OF ) THE CARBON VALLEY PAR.: AND RECREATION ) ORDER AND DECREE DISTRICT • This matter coming on to be heard in open Court, and it appear- ing that Notice of Hearing on the Petition to organize the above District was duly published and mailed in compliance with the re- quirements of law. / • And it further appearing that by Order of this Court and Notice issued by the Clerk of the District Court, and published according to law, there was conducted a Special Election April 26, 1983, and as a result organization of this District was approved and a Board of Directors elected; and the Court. being fully advised in the prem- ises, ORDERS AND DECREES: ' The Court has jurisdiction in this matter. Said District has been duly organized pursuant to the "Special District Act" contained at Title 32, Article 1, C.R.S. , as amended, and shall be known as the "Carbon Valley Park and Recreation District." IT IS FURTHER ORDERED, pursuant to C.P.S. 31-1-307, 1973, as attended, that owners of 40 acres and more used prir..ari ly and zoned agricultural, whose names appear on Exhibit D here incorporated shall have said property excluded and the same is by reference, excluded from the District, surface only. The filing o: corporate surety bonds by said eirectors and by the Treasurer of said District is dispensed with and said persons nay file their personal bonds without sureties. . If • Said District shall become a governmental subdivision of the State of Coloradoaand a body corporate with all the powers of a public or quasi-municipal corporation. BE IT FURTHER ORDERED that the Poard of Directors upon their oath shall take such steps and proceedings as the needs of the District require and that within 30 days hence the Clerk of this Court shall transmit to the County Clerk and Recorder of Weld County, Colorado, a copy of this Order and Decree for filing in their respective offices , and said District shall he and is identified for administrative purp- oses as the Carbon Valley Park and Recreation District.
