July 9, 2001 Mr. Brad Janes Varra and Sand Land Companies, Inc. 1431 East 16th Street Greeley,CO 80631 Re: Water Availability for Processing Facility South Half of the Northwest Quarter and the North Half of the Southwest Quarter, Section 25,Township 1 North, Range 68 West, 6th P.M. Dear Mr. Janes: At your request, we have investigated the water available to serve a proposed processing facility located in Weld County as referenced above. This site is not located in a Designated Ground Water Basin. The projected water requirement for processing is 10,000 gallons per day A permit for an exempt commercial well on this property has been issued by the state. The uses allowed under this permit are drinking and the operation of sanitary facilities. This well can be used to provide water for employees and visitors to the site. However, the water from this well would not be available for processing use. There are four options to serve the processing facility. These options and our findings for each one are discussed below: • Service from a quasi-municipal supplier The site is located in the Central Weld County Water District's service area. However, the district requires that water mains be installed prior to its service. This requirement is too expensive for the proposed use. The district could not estimate when water service may be available at this site. • Water from a non-tributary aquifer: There may be nontributary water available from the Laramie-Fox Hills aquifer at the site. The state denotes this area as complex on its mapping of the Denver Basin aquifers. This complex area is bounded by a fault, and data about formations under the site are lacking. The availability of water from the Laramie- Fox Hills aquifer under this site is highly speculative. Test drilling to depths greater than 1,000 feet would be necessary, and there would be no assurance that water could be located. This is not a feasible source of water at this time. Mr. Brad lanes July 4, 2001 Page 2 • Surface or tributary water: Our records indicate that this site was once served by shares of the Standley Lake Division of the Farmers Reservoir and Irrigation Company These shares were sold to the City of Thornton some time ago. Any tributary source would require augmentation water and either a substitute supply plan approved by the State Engineer's Office(SEO)or a decree Cana the water court. The SEO has recently adopted a new policy regarding its approval of substitute supply plans. This policy does not allow approval of a plan for this new water use. A water court decree is possible but would involve a lengthy process_ Although it is not possible to predict how long this procedure may take, it is likely that the time required would exceed two years. • Transporting water to the site Water available to the company at other sites it controls could be trucked to the site. Approximately two trucks per day could provide the water required for processing. This appears to be the only feasible method of service at this time. In summary,we conclude that the only feasible method of providing water to this proposed processing site in a timely fashion is by trucking water to the site. We understand that Varra and Sand Land Companies, Inc. are prepared to implement this solution. The depth of this well shall not exceed 40 feet or the depth at which sandstone or shale is first encountered, whichever comes first. 6) The maximum pumping rate of this well shall not exceed 15 GPM. 7) The annual amount of ground water to be withdrawn shall not exceed 0.33 acre-feet (108,600 gallons). as applied for. 8) Approved as the only well on a tract of land of 69.48 acre(s)described as a portion of the S1/2 of the NW 1/4 and the N1/2 of the SW 1/4 of Section 25, Township 1 North, Range 68 West, 6th P.M., Weld County, reference attached exhibit"A". 9) The return flow from the use of this well must be through an individual waste water disposal system of the non-evaporative type where the water is returned to the same stream system in which the well is located. The maximum consumptive use of ground water shall not exceed 10 percent. 10) A totalizing flow meter must be installed on this well and maintained in good working order.
