A well permit will be applied for through the State Division of Water Resources
once the Special Use permit has been approved. The 80 acre parcel is eligible
for a well permit, per the State Division of Water Resources, but must be
surveyed first. The property will not be surveyed unless the Special Use permit
is approved.

Anderson Consulting Engineers, Inc. (ACE) has completed a preliminary investigation regarding
potential water supplies for a commercial crop dusting operation, Aerial Sprayers, Inc., to be
housed on an 80 acre parcel in Section 5, Township 2 North, Range 66 West, in Weld County,
CO. Based on the development plan provided to us by AG and LANDProfessionals, LLC
(AGPro) the proposed business meets the criteria to obtain a permit for a commercial exempt
well. As implied by the name this type of well permit is given to individual businesses and is
exempt from augmentation requirements. Commercial exempt wells are subject to several
restrictions', including the following:
• Permit will only be issued on a lot created prior to June 1, 1972, or a parcel that is exempt
from subdivision laws or greater than 35 acres in size.
• Permits will only be issued to commercial businesses for inside uses. No outside uses are
permitted.
• Pumping is limited to 1/3 of an acre-foot (108,600 gallons) annually, and the pumping
rate shall not exceed 15 gallons per minute.
• The consumptive use of the water shall not exceed 10% of the volume of groundwater
diverted and return flow must be discharged to same stream system. An approved septic
tank and non-evaporative leach field is an acceptable discharge method.
• The proposed well must be the only source of water to the property, and the well must be
the only well on the site.
• A totalizing flow meter must be installed on the well. Permanent annual diversion
records must be maintained by the well owner and submitted to the SEO annually of

The information outlined in the development plan indicates that Aerial Sprayers. Inc. will be
able to meet all of these requirements. ACE performed a rough water demand analysis for
inside uses at the business based on SEO guidelines for water use and determined that the
annual gross pumping will be 73,100 gallons. The calculation assumed four day-employees
(15 gallons / employee/ day) for 245 days (March—October) and two on-site proprietors (80
gallons / person / day) year around. It is also stated in the development plan that an
individual sewage disposal system will be constructed on site, which is in keeping with the
well restrictions as long as it is not an evaporative system. The SEO estimates consumptive
use of water from inside uses with leach field type septic systems as 10% of the gross
pumping. A search of well permit records from the SEO has indicated there are no registered
wells in Section 5, this is a good indication that the property has no other water source,
providing it is not within the service area of a municipal system and there are no unregistered
wells. The SEO requires that the applicant provide an affidavit along with the well
application affirming that the property has no water other water source..

GUIDELINES FOR COMMERCIAL DRINKING AND SANITARY WELLS OUTSIDE A DESIGNATED GROUNDWATER BASIN
For all commercial drinktna and sanitary wells:

B. The parcel on which the wall would be located, must be:

8. The consumptive use of the water shall not exceed 10%of the volume of ground water diverted. An approved septic tank and
non-evaporative leach field is an acceptable discharge method. Other types of disposal systems must be evaluated to
determine the amount and location of the return flow.
9. A totalizing flow meter must be installed on the wall. Permanent annual diversion records must be maintained by the well
owner and submitted to the Division of Water Resources annually or upon request.
For existino commercial wells out to beneficial use for drinkino and sanitary purposes odor to May 8. 1972:
4. The well must be the only commercial well serving the business.
5. The amount of ground water diverted shall not exceed one (1) acre-foot annually (325,900 gallons). The applicant must
support the apprcation with evidence that the proposed use will not create a demand greater that one(1) acre-foot.
6. The claimed date and use must be supported by a written field inspection report prepared by personnel from the State
Engineers Office.
7. A totalizing flow meter may be required to be installed on the well, and permanent annual diversion records be maintained by
the well owner and submitted to the Division of Water Resources annually or upon request.
