There is also a shallow alluvial-aquifer well on the property. This proposal may utilize a significant amount of water and the Department of Planning Services relies on the expertise of the Division of Water Resources to determine if the water supply is adequate in quantity and quality. AgPro Environmental Services, LLC 4311 Hwy 66, Suite 4 Longmont, Colorado 80504 Dear Mr. Dunker: I am responding to your written request of February 2, 2001 regarding Sparboe Farms of Hudson and well number 7289: • First, well number 7289 is currently augmented by Central under a Class D Non- Irrigation Water Allotment contract with the Milton G. Waldbaum Company of Colorado. Scott Mefford of Hydrokinetics notified us last week that the property and well have been purchased by Sparboe Farms. No one from Sparboe farms has notified us and until they do our files indicate the current record of ownership for the well is the Waldbaum Company. It is very important that Sparboe Farms contact us so we can transfer ownership of the Class D contract for the property and well(s) to them. • Central has been augmenting well number 7289 for 22 cubic acre-feet of water per year. If Sparboe Farms expands their operation and needs additional water, they will need to bring their own water to cover the additional cubic acre-feet of water they need augmented by Central. This means they will need to buy or lease enough ditch water to cover this augmentation. • Before buying or leasing the ditch water, Sparboe will need to contact Central. The ditch water Sparboe buys or leases should be with a ditch company Central already has a mechanism in place with for getting delivery of the water back to the South Platte River, which is the way Central prefers. If not, Sparboe needs to make sure they get an agreement with the ditch company and Central as to how Central will get delivery of their water. EXHIBIT Ii b7s` Eric W. Dunker, P.E.
