HomeMy WebLinkAbout810662.tiff RESOLUTION RE: APPROVE AGREEMENT WITH COOKSLEY GEOPHYSICS, INC. TO USE COUNTY ROAD RIGHT-OF-WAY FOR SEISMOGRAPH TESTS AND AUTHORIZATION FOR CHAIRMAN TO SIGN SAME. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, an agreement between the Board of County Commissioners of Weld County, Colorado, and Cooksley Geophysics, Inc. , 624 North 4th Street, Sterling, Colorado 80751 has been presented to the Board of County Commissioners for approval, and WHEREAS, Cooksley Geophysics, Inc. desires to conduct seismograph testing for oil and gas exploration in a portion or portions of Weld County, upon and along certain public road rights-of-way within Weld County, as specified in the attached underground and utility permit, and WHEREAS, said agreement provides for restrictions and specific instructions as set forth in Exhibit "A" of said agreement, a copy of which is attached hereto and made a part hereof. NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners has studied said Agreement and Exhibit "A" between Weld County and Cooksley Geophysics, Inc. be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman is hereby authorized to sign said agreement. Steinmark DATE PRESENTED : NOVEMBER 16 , 1981 AGREEMENT THIS AGREEMENT, entered into this 9th day of November , 19 81 , between the BOARD OF COUNTY COMMISSIONERS of the COUNTY OF WELD, STATE OF COLORADO, hereinafter called the "County" and COOKSLEY GEOPHYSICS, INC. , 624 NORTH 4TH STREET, STERLING, COLORADO 80751 ' WHEREAS, COOKSLEY GEOPHYSICS, INC. is preparing to conduct Seismograph testing within the County of Weld for Oil and Gas Exploration and desires to do testing in a portion or portions of said County upon and along the right-of-way of certain public roads within said County; NOW THEREFORE, for and in return for good and valuable consideration to the County paid by COOS GEOPHYSICS, INC. , the receipt of which is hereby acknowledged, and operate Seismic Exploration operations in, under, upon and along the public highways situated and described on the foregoing Underground and Utility Permit: Restrictions and specific instructions: See Exhibit "A" It is understood and agreed that WUKSLEY GEOPHYSICS, INC. , may conduct Seismic operations along the rights-of-way, but that roads shall be kept open for traffic. CI: ESLEY GEOPHYSICS, INC. agrees to leave said roads in as good condition as existed immediately prior to the beginning of said operations. COOKSLEY GEOPHYSICS, INC. covenants and agrees with the County that it will protect and save harmless and indemnify the County, its agencies thereof, and their officiers and employees from and against all liability, loss damage and expense suffered by or imposed by the County by reason of conducting and operating of said Seismic operations. It is understood and agreed that no oiled road surface shall be cut and will be crossed with boring only. Tb provide Weld County a list of all well owners that could be affected and provide proof each owner has been contacted and advised of this operation. 3. That no hole is to be shot within 800 feet of a well without specific written permission of the well owner. 4. That if damage should occur within the right-of-way that would require repair with a motor-grader, Weld County may perform repair work and be reimbursed at the rate of $40.00 per hour. 5. To provide the Weld County Engineer with weekly progress reports stating which holes have been drilled, which holes have been repaired and any damages or problems that have occurred on or off the rights-of-way. 6. To backfill and gravel holes within ten (10) days of test completion. 7. That this agreement allows testing only on the highways described on the fore- going Underground and Utility Permit. 8. That no paved roads are to be cut or drilled. 9. That holes are not to be drilled on the road surface, but may be drilled from the edge of the shoulder to the right-of-way line. Lines and as per attached letter This work shall be completed within —. ( ) days fran the issue date. No work shall be allowed on Saturdays or Sundays. IT IS UNDERSTOOD that the Permittee will cause installation at no expense whatsoever to Weld County and the Permittee will own and maintain the sane after installation. The cable line shall be installed beneath the surface of the right-of-way at a minimun cover of 36 inches and the disturbed portion of the right-of-way shall be restored to its original condition. All Leckfilling shall be in eight inch lifts and nechanically compacted to 95% of Standard Proctor. All road crossings shall be bored. Said installation shall be encased in pipe of larger diameter when required and the crossing shall be as nearly perpendicular to the roadway as physically possible. No water shall be used in the boring and no tunneling shall be permitted. Where the installation crosses any ditch, canal or water carrying structures, wherever possible it shall he pusled through and beneath in a pipe of larger diameter thereby eliminating the necessity of trenching. In no case shall the flow of water ever be impaired or interrupted. The applicant shall obtain permission to cross all irrigation ditches fran the owner of each ditch. This work must be accomplished in accordance with acceptrd good practices and conform to the recommendations of the National Electric Safety Code and to such statutes an are applicable. Construction warning signs, conforming to the Uniform Traffic Control Device Manual and to the Colorado Supplement, shall be in place daily prior to starting any work. If proper signs are not in place during any work, the County Engineer or his authorized agent shall immediately stop all work until proper signs are in place. Traffic shall be maintained on all roads at all tines. Flagmen shall be provided at any locations where the orderly flow of traffic is interrupted. The Permittee shall maintain the installation at all tines and agree to hold Weld County, Colorado, the agencies thereof, and their officers and employees harmless fran any and all loss and damage or any claims which nay rise out of or be connected with the installation, maintenance, alteration, renoval or presence of the installation herein referred to or any work or facility connected herewith, within the area covered by this permit. If it becomes necessary to change the location of the proposed line, written approval must be secured fran the County Engineer. Permittee will he required to shut off lines and remove all cunbustible materials fran the County right-of-way when requested to do so by Weld County, Colorado, because of necessary highway construction or maintenance operations. Permittee shall mark this installation with markers acceptable to Weld County, Colorado, a mininun of two signs per mile, and shall be marked by two signs at each bridge or ditch crossing, and at each road crossing. In the event any changes are made to this roadway in the future that would necessitate removal for relocation of this installation, Permittee will do so promptly at its own expense upon written request fran Weld County, Colorado. All requests for installation will be reviewed in the flab: by representatives of Weld County, Colorado, prior to any issuance of any permit. 18. Where special cases warrant,weld County will permit. IP installation of underground utilities paralleling high- ways along the slope of the shoulder. In the event sari] permits are issued, it will be required by the contractor that material removed must be replaced in like kind and with same or better compaction. No segregation of material will be permitted. 19. The construction of undesgrouiid installations will centrally rcqui re the services of an inspector furnished by Weld County, Colorado. The decision in regard to which project requires inspection is reserved by Weld County, Colorado. All extraordinary costs relating to the inspection of such utility installation will be borne by the Perndttee at a rate specified by Weld County, Colorado. 20. All drainage facilities or siphons will be opened irulediotely upon mlpletion of work at sites of drainage or siphon installation. Damaged portion of drainage or siphon facility will be replaced. All damaged sections are to be inspected by Weld County, Colorado, before being concealed in any manner. Drainage ditches or borrow pits are to be restored to original condition immediately after tackfil]ing is carpeted. 21. No peters are to be placed within the highway right-of-way, excepting within corporate limits where municipal regulations allow installation. 22. Thrust blocks will be raiguired on all vertical ant horizontal bends in water pipes. 23. Weld County, Colorado, does not warrant county right-of-way. Tie Permdttee shall determine all ownership and property lines. 24. Weld County, Colorado, nay require a nrnte'nneitallt' rash or ,surely load to insure carpliance with the provisions of this permit. The bond will remain in effect for a period of one year after all work has been completed. The total mount of the bond will be determined by Weld County, Colorado. 25. Ml necessary new gravel shall be placed on all surfaces where any damage has occurred to the road surface from equiprent, trenching, or storage of material. Weld County, Colorado, shall determine the damaged areas and depth of new gravel. 26. The installation of non-ferrous lines in rood right-of-way shall require a suitable means to facilitate future line location. 27. For all utilities, regardless of installation, permit fee shall be based upon trench width as follows: Up to 6 inches -- $0.02 per lineal foot, 7 inches through 12 inches -- $0.05 per lineal foot, 13 inches through 24 inches -- $0.09 per lineal foot, 25 inches through 36 inches -- $0.14 per lineal foot, 37 inches and above — $0.18 per lineal foot. Minirnun permit fee will hi $10.00. ADDITIONAL SPECIAL CONDITIONS • The permit is being issued for Seismic Exploration for oil and gas. Requirements within this permit regarding utility installations that will remain in the right-of-way will not apply. All other requirements and restrictions applicable to this work remain in force. VGeology •Geophysics • Engineering • Weld County Board of Commissioners Centennial Building Greeley, Co. 80632 Dear Sirs; Cooksley Geophysics Inc. respectfully requests permission to conduct a seismic survey in and along the barr ditch of Weld County Rd. #90 beginning 10 miles west of Briggsdale continuing westerly across Weld County to the Larimer County line. Four crews will be involved in this survey, consisting of: 1. Survey Crew a. lay out and survey land in barr ditches. b. place pin flags and shot lathe in ditches. 2. Drilling Crew a. drill a 4" hole varying in depth from 150' to 200' deep. b. place a 25 to 35 lb. charge of dynamite in said hole. c. holes will be drilled no closer than 600' to houses and 800' to wells. 3. Shooting Crew a. lay out cable and geophones in ditches. b. set off charges in holes for seismic print out. c. pick up said cable and geophones. 4. Reclamation Crew a. to fill holes and retrieve any flags, wire, caps, and other trash overlooked by shooti$g crew. In consideration for granting this permission, Cooksley Geophysics Inc. is willing to adhere to special conditions that may be required.
