RE: INTENT OF WELD COUNTY TO APPLY FOR A SMALL CITIES COMMUNITY
DEVELOPMENT BLOCK GRANT ON BEHALF OF WATTENBERG IMPROVEMENT
ASSOCIATION AND AUTHORIZATION FOR CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, an Intergovernmental Cooperative Agreement, between
Weld County, Wattenberg Improvement Association and the Larimer-
Weld Regional Council of Governments, has been presented to the
Board of County Commissioners, and
WHEREAS, said agreement certifies that Weld County agrees
to submit an application for a Small Cities Community Development
Grant on behalf of the Wattenberg Improvement Association to the
Colorado Department of Local Affairs, and
WHEREAS, the purpose of said Block Grant is to upgrade and
expand the public water system in the unincorporated area of Weld
County known as Wattenberg, and
WHEREAS, Wattenberg has a large proportion of persons on
low and moderate income, and
WHEREAS, certain conditions exist with the public water
system which pose dangers to the health, safety and welfare of
said citizens, and
WHEREAS, the Board, after study and review, deems it advis-
able to apply for said Block Grant as stated in the Intergovern-
mental Cooperative Agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the intent of Weld County
to apply for a Small Cities Community Development Block Grant
on behalf of Wattenberg Improvement Association be, and hereby
is, approved, with the terms and conditions to be as stated in
the Intergovernmental Cooperative Agreement, a copy of which is
attached hereto and incorporated herein by reference.
BE IT FURTHER RESOLVED by the Board that the Chairman be,
and hereby is , authorized to sign said agreement.

DOCKET #82-76
The Weld County government is eligible to apply for a State of Colorado
Community Development Block Grant (CDBG) . This program will be making grants
of up to $850,000 to cities and counties for community development projects.
Activities eligible for funding by CDBG include: housing rehabilitation or
weatherization; construction of senior centers; park improvements; upgrading
of streets, sewer, or water systems, etc.
The Wattenberg Improvement Association has requested that Weld County apply
for a grant for the Association to improve Wattenberg's water supply system by
adding a well , improving the distribution system, and adding other new
equipment.
A public hearing will be held at 10:00a.m. on November 15, 1982, at the Weld
County Building at 915 10th Street in Greeley, to hear comments on the
proposed project.

9. In the space provided, give a broad overview or general description of
the proposed project. Indicate all public and private participants and
their relationship to the completion of the project.
The activities proposed by this project address deterioration of suitable housing
in Gill , Colorado through the rehabilitation of 26 owner-occupied homes and 8 renta
units in need of substantial rehabilitation. Other activities included are the
reconstruction of a water ditch that borders the east and south side of Gill and a
clearance, clean-up program. County departments that will be involved in the pro-
ject include the Housing Authority, which will administer the project, the Depart-
ment of Social Services , which will furnish office space, the County Code Enforce-
ment Division and the Division of Human Resources, who will undertake weatheriza-
tion activities in conjunction with the rehabilitation activities.

The need for housing rehabilitation, reconstruction of a water ditch and
clearance and clean-up efforts were identified. At the public hearing
conducted on 10-26-82 there were no negative comments on the proposed
activities .

The Weld County Comprehensive Plan adopted September, 1973 provides :
"Pressures for urbanization must be recognized and accommodated so that
growth which occurs is directed and controlled, minimizing any negative
impact. . . . Any further expenditure of public funds for urban type
services and facilities should be used to upgrade and expand existing
services and facilities. " This project provides for upgrading of housing
in Gill , reconstructing a drainage ditch, and cleaning up the community.
We have determined that activities are consistent with local development
strategies . The project will be coordinated with the Division of Human
Resources Weatherization Program and Weld County Code Enforcement.

to ensure project success , local taxing efforts to address continuing
development and maintenance needs, and local citizen support.

The residents of Gill are extremely committed to the project. Primarily due
to low income, many of the homes are in need of repair, and this project will
provide the opportunity to upgrade and improve the housing units. Residents
have already participated and assisted with collection of data and input at
the town meetings. Local advisory committees will establish policies related
to clean-up and common ground improvement and maintenance. This project will
not require additional taxation for future development/maintenance. See attached
newspaper articles .

their relationship to the completion of the project.
Weld County is applying in behalf of the Wattenberg Improvement Association
for a project to improve Wattenberg's public water system. The main Project
objective is to protect the public health by: providing a reliable water
system; improving water flow and pressure; increasing water supply; increasing
water conservation; and meeting maximum daily usage rates and fire demand.
Project activities would include: the development of a standby well and
power supply, residential water meters , rehabilitation of existing treatment
facilities and upgrading of the water distribution system. If funded, Weld
County would contract with the Larimer-Weld Regional Council of Governments
(LWRCOG) for project and grant administration.

Citizen comments at the public hearing were supportive of the project.
It was stated that the community had long acknowledged the water systers'
problems and that the Wattenberg Improvement Association had been working
on the problem for 2 years. At a citizen meeting in April 1981, the
citizens indicated top community development priorities were water, sewers,
and street improvements, in that order.

Since Wattenberg is not incorporated it does not have an adopted comprehensive
plan. The Project is consistent with policies in the Weld County Comprehensive
Plan which states , "The Board of County Commissioners is. . .responsible to the
public to see that these facilities [water, sewer and other utilities] are
adequately supplied and that they meet certain standards. " (p. 75) The
Wattenberg Improvement Association, a group of concerned local citizens, has
identified two important community development needs : water system improvements,
and construction of a sewer system. Water system improvements are the Association 's
first priority for implementation.

The Wattenberg Improvement Association received a $10,000 grant from the Rural
Development Corporation in 1980 to finance engineering feasibility studies for
both the water and sewer systems. The Association has also submitted an app-
lication to the U.S. Farmers Home Administration (FmHA) in May, 1981 for a
grant to fund a portion of the water system improvements. The Project did
not meet all FmHA grant qualifications and the Association is currently preparirg
another application for FmHA to finance construction of a water storage facility.
_ Wattenberg's water system improvements are included in the 1982 Colorado Water
Needs Categorization List.

ThetWatten ers Community has a governing board of 7 people who are elected
by nity to 3 year terms that will act as the advisory committee
for the project.

The LWRCOG has extensive experience in managing large federal grants with
extensive statutory and regulatory requirements. Past grants administered
include: EPA Section 208 Water Quality, EPA Section 175 Air Quality Planning,
Law Enforcemert Assistance (LEAA) , Federal Highway Administration 's Metropolitan
Planning for Transportation, etc. The LWRCOG Executive Director has past
experience in administrating HUD CDGB grants for water and sewer projects.

Part IV - Local Commitment

Due to high percentage of low and moderate income persons in Wattenberg,
no locally funded efforts could be made to fund this project. The
Wattenberg Improvement Association does have a strong committment to
this project as evidenced by their efforts to apply for grants and/or loans
from the Farmers Home Administration (FmHA). They have applied for a FmHA
"Water and Waste Systems for Rural Communities" grant and are currently
working with FmHA on a possible loan/grant package. Based on citizen
comment at prior public hearings, the Association is willing to raise the
water rates from $8.00/month per household to as high as $12.00/month.
The FmHA package would be in addition to funding from the CDBG program
and would fund the construction of a larger water storage tank.

APPLICANT STATEMENT CF ASSURANCES AND CERTIFICATIONS
The applicant hereby assures anC certifies that :
.al It possesses legal authority to apply for the grant , and to execute :ne
proposed program.
(b) Its governing body has duly adopted or passed as an official act a resolution,
motion or similar action authorizing the filing of the application, including
all understandings and assurances contained therein, and directing and
authorizing the applicant 's chief executive officer to act in connection with
the application and tc provide such additional information as may be required .
(c) Prior to submission of this application, it has conducted at least one public
nearing to obtain citizen input on community development needs and priorities
in the community and on the proposed
•
p p project for which application for funds
is being made.
(d) Its chief executive officer or other officer of applicant approved by the
State:
( 1 ) Consents to assume the status of responsible Federal official under
the National Environmental Policy Act of 1969 (NEPA) and other pro-
visions of Federal law, as specified in 24 CFR Part 58, which further
the purposes of NEPA, insofar as the provisions of such Federal law
apply to the Colorado Community Development Block Grant Program:
(2) Is authorized and consents on behalf of the applicant and himself/herself
to accept the jurisdiction of the Federal courts for the pu rose of
enforcement of his/her responsibilities as such an official .
(e) The proposed project has been developed so as to give maximum feasible
priority to activities which will benefit low- and moderate- into-e families
or aid in the prevention or elimination of slums and blight . (The re-
quirements for this certificationwill not preclude the State from
approving an application where the applicant certifies and the State
determines , that all or part of the proposed project activities are designed
to meet other community development needs having a particular urcency
because existing conditions pose a serious and immediate threat to the
health andwelfare of the community and where other financial resources are
not available to meet such needs. )
(f) It will comply with the regulations , policies , guidelines and requirements
of OMB Circulars Number A-87 and A-102, Revised, as specified
by .he state,
which related to the application, acceptance and use of Federal `unds .
(g) It will comply with:
ll ) Section 110 of the Housing and Community Development Act of 1974 , as
^ended, 24 CFR 570.605, and any State regulations regarding the
administration and enforcement of labor standards ;
(2) The provisions of the Davis-Bacon Act (46 U.S.C .S 276a) with respect
to prevailing wage rates (except for projects for the rehabilitation
of residential properties of fewer than eight units) ;
(3) Contract Work Hours and Safety Standards Act of 1962, 40 U.S.C. 327-332,
requiring that mechanics and laborers employed on federally assisted
contracts be paid wages of not less than one and one-half times their
basic wage rates for all hours worked in access of eight in a calendar
day or, forty in a work-week, whichever is greater; and
(4) Federal Fair Labor Standards Act, 29 U.S.C. S 201 et seq, requiring
that covered employees be paid at least the minimum prescribed wage,
and also that they be paid one and one-half times their basicwage
rate for all hours worked in excess of the prescribed ,ork-•:,eek.
(h) It will comply with:
(1) Title VI of the Civil Rights Act of 1964 (Pub. L.88-352) , and the
regulations issued pursuant thereto (24 CFR Part 1) , which provides
that no person in the United States shall on the grounds of race,
color, or national origin, be excluded from participation in, be
denied the benefits of, or be otherwise subjected to discrimination
under any program or activity for which the applicant receives Federal
financial assistance and will immediately take any measures necessary
to effectuate this assurance. If any real property or structure
thereon is provided or improved with the aid of Federal financial
assistance extended to the applicant, this assurance shall obligate
the applicant, or in the case of any transfer of such property , any
transferee, for the period during which the real property or structure
is used for a purpose for which the Federal financial assistance is
extended, or for another purpose involving the provision of similar
services or benefits;
(2) Title VIII of the Civil Rights Act of 1968 (Pub. L. 90-284) , as
amended, administering all programs and activities relating to housing
and community development in a manner to affirmatively further fair
housing; and will take action to affirmatively further fair housing
in the sale or rental of housing, the financing of housing, and the
provision of brokerage services ;
(3) E.O. 12259, Leadership and Coordination of Fair Housing in Federal
Programs, requiring that programs and activities relating to housing
and urban development be administered in a manner affirmatively to
further the goals of Title VIII of the Civil Rights Act of 1968;
(4) Section 109 of the Housing and Community Development Act of 1974
(ACT) , as amended, and the regulations issued pursuant thereto
(24 CFR 570.601 ) , which provides that no person in the United States
shall , on the grounds of race, color , national origin, or sex, be
excluded from participation in, be denied the benefits of, or be
subjected to discrimination under, any program or activity funded
in whole or in part with funds provided under the Act. Any pro-
hibition against discrimination on the basis of age under the Age
Discrimination Act of 1975 or with respect to otherwise qualified
handicapped individuals as provided in Section 504 of the
Rehabilitation Act of 1973 shall also apply to any such program
activity;
(5) Executive Order 11063 on equal opportunity in housing and nondiscrimina-
tion in the sale or rental of housing built with Federal assistance;
and
(2)
(6) Executive 0-der 11246 as amended by Executive Orders 11375 and
12086, and the regulations issued pursuant thereto (24 CFR Part 130
and 41 CFR Chapter 60) , which provide that no person shall be
discriminated against on the basis of race, color, religion, sex or
national origin in all phases of employment during the performance of
federal or federally assisted construction contracts . Contractors
and subcontractors on Federal and federally assisted construction
contracts shall take affirmative action to insure fair treatment in
employment, upgrading, demotion, or transfer; recruitment or re-
cruitment advertising; layoff or termination, rates of pay or other
forms of compensation and selection for training and apprenticeship.
(j) It will comply with Section 3 of the Housing and Urban Development Act
of 1968, as amended, requiring that to the greatest extent feasible
opportunities for training and employment be given to lower-income persons
residing within the unit of local government in which the project is
located; and that contracts for work in connection with the project be
awarded to eligible business concerns which are located in, or owned in
substantial part by, persons residing within the unit of local government.
(k) It will :
(1 ) Comply with Title II (Uniform Relocation Assistance) of the Uniform
Relocation Assistance and Real Property Acquisition Policies Act of
1970 and HUD implementing regulations at 24 CFR Part 42 and 24 CFR
570.602(a) ;
(2) Provide relocation payments and offer relocation assistance as
described in Section 205 of the Uniform Relocation Assistance Act
to all persons displaced as a result of acquisition of real property
for an activity assisted under the Community Development Block Grant
program. Such payments and assistance shall be provided in a fair
and consistent and equitable manner that insures that the relocation
process does not result in different or separate treatment of such
persons on account of race, color, religion, national origin, sex,
or source of income;
(3) Assure that, within a reasonable period of time prior to displacement,
comparable decent, safe and sanitary replacement dwellings will be
available to all displaced families and individuals and that the
range of choices available to such persons will not vary on account
of their race, color, religion, national origin, sex, or source of
income; and
(4) Inform affected persons of the relocation assistance, policies and
procedures set forth in the regulations at 24 CFR Part 42 and 24 CFR
570.602(a) .
(1 ) It will :
(1 ) To the greatest extent practicable under State law, comply with
Sections 301 and 302 of Title III (Uniform Real Property Acquisition
Policy) of the Uniform Relocation Assistance and Real Property
Acquisition Policies Act of 1970 and will comply with Section 303 and
304 of Title III , and HUD implementing instructions at 24 CFR Part 42;and
(2) Inform affected persons of their rights and of the acquisition policies
and procedures set forth in the regulations at 24 CFR Part 42 CFR
570.602(b) .
(3)
(m) It will establish safeguards to prohibit employees from using positions for
a purpose that is or gives the appearance of being motivated by a desire
for private gain for themselves or others , particularly those with whom they
have family, business, or other ties.
(n) It will comply with the Anti-kickback (Copeland) Act of 1934, 18 U.S.C.
S 874 and 40 U.S.C. 5276a, which outlaws and prescribes penalties for
"kickbacks" of wages in federally financed or assisted construction activities .
(o) It will comply with the provisions of Executive Order 11296, relating to
evaluation of flood hazards and Executive Order 11288 relating to the
prevention, control , and abatement of water pollution.
(p) It will gi e the State, HUD and the Comptroller General , through any
authorizec representatives, access to and the right to examine all records ,
books, pacers, or documents related to the grant.
(q) It will insure that the facilities under its ownership, lease or supervision
which shall be utilized in the accomplishment of the program are not listed
on the Environmental Protection Agency's (EPA) list of Violating Facilities
and that it will notify the State of the receipt of any communication from
the Director of the EPA Office of Federal Activities indicating that a
facility to be used in the project is under consideration for listing by
the EPA.
(r) It will cc ply with the flood insurance purchase requirement of Section 102 (a)
of the Flood Disaster Protection Act of 1973, Pub. L. 93-234, 87 Stat. 975,
approved Cecember 31 , 1973. Section 102(a) requires , on and after March 2,
1974, the purchase of flood insurance in communities where such insurance is
available as a condition for the receipt of any Federal financial assistance
for construction or acquisition purposes for use in any area that has been
identified by the Secretary of the Department of Housing and Urban Development
as an area having special flood hazards. The phrase "Federal financial
assistance" include any form of loan, grant, guaranty, insurance payment,
rebate, su:sidy, disaster assistance loan or grant, or any other form of
direct or indirect Federal assistance.
(s) It will , in connection with its performance of environmental assessments
under the `+aitonal Environmental Policy Act of 1969, comply with Section 106
of the National Historic Preservation Act of 1966 (16 U.S.C. 470) , Executive
Order 11593, and the Preservation of Archeological and Historical Data Act
of 1966 C16 U.S.C. 469(a) , et. seq. ) by:
(1) Consulting with the State Historic Preservation Officer to identify
properties listed in or eligible for inclusion in the National Register
of Historic Places that are subject to adverse effects (see 36 CFR Part
800.8. by the proposed activity; and
(2) Complying with all requirements established by the State to avoid or
miticate adverse effects upon such properties.
(t) It will cc-,ply with:
(1 ) The National Environmental Policy Act of 1969 (42 U.S. C. Sect 4321
et seq.) and 24 CFR Part 58;
(2) Executive Order 11988, Floodplain Management;
(3) Executive Order 11990, Protection of Wetlands ;
(4)

INTERGOVERNMENTAL COOPERATIVE AGREEMENT
BETWEEN
WELD COUNTY, THE WATTENBERG IMPROVEMENT ASSOCIATION,
AND THE LARIMER-WELD REGIONAL COUNCIL OF GOVERNMENTS
THIS INTERGOVERNMENTAL COOPERATIVE AGREEMENT certifies that the County of Weld
has agreed to submit an application on behalf of the Wattenberg Improvement
Association for a Small Cities Community Development Block Grant.
The purpose of the project will be to make major improvements to the public
water system in the unincorporated portion of Weld County known as
Wattenberg. The County is hereby authorizing the Wattenberg Improvement
Association to contract with the Larimer-Weld Regional Council of Governments
for administration of the grant and the project. The County retains the right
of review and approval for all activities associated with project
implementation, including but not limited to the review and approval of:
project plans, engineering specifications, contract bidding procedures,
contracts, proposed expenditures, receipts and disbursements, grant
performance reports, and audits.
The Larimer-Weld Regional Council of Governments certifies that it will work
closely with the people of Wattenberg and with the Wattenberg Improvement
Assoication on all aspects of the design and implementation of this project.

RESOLUTION
BY
WELD COUNTY
A RESOLUTION certifying the intent of Weld County to make Application on
behalf of the Wattenberg Improvement Association to the Colorado Deparment of
Local Affairs for a Small C ties Community Development Block Grant for the
purpose of upgrading and expanding the public water system in the
unincorporated area of Weld County known as Wattenberg.
WHEREAS, Wattenberg has a large proportion of persons on low and moderate
income; and
WHEREAS, the existing water well , storage capacity and distribution system are
inadequate to be recognized by the Insurance Service Office for fire fighting
capabilities; and
WHEREAS, the water system's storage capacity is sufficient for only one day of
average use; and
WHEREAS, the system is in need of a standby well to serve the area in the
event of failure of the present well ; and
WHEREAS, past power failures to the well 's pump have caused residents to go
without water for as long as three days ; and
WHEREAS, when the water system has been down, residents have drawn water from
old stagnant wells contaminated by sewage from septic systems, posing a
serious threat to the public's health and safety; and
WHEREAS, the water distribution system is not designed to handle the estimated
flows for the maximum usage day and fire demand, causing extreme loss of
pressure; and
WHEREAS, the installation of residential water meters will encourage water
conservation, thereby prolonging the design life of the system;
NOW, THEREFORE, BE IT RESOLVED that the County of Weld approves and supports
the Small Cities Community E=velopment Block Grant Application for the
Wattenberg Improvement Association and authorizes the Wattenberg Improvement
Association and the Larimer-Weld Regional Council of Governments to prepare
the said Grant Application and to provide any information necessary to its
completion.
RESOLVED, PASSED AND ADOPTED this 15th day of November, 1982, at Greeley,
Colorado.

Public Hearing Notice
The Weld County government is eligible to apply for a State of Colorado
Community Development block grant (CDBG) . This program will be making grants
of up to $850,000 to cities and towns for community development projects.
Activities eligible for funding by CDBG include: housing rehabilitation or
weatherization; construction of senior or recreational centers; park
improvements; upgrading of streets, sewer or water systems, etc.
The Wattenberg Improvement Association has requested that Weld County apply
for a grant for the Association (which is not eligible to apply on its own. )
The Association is proposing to improve Wattenberg's water supply system by
adding a well , improving the distribution system, and adding other new
equipment.A written description of the proposed project is attached.
A public hearing will be held at 8:00 p.m. on November 11 , 1982 at the
Community Building to find out what other projects the local residents would
like to see funded, and to hear comments on the proposed water improvements.
