NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Andrew 81:163 and Muriel Hop for a Special Use Permit for a dairy operation on the hereinabove described tract of land be, and hereby is, granted subject to the following: 1. The Development Standards contained in the Special Use Permit. 2. No building or electrical permits shall be issued on the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the Department of Planning Services. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 4. Lagoons for r.astewater retention shall be installed as per Rules and Guide- lines for ''.ater Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May 1968. The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health, Water Pollution Control Division. 5. All accesses shall have the approval of the Weld County Engineering Depart- ment and/or State Highway Department. At the present time corrals are being built to handle 290 head. The barn will be built with adequate sewage disposal and meet building re- quirements set by Weld County and the State of Colorado. The barn will milk 16 head. The wastewater from the barn will be pumped to a 3-1/2 Acre pasture. It will also be used with irrigation water in the summer. The corrals will be cleaned from Fall to Spring and the manure will be spread on adjoining fields. The corrals will be graded so that any runoff water will drain to an adjoining field. Fly control will be primarily by use of misting. Rat control will be through poison and cats. The milk truck will be on an everyday pickup. This will not increase traffic because there are now two dairies already located on this road. Water for the dairy will be provided by Central Weld Water District and supple- mented with well water. The dairy will employ four full time workers. Ms. Jamison indicated that the lots on the south side of West 9th Street Drive do not comply with the 150 foot lot depth standard for lots adjacent to arterials. The purpose of the 150 foot lot depth requirement is to provide a noise buffer between the residences and the street. The average lot depth for these lots is 116 feet. She noted that the developer is proposing to mitigate the noise impact by constructing a solid fence along the property lines adjacent to and six feet above the grade of Highway 34. In addition, she indicated that the State Highway Department had indicated that this noise barrier would adequately bring the effective noise level down to the residential level. However, Ms. Jamison noted that the staff is concerned that the proposed fence would not be as effective as the lot depth requirement in the long term in abating noise due to potential deterioration of the fence over time. She did note that this alternative noise abatement technique is similar to the proposal for noise mitiga- tion submitted by the developer and accepted by the Commission for Outlots "A" and "B. " Finally, Ms. Jamison indicated that the final plat as proposed shows a 14 foot offset in the alignment of West 9th Street Drive where it intersects with 49th Avenue. She noted that this offset had been approved by Bill Hargett, Director of Public Works. Ms. Jamison indicated that the staff is recommending approval of the final plat of Outlot "C." Canmissioner Cummins questioned what the noise barrier fence is to be constructed of. Dan Schaffer, Webhan Corporation, indicated that the fence is to be a six foot cedar fence. Commissioner Markley questioned who is to be responsible for the maintenance of this fence once it does start to deteriorate. Mr. Schaffer indicated that he was not sure who would be responsible for it after the lots are sold. Chairman Webster questioned who is responsible to maintain the strip of land located between the fence and the street right-of-way, He indicated that there is a large problem around the City with the lack of maintenance in similar situations. There was some general discussion between the Commissioners and the staff regarding the maintenance of the fence and that strip of land between the fence and the street right-of-way, Ms. Jamison pointed out that in this particular instance, the property owners will be responsible to take care of the fence and the State Highway Department will be responsible to take care of the area behind the fence because the fence will be constructed just a few inches inside the back property line and the right-of-way runs right up to the back property line. Commissioner Keirnes made a motion to approve the Final Plat of Outlot "C", Westmoor West as presented. Commissioner Miller seconded the motion. Vote was taken and the motion carried unanimously. IV. WELD COUNTY REFERRAL: SPECIAL USE PERMIT FOR A DAIRY OPERATION LOCATION: 2z miles east of Greeley on North side of U.S. Highway 34 Bypass Ann Jamison indicated that this proposal is for a dairy operation on 60 acres of land approximately 2z to 3 miles east of the city limits. She noted that the dairy facility will initially accommodate 290 head of cattle with future expansion to 530 head. Ms. Jamison indicated that access to this site will be provided on Weld County Road 471, approximately 1500 feet north of U.S. Highway 34. She noted that access to a future residence on the site will be combined with either an existing access onto U.S. 34 or an existing access onto Weld County Road 47k. Finally, Ms. Jamison noted that the Greeley Comprehensive Plan suggests that the long range use of this area is agriculture. She noted that the staff is recommending approval of the Special Use Permit • for the dairy operation. Commissioner Keirnes made a motion to recommend approval to the Weld County Planning Commission for the Special Use Permit for the dairy operation. Commissioner Cummins seconded the motion. Vote was taken !' and the 'motion carried unanimously. VI. STAFF REPORT k Sam Sasaki indicated that Bill Hargett had asked to attend this I Commission meeting in order to discuss street construction standards in subdivisions. Mr. Sasaki noted that the recent annexations and the' outside city standards for street construction are what brought this subject to a head. He indicated that certain questions in regard to who is responsible for what when streets are constructed need to be considered. In addition, Mr. Sasaki noted that questions have arisen concerning street construction for single lot developers and the costs involved to those developers. Mr. Sasaki turned the meeting over to Bill Hargett at this point to define the problems in more detail. Mr. Hargett indicated that one concern was with who is responsible for paying for the oversizing of streets in subdivisions. He noted that the City's Subdivision Regulations require that the developer be responsible for one-half of all streets abutting the subdivision if those streets do not meet City standards. He further indicated that in practice, the developers are being required to design 100% of all collector streets running through ,a subdivision. However, for arterial streets adjacent to or running through the middle of a subdivision, the developer has been required to pay for no more than a local street, and the City picks up the rest of the cost for oversizing the street. He noted that in most instances, there is no difference between an arterial street and a collector street except the designated use and size of the right-of-way. In addition, Mr. Hargett noted that he has been unable to find any written or adopted policy which would relieve the developer of the financial responsibility for the construction of an arterial street. Mr. Hargett indicated that Ft. Collins faced a similar problem in 1972 and decided, at that time, to pick up the cost of all oversizing of streets. As a result, he noted that Ft. Collins ran out of funds in a very short time. The final outcome of this situation is that Ft. Collins now has a lot fee for developers which is paid to the City and covers the oversizing of streets. Mr. Hargett indicated that the second problem which has arisen deals • with City standards in nonurbanized areas that are urbanizing. He questioned at what point do you require developers of single lots to pick up the cost for construction of a street when the surrounding street is not yet constructed. He indicated that a problem in the past has been with small single lot developers having to design and install curb, gutter, and sidewalk for their property when the rest of the street is not installed. He noted that the portion that the developer installs tends to deteriorate before the rest of the street is construc- ted; or, if they escrow the funds instead of installing the street, the funds are not enough to cover the actual construction cost by the time the street is ready to be constructed. Commissioner Miller indicated that he felt that since a collector street is used by all of the citizens in a particular area and arterials are considered to be used by all the residents of Greeley, the developer .should probably be required to pay for only the local portion of the street and all oversizing costs should be picked up with funds generated out of tax revenues.
