A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
Augpust 11, 2005 10:00 a.m., in the Conference Room of the Weld County Planning Department at 918
10` Street, Greeley, Colorado.
Members Present: Doug Melby, Robert Fleck, Jerry Adams, Don Somer.
Also Present: Sheri Lockman, Jacqueline Hatch
CASE NUMBER: MF-1039
APPLICANT: Charles Messerlian

LEGAL DESCRIPTION: Pt N2 of section 10, T7N, R67W of the 6th P.M., Weld County, Colorado.
REQUEST: Minor Subdivision Final Plan for 9 (nine) residential lots (Prairie Hollow
Estates).
LOCATION: South of and adjacent to CR 84 and west of and adjacent to CR 21.
Sheri Lockman Department of Planning Services presented MF-1039. The services will be provided by
Poudre Valley REA, Qwest and propane. There are service letters form both Qwest and Poudre Valley
REA.
Robert Fleck asked where the closest municipality was for sanitary sewer. Ms. Lockman stated that
Boxelder was being brought in from the west. It was requested by staff that they speak with them. At this
time it is not feasible to obtain service. Saddler Arena is in the area but not developed yet.
Doug Melby moved to approve. Don Somer seconded. Motion carried.
CASE NUMBER: PF-604
APPLICANT: Antelope Estates
PLANNER: Sheri Lockman
REQUEST: Cluster PUD Final Plan for six (6) residential lots and one Agricultural
outlot
LEGAL DESCRIPTION: Lot C of RE-2940, being a part of the NE4 of Section 29, T9N, R67W of
the 6th P.M., Weld County, Colorado
LOCATION: South of and adjacent to CR 102 and west of and adjacent to CR 17
Sheri Lockman, Department of Planning Services presented PF-604. The services will be provided by
Nunn telephone and Poudre Valley REA.
Robert Fleck asked where the closest municipality was located for sanitary sewer. Ms. Lockman stated
there was nothing in the area that could provide services.
Don Somer asked what the outlot will be utilized for. Ms. Lockman stated this was done as a cluster so to
utilize the wells there was a need to have a 2/3 portion of the area in outlot. The outlot could possible be
used in the future after the forty year requirement from the State but there would need to be a public water
supply.
Doug Melby asked if the utility easement between Lot one and the outlot should state 15 feet. Ms.
Lockman stated the back lot lines are typically 20 feet, 10 foot easement on each side would be
acceptable. There needs to be utility easements throughout the outlot
Jerry Adams asked if the outlot was part of the application which would make the need for the side lot
easements to be 10 feet on either side of the parcel line. Ms. Lockman stated there needs to be 20 feet
on the east side between Lot 1 and the outlot. Mr. Adams added there needs to be a 20 foot perimeter
easement around the outlot and 15 easement adjacent to road right-of-way. Ms. Lockman stated that
could be added and the outlot could have agricultural structures so it is feasible they will need those
easements. Mr. Adams stated that the plat needs to be brought up to standards with regards to all
easements. Mr. Adams stated there would be room for a 20 easement on the south lot line. Mr. Somer
stated that a 20 foot utility easement is needed along the south side of lots 4, 5, and 6. Mr. Adams
indicated the applicant may want to include an access easement as well.

REQUEST: An Amendment to a PUD Final Plat Redesign -consolidating Lots 4, 5, 6
& 7 of Block 2 into one (1) lot in the Western Dairymen Cooperative PUD.
LOCATION: South of Hwy 119; approximately 1/4 mile east of CR 7.5.
Jacqueline Hatch, Department of Planning Services presented Case 2AmPF-431. The intent is to
consolidate Lots 4-7 into one lot. Services will be provided by Left Hand Water District and St. Vrain
Sanitation. The intent is to retain the 20 foot existing utility which runs east/west through site.
Rob Fleck stated they have talked with the owners and reviewed the requirements and are in agreement
with the proposal. There will be some requirements regarding the multi tenants.
Jerry Adams added that there is a 10 foot utility easement on the replat but it should be a 20 foot
easement through the middle. Ms. Hatch stated it was 10 foot on each side of the property line.
Robert Fleck moved to approve. Don Somer seconded. Motion carried.

4) The use of ground water from this well is limited to fire protection,ordinary household purposes inside not more than one
(1)single family dwellings, the irrigation of not more than 1 acre of home gardens and lawns,and the watering of domestic
animals as described in CRS 37-92-602(1)(b). Such use is restricted by the approved annual amount of groundwater that
may be diverted by the well. The annual withdrawal is limited to 0.50 acre-feet,which, in addition to one single-family
dwelling,will typically allow for the irrigation ofapproximately 3,000 square feet of lawns and gardens and the watering of a

Purpose of the "Owners Notice of Constructed Well"
It is necessary that your well permit remains valid to allow you and
future owners of the property to withdraw ground water from the well for
use and to have the well worked on by licensed contractors. First and
foremost in maintaining your well permit valid and in good standing is the
submittal of the Well Construction and Test Report and the Pump
Installation and Test Report (work reports) that licensed contractors (or
you, if you constructed the well as a "private driller" or installed the pump as
a "private pump installer") are required to submit to the Division of Water
Resources. Without the submittal of a work report to show that the well was
constructed in conformance with the Water Well Construction Rules and
that it is in compliance with the conditions of approval of the well permit,
the permit will expire on the expiration date indicated on the permit.
Reinstatement of your permit after it has expired or obtaining a new
permit for your well will require that you show that the well was constructed
by a licensed water well construction contractor (or private driller) and that
it meets the required standards of the Water Well Construction Rules. It is
much easier and efficient to maintain the valid status of your original well
permit than it is to try to have it reinstated after it has expired or to obtain a
new permit for the existing structure.
Because it is not always easy to confirm that the required reports have
been submitted to DWR, this "Owner's Notice of Constructed Well" is
provided for your use. Do not give the notice to your contractor to submit.
The notice is to be completed by you and mailed or faxed to the Division of
Water Resources so that the Division is advised that your well has been
constructed. If the required work reports are not then filed within a
reasonable period of time, the Board of Examiners can initiate its procedures
for obtaining the reports and thereby assist you in keeping your well permit
valid.

Nunn Telephone Company is ready,willing,and able to serve the Antelope Estates
Minor Subdivision near the intersection of WCR 17&WCR 102(Section 29, Township
9 North,Range 67 West.).
Service to the entrance to the housing addition is available today. Our tariff on file with
the Colorado Public Utilities Commission dictates the terms of Land Development
Agreements. Nunn Telephone Company will request an upfront payment of$3,594.42 to
place faculties within the development. As each of the six lots request telephone service,
1/6 of the upfront payment will be refunded(provided the service is provided within 5
years). Please see tariff attached.
Also attached is the basis of the cost estimate of$3,594.42_

(C)
14.4 Land Development A3reements
(A) A Land Development Agreement (LDA) , not to exceed a five (5) year
period, is required where a Developer/Builder/Property Owner
requests the Company provision telephone facilities (such as
placement of additional feeder, distribution facilities and drape)
within new areas of land development. The LDA will include, but is
not limited to:
1) Description of the subdivision or development;
2) Disposition of Covenant requirements that affect utility
placement and maintenance. If further subdivision of the area
is to be allowed, methods and responsibilities for providing
additional service shall he listed;
3) Utility easements on all aides of every parcel shall be
patted and recorded;
A) An addressed, recorded plat in electronic. dicitized or
written format shall be provided to the Company;
5) Rights, responsibilities and liabilities associated with
trench and backfill work upon initial construction and
subsequent maintenance; or,
6) Provisions for notification between the Company and
Developer/Builder (such as, notification 90 days prior to the
backbone trench date, 21 days notice of ohs completion date of
a premises) .
(9) The Company will use standard specifications and will engineer,
design, secure all materials and provide the labor to extend
teleccmmunicatione facilities from existing Company facilities to
the development and to place telecommunications facilities within
the development. Consistent with the Commission's Rules regulating
telecommunications providers and telephone utilities, a written,
good faith, cost estimate will he provided to the Developer/Builder.
The Developer/Builder is responsible for paying the full amount of

(C) The Property Owner/Developer/Builder holding title to the property
will grant and convey to the Company all necessary non-exclusive
easements (form to be provided by the Company) . The easements will
provide for the Company to construct, reconstruct, augment, operate,
maintain and remove such telecommunications facilities, and
appurtenances, from time to time, as the Company may require upon,
over, under and across the property. The width and length cf the
easement will be determined at the time of the request for
facilities. In general, all easements will be a standard width of
eight feet along the front and rear lot lines and five feet wide
along all side lot lines unless otherwise agreed upon. The Property
Owner/Developer/Builder will pay the additional costs associated
with acquiring easements.
{D) In all cases, the Company retains ownership of the installed plant.
(Z) In areas where the Company has existing trench and backfill
agreements with local power utilities, the Developer/Builder shall
be reeponsihle for the Company's portion of the trench and backfill
costs.
(F) Distribution facilities covered by a LDA cannot be used for
subsequent developments until they are covered by a new LDA-
(G) Once the Company has completed the construction within a land
development area, the Company will reimburse the pevelopment/Builder
the leseer of the average coat per single Harty loop per premises
for the land development project or the Construction Charge
Allowance per section 14.6 following, for each Customer that
established permanent service at a premises during a period of five
(5) years from the date of the agreement. Only one reimbursement
per premises will be made by the Company to the Developer/Builder
for a premises regardless of the number of facilities ordered by the
end user Customer or by subsequent end user Customers occupying the
premises- In the event the development contains lots or premises
after five(5) years from the agreement date for which facilities
were provisioned and for which no service was ordered by an end use
Customer, no reimbursement will be Made by tie Company to the (C)
Developer/Builder.
