Dear Sir:
By the inclosed correspondence you are hereby notified of an activity
performed without proper Department of the Army authorization pursuant
to:
( ) Section 10 of the River and Harbor Act of 1899
( x) Section 404 of the Clean Water Act

In accordance with final regulations published in the Federal Register,
Volume 42, No. 138 on 19 July 1977, governing the permit program of the
Corps of Engineers, we are required to solicit the views of appropriate
Federal, State and local agencies. This information will be evaluated
in conjunction with prescribed policy and guidelines to determine what
further administrative and/or legal action will be taken.
Accordingly, we request your comments on or before 17 September 1981.

The following activity was performed without proper authorization pursuant
to section 404 of the Clean Water Act:

Location: Little Thompson River, SW a of Section 19, Township 4 North,
Range 68 West, Weld County, Colorado
Activity: Mr. Carroll's work forces have placed earth and broken concrete
as riprap for approx. 1500' of bankline. In at least one
area the river alignment has been changed and an estimated
2000 cubic yards of embankment has been relocated along the
bank.

Dear Mr. Carroll:
It has come to my attention that your work forces were responsible for placing
earth and broken concrete for bank stabilization in the Little Thompson River
in the SW 4, Section 19, Township 4 North, Range 68 West, Weld County, CO.
Section 404 of the Clean Water Act (33 USC 1344) requires authorization from
the Corps of Engineers prior to start of work for the discharge of dredged or
fill material into waters of the United States.
Since you have not applied for and received the required authorization, you are
in apparent violation of the Act and are hereby directed to cease and desist
any further filling activity in the waterway. This cease and desist will remain
in effect until notified otherwise.
Current regulations require that unauthorized activities are coordinated with
the Environmental Protection Agency, the US Fish and Wildlife Service, and other
appropriate Federal, state, and local agencies to assist in determining what
further legal and/or administrative action to take.
Should you elect to remove the unauthorized fill, I will take no further action
provided you comply with the following:
a. The fill material is removed in its entirety from the waterway and deposited
landward in such a manner as to prevent it from reentering the waterway or
possible wetlands;

b. The removal is accomplished in such a manner as to minimize any further
degradation of water quality and damage to aquatic life outside the immediate
area of removal;
c. The rennval is perfoined by means other than using a bulldozer;
d. The work is accomplished within fifteen (15) days from receipt of this
letter.
If I do not hear from you within ten (10) days of receipt notifying me of your
intentions, I will proceed with the coordination mentioned above.
