Lupton, CO 80621 RE: Water Service Dear Mr. Zadel: This letter is in response to a request for water service to serve the following property described as follows: Part Syz Section 10, Township 1 North, Range 67 West, Weld County, Colorado. Water service can be made available to the above described property, provided all requirements of Central Weld County Water District,Northern Colorado Water Conservancy District and the U. S. Bureau of Reclamation are satisfied. Central Weld County Water District requires that contracts be consummated within one (1) year from the date of this letter or this letter shall become null and void unless extended in writing by the District. Please note that you are responsible for confirming that this property has met the requirements of Northern Colorado Water Conservancy District and the Bureau. Central Weld cannot issue a tap until all requirements are satisfied. Due to the rapid cost increase of raw water, existing tap fees may not apply for water service to this property. The District will not notify, by separate letter, any prospective landowners or land purchasers of tap fee or line extension cost increases. The cost of a tap fee and/or line extension will have to be paid in advance to the District by the prospective customer in accordance with District policy. S % SW 'A of Section 10, Township 1 North,Range 67 West of the 6'h P.M.,Weld County, Colorado. tH WHEREAS, DISTRICT water facilities are not presently located to service adequately the Subject Property, and, WHEREAS OWNER wishes to have the DISTRICT construct water mains to service the Subject Property, and, WHEREAS DISTRICT wishes to construct said water mains on the terms and conditions hereinafter set forth and, WHEREAS, OWNERS are requesting water service by separate tap fee agreements and will acquire ONE water tap(s)with meter size of 5/8 inches from the said DISTRICT, and, WHEREAS DISTRICT reserves the right and has the authority to consider each extension contract and rebate provision individually, and administer as determined appropriate based on varying conditions. NOW, THEREFORE, in consideration of the premises and the terms of this agreement, it is mutually agreed as follows: I. Prior to any expenditure or construction by DISTRICT, OWNER agrees to pay, in advance, the amount of $6,057.60 based on the estimated costs for all material, labor, installation, fees and other costs directly applicable to extension and meter set(s),less any credits allowed by DISTRICT. Page 1 of 2 • ,,ater Main Extension Contract tr r 2. DISTRICT agrees to provide credits to OWNER in the total amount of$ 4,000.00 for tap(s)purchased. 3. OWNER may be entitled to a rebate from DISTRICT based on new services being added to the extension paid for by OWNER. DISTRICT shall only pay a rebate on extension. DISTRICT shall not pay rebates in excess of the total amount of $ 2,057.60 . Said rebates, when approved by DISTRICT,will be in the amounts of the actual CIF included in the tap fees for services attached to this extension. Rebates will not be paid to OWNER by DISTRICT after 10 years from date of this contract. 4. OWNER agrees to execute any and all easements needed by DISTRICT at no expense to DISTRICT, across OWNER'S property for the purpose of installing any pipelines constructed by DISTRICT. DISTRICT shall be responsible for restoring surface area back to reasonable condition at DISTRICT cost. 5. OWNER agrees to abide by rates established and the rules and regulations of the DISTRICT. 6. This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado. 7. This Agreement constitutes the entire agreement between the parties with respect to the extension of the water mains herein described, and supersedes all prior arrangements or understandings with respect thereto. 8. This Agreement may only be modified, in writing,by the Board of Directors of the DISTRICT. 9. This Agreement shall be binding upon,and shall inure to the benefit of,the parties hereto,and their successors, heirs,and assigns. Our office only responds to the adequacy of the subdivision water supply plan when the plan is referred to our office by the county. Pursuant to Section 30-28-136(1)(h), C.R.S., upon receipt of a complete preliminary plan submission, the board of county commissioners or its authorized representative distributes copies of prints of the plan to the State Engineer for an opinion regarding material injury likely to occur to decreed water rights and adequacy of proposed water supply to meet requirements of the proposed subdivision. Pursuant to the State Engineer's August 7, 1995 memorandum to county planning directors, this office is no longer providing comments on water supply plans for land use actions that do not involve a subdivision as defined in Section 30-28-101(10)(a), C.R.S. Therefore, our office does not provide comments on the adequacy of a water supply plan for zone changes. Attached hereto is the information that you provided to our office.
