RE : Empire Diversion Works at Kuner Bridge
Dear Mr. Zorn :
This is an intermediate reply to your Metter of Dub 9, 1981 , regarding —
the diversion works for the Bijou Irrigation District. The Board of
Weld County Commissioners was made aware of the problem with the dam on
the north channel , at which time it was their consensus that they would
have to see some evidence that the County was in any way responsible for
the maintenance or repair to the dam. Your recent letter prompted a
search of the files held by the County Clerk and Recorder, in an attempt
to locate a copy of the 1925 agreement which you refer to in your letter,
along with any other relevent correspondence. We were unable to locate —
the documents you referred to or for that matter any correspondence relating
to the subject.
In order to assist the Board of Commissioners in making an equitable
decision, it would be appreciated if you could furnish this office with
copies of any correspondence or agreements which bear on the subject.
The Board will be taking this up in a 4ork Session on Monday, July 27 ,
1981 , for further consideration.
