MEMORANDUM OF AGREEMENT
THIS AGREEMENT, made and entered into this , day of S

First Party, and hereinafter called Second

WHEREAS, the First Party is a legally formed water district in Weld and
Lorimer Coun^t1es, Colorado and,
WHEREAS, Second Party is desirous of purchasing water taps from said
District,
NOW, THEREFORE, i.n consideration of the premises and the terms of this
Agreement, it is mutually agreed as follows:

1. Second Party agrees to purchase 1 water tap(s) from First Party

of $" diameter at the rate of $ 15006, per tap, or a total of
0_ bei.V . Further, Second Party agrees to pay said sum of
concurrently with the execution of this Agreement.
2. Further, in the event the Second Party desires to sell any of their Dig
Thompson Project Water attached to their property for irrigation, they hereby
agree to give First Party the first option to purchase said water, at the then
market price, and to execute all necessary documents in connection therewith,
including documents for the transfer of any such water.
3. Further, Second Party agrees to pay all rate and charges as set by
• First Party.
4. It is further mutually agreed that this Agreement shall extend to and
be binding upon the heirs, executors, administrators and assigns of the parties
hereto.
IN WITNESS WHEREOF, the parties hereto have hereunto and hereunder set
their signatures the day and year first hereinabove written.

1. The proposed use of the property is for a small home based business that
specializes in waterjet cutting of metals.
5. a. There will be three people using this site.
b. There may be two employees at this site.
c. The hours of operation are Monday through Thursday from 7:00 a.m. to
5:30 p.m.
d. There will not be any additional buildings erected (built) on this site.
e. There will be five horses and one dog on this site.
F. Fire protection will be provided by Weld County Fire Department
g. The water source for the property is North Weld County Water District,
two ponds on site, and 62 shares of Woods Lake.
h. the sewage disposal on the property is a septic tank.
i. Items to be stored are a few metal supplies for cutting.
6. There is existing landscaping already on site. No additional landscaping
proposed.

8. All storm water drainage on the site is handled through current water drainage
system which is gutters, downspouts and drainage down to the ditch on the
East side of the property.
9. This site was already constructed and landscaping was already in.
10. Storage and stockpile of wastes are on the East side of the outbuilding. There
is a dumpster and a recycling bins.
