Larson 1888 Sherman Street, Ste. 415 Denver, CO 80203 Re: Water Supply for Arbor Valley Nursery Weld County Property Dear Mr. Larson: With this letter, I am providing information concerning the adequacy of the water supply available to the Arbor Valley Nursery at the property located north of the Town of Lochbuie in Section 30, Township 1 North, Range 65 West, of the 6th P.M., Weld County, Colorado. Arbor Valley plans to use this property for a plant and tree nursery operation. Arbor Valley's water consultants, Bishop-Brogden Associates, Inc., have estimated that, at full operation, the nursery will require approximately 384 acre feet of water per year for irrigation purposes, resulting in approximately 110 acre feet per year of consumptive use. It is my understanding that the physical supply for the nursery operation will be taken from two existing wells with Permit Nos. 267 and 268. Copies of the well permits for these wells are enclosed. Because the water rights associated with these wells are junior in priority, they will require augmentation or replacement water for the consumptive use amount in order to provide a reliable water supply. Arbor Valley intends to provide augmentation water through its contract with the Central Colorado Water Conservancy District ("Central District"). I have enclosed a copy of Contract No. 242 between the Central District and RES-0420, LLC for Arbor Valley Nursery. This contract evidences the Central District's commitment to provide augmentation water for the wells with Permit Nos. 267 and 268 in the amount of 256 acre feet annually. The Central District has recently obtained Water Court approval of a plan for augmentation covering its member wells. A decree in Case No. 02CW335 was entered by the Water Court for Water Division 1 on June 3, 2005. Currently, the Central District has allocated to its member wells a quota of available augmentation water in the amount of 50% of the contractual commitment. The Central District anticipates that this 50% quota will be maintained and increased as it acquires additional water supplies for augmentation purposes after meters have been installed on the two wells on the property.
