tl • N RESOLUTION RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 69:81:2 FOR DARRELL NOPENS FOR A HORSE BREEDING AND BOARDING FACILITY LOCATED IN PART OF SECTION 24, TOWNSHIP 3 NORTH, RANGE 65 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs oflWeld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public meeting on the 15th day of July, 1981 at the hour of 9: 00 o'clock a.m. for the purpose of hearing the application of Darrell Nopens for a Conditional Use Permit for a horse breeding and boarding facility on the following described real estate, to-wit: SE4NEa of Section 24, Township 3 North, Range 65 West of the 6th P.M. , Weld Clunty, Colorado WHEREAS, the petitioner' s agent was present, and WHEREAS, evidence was presented in support of approval of the Conditional Use Permit for a horse breeding and boarding facility, land WHEREAS, Section 3. 3.D. of the Weld County Zoning Resolution authorizes such a use in an Agricultural District upon approval of the Conditional Use Permit by the Board of County Commissioners, and I. WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and, statements of those present, has studied the request of the petitioner and the recommendltions of the Weld County Planning Commission and all of the exlibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Conditional Use Permit for a horse breeding and boarding facility on the hereinabove described real estate complies with all of the conditions as set out in Section 3. 3.D.- (2) of the Weld County Zoning Resolution. It is the opinion of the Planning Commission that this request is in agreement with the Weld County Comprehensive Plan in that the proposed use would not appear to have any adverse impacts on the agricultural interests of the County or the environment. 2. It is the opinion of the Planning Commission that this request is in compliance with the provisions of Section 3.3.D. (2) of the Weld County Zoning Resolution. 3. The Planning Commission recommendation for approval is conditional upon the following:i 1. The Conditional Use Permit plat being amended to show the reservation for permanent easement across the subject property. 2. The attached Development Standards being recommended and approved for the Conditional Use Permit. 3. The Development Standards for the Conditional Use Permit shall be placed on the Conditional Use Permit plat and the plat shall be delivered to the office of the Department of Planning Services prior to any electrical or building permits being issued on the subject property. The permitted uses on the hereon described parcel shall be a horse boarding facility andlall other uses permitted by right in the Agricultural District of the Weld pounty Zoning Resolution. Major facilities shall be limited to those shown hereon which are designed to handle approximately twenty (20) head of horses .at any one time. 2. The Conditional Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. . 4. All accesses shall have the approval of the Weld County Engineering Depart- ment. All accesses shall be constructed in accordance with the recommenda- tions of the Weld County Engineering Department. 5. The Conditional Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards, as shown or stated above, shall require the approval of an amendment to the Conditional Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or-Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department. of Planning Services. 6. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development standards. Noncompli- ance with any of 'the above stated Development Standards may be reason for revocation of the Conditional Use Permit by the Board of Commissioners. The Colorado Geological Survey has advised that foundations be engineered due to sandy conditions and that the area may contain potentially commercial coal resources. 2. Permitting the horse breeding and boarding activity will create two tracts; one will be eligj.ble for building permits (subject parcel) and the second (80 acres) will not. Under the Agricultural District Lot Size Standards a minimum size of 160 acres (nonirrigated) is required to obtain building permits. Any requests for building permits on the remaining 80 acre parcel will • require similar review as the present application can be considered on its own merit weighed against land use policies of the County. It is felt by staff that the proposed use is one which is compatible with existing large tracts in the immediate neighborhood. Also, considering soils and available water it is a more intensive use than may normally occur, thereby supporting the placement of a residence on a less than minimum lot 'size tract. .
