RE: APPROVAL OF LOT SIZE VARIANCE NO. 115 - MR. AND MRS. LARRY
FULTON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public meeting held on the 17th day of September, 1980 in
the Chambers of the Board of County Commissioners of Weld County,
Colorado that a certain tract of land is owned by Mr. and Mrs.
Larry Fulton, which land is more particularly described as
follows :
Part of the Southwest Quarter of
Section 18 , Township 2 North,
Range 67 West of the 6th P.M. ,
Weld County, Colorado
WHEREAS, the owners of said tract of land desire to obtain
a variance from the minimum lot size requirement so that they
may make application to the Board of County Commissioners for
a recorded exemption, as set forth in Section 9-4 .A. (6) of the
Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado feels that the applicants have shown good cause for
granting a lot size variance under Section 9-4 .A. (6) of the
Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that a variance from lot
size requirements be, and hereby is , granted to Mr. and Mrs.
Larry Fulton for the above described parcel of land.

and seconded, adopted by the following vote on the 17th day of

RE: Lot Size Variance #115
Dear Commissioners :
The attached letter and related materials are in reference to a request for a
lot size variance from Mr. & Mrs. Larry Fulton. The property on which this
request has been made is described as Pt. SW1 Secton 18, T2N, R67W of the 6th
p.m. , Weld County, Colorado. This property is located % mile north of the
incorporated boundaries of the Town of Firestone.
The property under consideration contains approximately 22.1 acres of class IV
and VI non-irrigated soils. The request is to obtain a variance from the minimum
lot size requirement, Section 9-4. A. (6) of the Weld County Subdivision Regula-
tions , so that they may make application for a recorded exemption.
The Fultons wish to sell the north half of their property. The balance of the
property will be retained by the Fultons which has their residence located on it.
Based upon the information submitted and the adopted policies in the County, the
Department of Planning Services Staff recommends this request be approved for
the following reasons :
1 . The request is in compliance with the policies of the Weld County Comprehensive
Plan in that to minimize conflicting land uses , residential development will
be encouraged to locate adjacent to the existing towns and in accordance with
the comprehensive plans and stated wished of each community. The parcel of
land is located just outside the Tri-Area Comprehensive Planning area. The
Tri-Area Planning Commission has set forth no objections to this request.
2. The request conforms with the intent clause of the Recorded Exemption Procedure
(Section 9-2 of the Weld County Subdivision Regulations) and the intent clause
of the Agricultural District (Section 3.3 A. of the Weld County Zoning Resolution)

since the use would be compatible with the surrounding agricultural uses .
In addition, the 22 acre parcel under consideration has low utility for
agricultural use due to the size of parcel and the existing improvements
located on it (ie. residence, oil well , out buildings) .
Prior to approval of a Recorded Exemption on the property the applicants will need
to make application to the Board of Adjustment for a variance from the 180 foot
minimum lot width requirement.

To Whom it May Concern:
We have 22.10 acres of land, the oil company put a well right in
the middle of it cutting off the front part making it a part of
the land we can not sell. The back part is not suitable for farm-
ing because it can not be irrigated.
The water Board in Denver told us because we have a well in our
name they will not give us another well permit. However when
the land is sold and the deed is in the new owners name the well
permit will be given.
Hope this is the information you will need to help you make your
decision.
