The quick summary of all of our phone calls was that in order not to do an augmentation plan, the three existing well permits (permit numbers—244991, 244992, & 254371) that have already been issued for this property, should be turned into the Division of Water Resources, and then apply for 6 individual ('Cluster type') well permits. This would keep the well permits from having the potential to draw more than one(1) acre foot of water, which is the trigger for the augmentation plan. Of course the catch was that the State has issued the well permits for maximum use (three dwelling units, home garden and livestock), which yields the potential to draw one and one half(1 14) acre feet of water. As we are all aware of, there is not a county in the State that will allow three houses on a 35 acre parcel without a development review, but will allow two houses on the 35 acre parcel. The reality is that only two houses would share each well permit and draw only one (1) acre foot of water. However the State submitted a letter to Weld County stating that the potential draw is one and one half(1 '14) acre feet, triggering the need for an augmentation plan. We have asked to limit our three existing well permits to two dwelling units and one (1)acre feet of water use, but the well permit division has said that they have been directed to only issue for maximum use, so that no one in the future can take litigious action against the State for denying the permit full and maximum uses. After receiving this decision, we agreed to return the three existing well permits to apply for six individual permits and that this would be supported by the State. We were directed to re- submit the project with the changes and a revised 'Water Supply Information Summary sheet and that the State would then issue a letter stating that the augmentation plan would not be needed any longer and that upon approval by the County Commissioners that we could apply and receive the six individual well permits for the final submittal. To date this is not what has transpired; instead we are right back to the requirement for an augmentation plan and denial. Therefore there is not any material injury to the vested water rights of others or to any other existing wells, due to our proposal actually reducing the ultimate water withdrawal potential on the property. We would like you to support a condition of approval that these three well permits must be turned in and six new applications for individual well permits for the lots must be applied for and approved. This will reduce the water draw to a half(1/2) acre feet per well, meeting the Cluster Development (30-28403) requirements and HB 96-1364. We understand that other non urban PUDs have received individual well permits and request the same. Antelope Estates Non Urban PUD is being processed pursuant to Weld County's rural land use process and actually meets all the requirements of a cluster development. We do not want to begin the application process again and do meet all other land use code requirements for Weld County and want to resolve the issues with your office and move forward to with staff and State support to County Commissioners on June 1, 2004.
