Proposed Change: A. Well No 1-6362-F and Well N°2-6363-F are decreed for irrigation use of 160 acres. Applicant seeks to change the use to commercial for the watering of chickens, egg washing, fire protection, drinking and sanitary facilities, domestic and use in four single-family dwellings and irrigation of 221.2 acres in the West % of Section 15 in combination with the other wells and 52 shares of FRICO/Barr Division. The State Engineer issued permit No 41882- F to replace No 6362-F and permit No 41883-F to replace No 6363-F on December 17, 1992. The State Engineer issued permit No 41883-F-R to replace No 41883-F on July 7, 1994. B. Permit No 10708-RF was issued for Well No 4-10708-F on January 9, 1980 as a replacement for the original well said replacement being located in the Southwest Quarter of the Southwest Quarter of Section 15, Township 3 North, Range 66 West of the 6th P.M., Weld County, Colorado, at a point 1315 feet North and 1,305 feet East of the Southwest Corner of said section for irrigation of 40 acres. Applicant seeks to change the location of the well to conform to the permit and to change the use to commercial for the watering of chickens, egg washing, fire protection, drinking and sanitary facilities, domestic and use in four single-family dwellings and irrigation of 221.2 acres in the West%of Section 15 in combination with the other wells and 52 shares of FRICO/Barr Division. The State Engineer issued permit No 41885-F to replace No 10708-RF on December 17, 1992. C. Permit N°42346-A was issued for Well N° 5-42346 on March 22, 1976 as a replacement for the original well, said replacement being located in the Southeast Quarter of the Southwest Quarter of Section 15, Township 3 North, Range 66 West of the 6th P.M., Weld County, Colorado, at a point 140 feet North and 2000 feet East of the Southwest Corner of said section for"watering chickens." Permit N° 016439-F was reissued as Permit NQ 19040-F for Well N° 8 on November 25, 1974 Applicant seeks to recognize the new permit and to change the use to commercial for the watering of chickens, egg washing, fire protection, drinking and sanitary facilities, domestic and use in four single- family dwellings and irrigation of 221.2 acres in the West 'fl of Section 15 in combination with the other wells and 52 shares of FRICO/Barr Division. The State Engineer issued permit N2 41889-F to replace N2 19040-F on December 17, 1992. E. The uses for Well N4 3-10548-F, Well N°6-43179 and Well N2 7-44315 are to be changed to commercial for the watering of chickens, egg washing, fire protection, drinking and sanitary facilities, domestic and use in four single- family dwellings and irrigation of 221.2 acres in the West % of Section 15 in combination with the other wells and 52 shares of FRICO/Barr Division. The State Engineer issued permit N°41884-F to replace N2 10548-F, permit N2 41887-F to replace NQ 43179 and permit N° 41888-F to replace N°44315 on December 17, 1992. F. Applicant has withdrawn its request to adjudicate each well 1 through 8 as an alternate point for each of the other wells. G. Applicant's changes are for the purpose of allowing the enlargement of its facilities to accommodate 2,000,000 layers, 1,000,000 pullets, egg washing, sanitary, residential and 2 acres of greenhouse. The total consumptive use for the enlarged facility is 140.5 acre-feet per year. Applicant's current consumptive use is 47.2 acre-feet based on actual measurements of Applicants operation, excluding irrigation. The proposed operation, excluding irrigation, requires an additional 93.3 acre-feet. To prevent injury to other water users and to maintain the same consumptive use as historic, Applicant proposes to reduce groundwater diversions from it's irrigation wells. The consumptive use of alfalfa is 2.32 acre-feet per acre according to a Modified Blaney-Criddle analysis of climatic data from the Denver weather station for the period 1950-1990. Applicant uses 52 shares of FRICO/Barr water on the 221.2 acres irrigated which provides an average of 164 acre feet of water to the alfalfa. The irrigation wells provide average historic groundwater pumping of 439 acre feet or 1.98 acre feet per acre and 1.69 acre feet per acre consumptive use water. The expansion of Applicant's FAMMWIORNINGOECREE2 • 2463399 B-1518 P-440 11/13/95 01:12P PG 5 OF 8 Vloming Fresh 92-CW-085 Page 5 facility will depend on business and economic factors. Applicant proposes to reduce a sufficient number of acres of irrigated alfalfa to off-set the increased consumptive use from the birds added to the facility. Based on Applicant's actual measurements, 5.5 gallons per day are required per 100 birds. 30,000 birds require 1.85 acre-feet per year. For each 30,000 birds Applicant will remove 1.09 acres of alfalfa from irrigation by the wells. Applicants wells are fully augmented and augmentation will be maintained. On July 27, 1992 and June 20, 1994 the Division of Water Resources approved Substitute Supply Plans for the enlargement and proposed uses. CONCLUSIONS OF LAW 7. The Court has jurisdiction of the subject matter of this application and all persons affected hereby, whether they have appeared or not, pursuant to §37-92-203(1), §37-92-302 and §37-92-304, C.R.S. 8. No statements of opposition have been filed and the time for filing statements of opposition has expired. 9. Full and adequate notice of the claim adjudicated herein has been given in the manner required by law. RULING AND DECREE 10. ¶1 through¶9, inclusive, are incorporated herein by reference and made a part of this Ruling and Decree as if fully set forth. 11. Well N° 1-41882-F and Well N°2-41883-F-R are decreed for commercial use for the watering of chickens, egg washing, fire protection, drinking and sanitary facilities, domestic and use in four single-family dwellings and irrigation of 221.2 acres in the West 1/2 of Section 15 in combination with the other wells and 52 shares of FRICO/Barr Division. The location of Well N° 2-41883-F-R is changed to the Northwest Quarter of the Northwest Quarter of Section 15, Township 3 North, Range 66 West of the 6th P.M., Weld County, Colorado, at a point 4088 feet North and 962 feet East of the Southwest Corner of said section. 12. Well N°3-41884-F is changed to watering of thickens, egg washing, fire protection, drinking and sanitary facilities, domestic and use in four single-family dwellings and irrigation of 221.2 acres in the West 1/2 of Section 15 in combination with the other r-- wells and 52 shares of FRICO/Barr Division. Well N2 7-41888-F is changed to watering of chickens, egg washing, fire protection, drinking and sanitary facilities, domestic and use in four single-family dwellings and irrigation of 221.2 acres in the West 'h of Section 15 in combination with the other wells and 52 shares of FRICO/Ban- Division. 17. Well N2 8-41889-F is changed to commercial use for the watering of chickens, egg washing, fire protection, drinking and sanitary facilities, domestic and use in four single-family dwellings and irrigation of 221.2 acres in the West ' of Section 15 in combination with the other wells and 52 shares of FRICO/Barr Division. 18. Terms and Conditions: Applicant's changes are for the purpose of allowing the enlargement of its facilities to accommodate 2,000,000 layers, 1,000,000 pullets, egg washing, sanitary, residential and 2 acres of greenhouse. Total consumptive use for the facility shall not exceed 140.5 acre-feet per year under this decree. To prevent injury to other water users and to maintain the same consumptive use as historic, Applicant shall reduce a sufficient number of acres of irrigated alfalfa to off- set the increased consumptive use from the layers which are added to the facility. Applicant requires up to 14 acre feet of water for two acres of greenhouses when and if the same are constructed. To prevent injury to other water users, and to maintain the same consumptive use as historic, applicant shall remove 8.2 acres of alfalfa from irrigation by the wells once irrigation in the greenhouses commences. If Applicant's greenhouse irrigation is less than 2 acres then the acres removed from irrigation shall be prorated. All acreage removed from irrigation for each additional 30,000 layers and any greenhouses constructed shall be documented or monumented to the satisfaction of the local Water Commissioner. This shall include providing the Commissioner with a map of the total acreage irrigated with the additional acres removed from irrigation clearly marked thereon. 19. Applicant shall install and maintain such measuring devices and maintain such records as the Division Engineer may require for administration of these rights. Prior to implementing the new uses provided for under this decree, the Applicant shall provide an accounting form to the local Water Commissioner which is acceptable to him. This form shall list the amounts of water diverted from each well and delivered pursuant to the FRICO/Barr shares, the acres irrigated, the size of the greenhouses and the number of 30,000 layer units. This accounting form will be provided to the Commissioner on at least a monthly basis. 20. This change of water right will not injure other water rights provided Applicant continues to operate this well in compliance with the amended rules and regulations for the South Platte as adopted in Case No. W-7209, et at, dated March 15, 1974. 21. This change of water right shall be subject to reconsideration by the Water Judge on the question of injury to the vested rights of others for a period of five years from the date of this decree pursuant to §37-92-304(6), C.R.S.
