lined with bentonite with dimensions
as shown hereon.
b. Main Lagoon #1 - lined with bentonite with dimensions as
shown hereon.
c. One 300 barrel tank for use by Amoco Oil Company
d. Five 400 barrel tanks for use by Amoco Oil Company.
e. Three 300 barrel tanks. •
f. Parking area with dimensions as shown hereon.
g. Skim Pit (Pit #2) with dimensions as shown hereon.
h. , Settling Pit (Pit #1) with dimensions as shown hereon.
i. 10 ' wide x 350 ' long fresh water and gel pit.
j . One circulating pump and motor.
k. One 8 ' x 10 ' structure for use by, operator.
Additionally, all uses permitted by right in Section 3. 3 of the

In company with Mr. Tom Lynch I inspected the oilfield fluids disposal
site. The large new pond which will apparently always have some water
in it is not covered to prevent waterfowl access.
The request from the Rochs' indicates that only water will be held
for evaporation in this pit. When we visited the site last Friday there
was an oily like substance on much of the south part of the pond.
As you are aware, we have no objections to the project as long as just
water is left in uncovered ponds. However, we feel that we must object
to any ponds left uncovered any time they contain pollutants as were
observed last Friday.

The seeding rate, as recommended by Oven Ayres and Associates, Inc., ex-
ceeds the seeding specifications of the Soil Conservation Service. This
excessive seeding rate may result in seeding failure due to competition
between seedlings for moisture and nutrients. The species involved in
this mixture are not compatible with each other and some are not adapted
to the site.
It is too late to change the seeding mixture since it is already planted.
I do suggest that the site be irrigated to insure a good stand of vegeta-
tion if voter is available. If not, should the seeding fail, I suggest
that Mr. Rech contact the Soil Conservation Service for an adequate seed-
ing recommendation.

Gentlemen:
As requested, we performed additional permeability tests on two samples of
the bentonite-sand liner material obtained from the bottom of the south pond
on February 26th, 1981 . The areas sampled were chosen by-department of Health
personnel . The samples obtained were remolded to approximately 96% standard
Proctor density at optimum moisture content and subjected to surcharge loads
of approximately 300 psf. The permeability- rate based on the falling head
test method was found to be 2. 1x10- and 3.1x10-5 cm/sec when measured between
March 2nd and 6th, 1981 . This rate is less than that suggested in our previous
engineering report.
The areas sampled were observed to contain very little bentonite. The
bentonite ranged from - to 2 inches thick with no cover layer of soil above it.
The samples were also tested for determination of standard properties. The
results of this testing are presented in the attached summary. Based on these
results, the bentonite does not appear to have been thoroughly mixed in some
areas of the pond bottom. Additional application of bentonite and/or better
mixing may be required.

This is to acknowledge receipt of your letter of March
30 , 1981 to Mr. Robert W. Willingham informing Mr.
Willingham that the Department of Planning Services staff
feels that seven months has been sufficient time for 31 to
prepare and submit a revised application for a Special Use
Permit to the Planning Commission.
Upon receipt of your letter , Mr. Willingham directed
engineers to prepare final drawings , which drawings were
prepared and submitted to Chen & Associates for their review
and comment. Chen & Associates completed its initial review
on or about May 1 of this year. Mr. Willingham then
proceeded to finalize said drawings in accordance with the
outline of the final plan for operation of 31 's site in Weld
County, Colorado . As a result of said review, it has been
necessary to resubmit the required blueprint and legal
description to Chen & Associates in order that they might
finally conform said blueprint and legal description to 31 ' s
actual plan of operation.
31 Disposal plans to submit a final Special Use Permit
to the Planning Commission of Weld County within the next
two to three weeks . As you know, during this period of
time, 31 has been actively working with the Colorado
Department of Health in order to ensure that its operation
of the south lagoon met with certain Chen & Associates
specifications set forth in the Special Use Permit .

31 Disposal appreciates the cooperation and patience of
the Planning Commission in this matter. As the Planning
Commission may well understand , given the problems with
obtaining approval from the Department of Health for the
south lagoon, 31 and Chen & Associates were reticent to
finalize this Special Use Permit application until such
application could be assured of receiving Colorado
Department of Health approval.

Gentlemen:
As requested, we observed and tested fill placement at the subject site
between November 5th and December 19th, 1980. Based on our observations and
the results of testing presented in our daily reports, we feel the embankment
extension has been properly compacted.
The bentonite-sand liner was found to range from 8 to 12 inches thick.
In our opinion, it has been uniformly mixed and properly compacted.
We previously performed a permeability test on a sample of the bentonite-
sand liner. The results of this test were presented in our letter dated
May 13th, 1980 under our Job No. 19,329. Samples of the bentonite-sand
liner obtained from the south and west embankment extensions of the pond on
December 16th, 1980 indicated Atterberg Limits and silt-clay contents similar
to those of the sample tested for permeability. In our opinion, the permea-
bility rate of the material placed in raising the south and west embankments
is similar to that of the liner material previously placed.
As of December 22nd, 1980, the final cover layer above the compacted
liner had not been placed. The liner material should be covered with a
minimum 4-inch blanket of con-site material as previously recommended.

This letter is in response to your letter of October 7 ,
1980 , to Mr. Robert W. Willingham, President of 31 Disposal ,
Inc. regarding 31 Disposal ' s operations in Weld County. As
you are undoubtedly aware , the undersigned represents 31
Disposal , Inc . with respect to the instant matter . In
addition to your October 7 , 1980 letter , this letter will
reflect the results of our meeting with various officials of
the Weld County Planning Department on or about October 28 ,
1980 , and our subsequent telephone conversations through
December, 1980 .
As a result of your letter and our meeting and various
conversations , it is the understanding of the undersigned
that the Colorado Department of Health is requesting that we
provide them with the "backup" information behind the May
30 , 1980 letter of Chen & Associates to Mr. S .L. Rech (a
copy of which is enclosed) which indicates that the south
lagoon meets the Chen & Associates specifications as set
forth in their original soil and foundation investigation ,
job number 19083 , dated August 29 , 1979 . The intent and
purpose of the "backup" materials is to establish the number
and types of tests performed by Chen & Associates for 31
Disposal , Inc . to ensure that the construction standards and
specifications for the south pond would provide an
impermeable barrier for percolation of "contaminating
fluids" to ground water , thus ensuring that the Colorado
Department of Health "Rules for Subsurface Disposal" have
either been complied with or are inapplicable to the instant
case . Specifically, Rule 7 .2 .2 (13) provides a definitiion
of "subsurface disposal system" to include systems utilizing
unlined lagoons . In the instant case , the purpose of the
bentonite-sand liner is to ensure impermeability and , more
importantly, to eliminate the possibility of percolation
into the ground water.
The enclosed information contains daily reportsCof Chen
& Associates for May 5 and 9 , 1980 indicating the tests
performed and the results of said tests . In addition, I
have enclosed a graph and summary of the laboratory tests
(table) prepared by Chen & Associates at that time . The
next document enclosed is a letter of May 13 , 1980 which is
written to Mr. Rech by Mr. Stephen L. Pawlak, P .E. , on
behalf of Chen & Associates setting forth the results of the
permeability tests performed by Chen & Associates on the
south lagoon of 31 Disposal , Inc . There are two separate
letters dated May 13 , 1980 , the second of which is more
detailed and sets forth the observations and testing
conducted by Chen & Associates as of May, 1980 . The next
document enclosed is a copy of daily report no . 5 dated May
15 , 1980 prepared by Chen & Associates , which is their
progress report for that date . The next document enclosed
is a letter dated May 27 , 1980 to Mr. Rech from David H.
Adams , II , P .E. , which summarizes the results of Chen' s
permeability tests for measurements between May 13 and May
27 , 1980 . The only problem, as of that date, appeared to be
with respect to the southwest portion of the pond . In
addition, I have enclosed a copy of the suiiuiiary of the
laboratory tests as of that date . The next document
enclosed is a letter dated May 29 , 1980 from Mr. Edward
Lind , Jr. , P .E. and L.S . No . 2730 indicating the results of
his inspection as of May 29 , 1980 , which letter is certified
by Mr. Lind . I have also enclosed a copy of the daily
report No . 5 dated May 29 , 1980 , prepared by Walter 0.
Schultz , as executed by Mr. Richard C. Hepworth, P.E. as of
May 29 , 1980 .
The final document is a letter dated May 30 , 1980 from
Mr. David H. Adams , II , P .E. to Mr. Rech which contains the
opinion of Mr. Adams to the effect that the bentonite liner
has been uniformly mixed to a sufficient depth and resultant
bentonite-sand liner material is properly compacted .
Given the information set forth above, which includes
the various tests performed by Chen & Associates , the
undersigned submits , on behalf of 31 Disposal , that the
bentonite-sand liner for 31 Disposal , Inc . has been properly

inspected , tested , and certified by a licensed professional
engineer for the State of Colorado , being individual members
of Chen & Associates , Inc . and meets all of the
specifications of their job no . 19083 dated August 29 , 1979 ,
which specifications were incorporated and made a
requirement of the final permit obtained by 31 Disposal ,
Inc. prior to using its south lagoon .
Once you' ve had an opportunity to review the above
information , I would be happy to discuss th.e matter with you
further and provide answers to any additional quest irons that
the Department of Health may have . It is my underseanding
that the above information should meet any and all testing
and information requirements of the Department of Health to
ensure that its rules governing subsurface disposal systems
have been met by ensuring that the south lagoon is lined and
that said liner is impermeable and prevents percolation of
contaminating fluids to ground water .

Dear Mr. Rech:
As requested, we performed a permeability test on a sample of the
bentonite-sand liner material.
The sample was remolded to density of 106.9 pcf at 9.0% moisture,
or approximately 96% of standard Proctor density, and subjected to a
500 psf surcharge loading. The permeability rate was measured between
December 31, 1979 and January 21 , 1980 and found to be approximately
1.8 x 10-8 cm/sec. This rate is generally considered to be
relatively impervious.
As of late December, 1979, the final cover layer had not been
placed. The liner material should be covered with a minimum 4-inch
blanket of on-site material as previously recommended. An energy
dissipator should also be provided at the pipe inlet to prevent erosion
of the liner.

Dear Mr. Rech:
As requested, we observed and tested the earthen liner being
constructed for the southern pond at the subject site on May 5 and
9, 1980. We previously conducted a subsoil investigation for the
proposed evaporation pond reported under our Job No. 19,083, dated
August 29, 1979.
At the time of our initial site visit on May 5, 1980, the pond had
been excavated and the contractor was in the process of placing and
compacting the bentonite-sand liner. The pond is approximately
250' x 750' , and on the order of 3 feet deep. Embankment sections are
earth and constructed on estimated 3:1 interior slopes (horizontal- to
vertical) . The exterior slopes are ground level with the exception of
the west side which has been filled, resulting in an embankment slope
on the order of 1-1/2:1. The maximum embankment slope as reconunended
in our previous investigation was 3:1. Additional fill will be
required along the west embankment.
The bentonite material had been _nixed into the natural sand and
compacted along the majority of the embankment slopes. The contractor
was in the process of mixing bentonite into the bottom of the pond.
Runoff from recent precipitation had puddled in the southwestern
portion of the pond. These wet conditions have delayed construction of
the liner. This area should be dried out before the bentonite is added
to the soil and the liner material compacted. At the time of our site
visit of May 5, 1980, mixing of the bentonite material was spotty and
the contractor was advised of the areas requiring additional mixing. A
total of 6 in place density tests were taken on the embankment slopes.
Test results, presented on the attached daily reports, indicate
compaction ranging from 93% to 100% standard Proctor density. In
addition, four samples were tested in our laboratory to determine total
silt and clay content and Atterberg limits. Test results are
summarized on the attached table, and indicate erratic mixing.

We again observed mixing and impacting of the liner material.on
on
May 9, 1980. Mixing of the bentonite on the pond slopes and bottom had
improved and appeared relatively uniform. A few localized areas were
observed which will require additional mixing. The contractor was
advised. The southwest portion of the pond remained wet and has
greatly reduced the workability of the site. The contractor was again
advised that these soils must be allowed to dry prior to addition of
the bentonite and compaction of the liner. A total of 7 in place
density tests were taken in the pond bottom during our May 9, 1980
visit. Compaction was satisfactory. At the request of the contractor,
a sample was obtained to perform a laboratory permeability test on the
bentonite-sand liner material. We anticipate that test results will be
available in two to three weeks, and will be forwarded under separate
letter.
In our opinion, construction of the bentonite-sand liner is
progressing satisfactory. Recent weather conditions have greatly
reduced the workability of the site ;,.x7 have affected mixing
procedures.

May 14, 1980. Ten holes were excavated across the pond to determine
the depth of bentonite. The bentonite was found to range from 7 to
10 inches thick. The average thickness was between 8 and 9 inches.
Bentonite has been added to the southwest portion of the pond where
wet soils had previously prevented liner construction. The soils in
this area remain very moist and the bentonite was found to be balling
up and not spreading evenly. Some additional work remains in this
area. Four additional samples were obtained and tested in our
laboratory to determine silt and clay content and Atterberg limits.
The test results are summarized on the attached table. Samples taken
in the southwestern portion of the site indicate erratic mixing.
As of our observation of May 14, 1980, the final cover layer to
be placed over the bentonite-sand liner material has not been placed.

Dear Mr . Rech :
This is to certify that on this date I made an inspection
of the construction on your property in the West one-half
Southwest one-quarter Section 22, Township 2 North, Range 66
West of the 6th Principal Meridian, Weld County, Colorado .
Following are the results of the inspection :
1 . All slopes on Lagoon No. 1 and on the emergency
Lagoon have been constructed to a slope of 5 :1 .
The slopes as shown on the plan of 31 Water
Disposal are 3 : 1 . The 5 :1 slopes as constructed
will improve the operation of the system by making
the planting on the slopes easier to maintain and
will improve the erosion control of the slopes .
2. The entire sitecgraded to provide adequate drain-
age and with the high percolation quality of the
site, very little runoff will occur during a nor-
mal rain storm .
3 . The slopes of the lagoons have been seeded as re-
commended in my letter of May 22, 1980 . Manure
and topsoil mixture were applied to the planted
area and mixed with the existing soil prior to
planting to provide a good seed-bed.

Dear Mr. Rech:
We again observed pond ctnstruction at the subject site on
May 30, 1980. We have previously observed and tested construction of
the bentonite-sand liner and reported our results on several
occasions. In our opinion, the bentonite has been uniformly mixed to
(7 a sufficient depth and the resulting bentonite-sand liner material
properly compacted. A permeability test previously conducted
indicated a permeability rate for the bentonite-sand liner within that
specified in our original soil and foundation investigation, Job No.
19,083 dated August 29, 1979.
Lagoon No. 2, located north of the subject evaporation pond, is
currently in use. Since a compacted soil layer has not been provided
above the bentonite-sand liner material, we recommend that a minimum
amount of water be kept in the pond to prevent cracking and shrinkage
of the liner.

Due to reported recent interest in disposal of wastes other than oil field
brines at your facility, this office felt that you should be informed of
the Colorado Health Departments position on this subject. The site review
of your facility was based upon disposal of oil brines only and did not ad-
dress disposal of any other types of wastes.
Therefore, before any attempt is made to accept and dispose of other types
of waste, you will need to receive approval` from this office, along with
Weld County, before acceptance of other wastes may take place.
