MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE
A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday,
December 13, 2001, at 10:00 a.m., in the Conference Room of the Weld County Planning Department at
1555 N. 17th Avenue, Greeley, Colorado.

Kim Ogle, Planner, presented case S-611, a minor subdivision final plat.
Discussion among the board members, Mr. Schultz, the applicant, and the applicant's engineer followed.
Doug Melby, Evans Fire Department, made a motion to accept the plat based on the following conditions
and comments: addition and adjustment of the 15 foot perimeter utility easement around the subdivision;
composition of a resolution regarding the dimensions to the entrance of Schultz Lane, with regard to the
50.7 feet and 49.36 feet; dimensions of Schultz Lane right of way be 60 feet on the plat; re-adjust the fire
hydrant from Lot 5 to between Lots 4 and 5, or the location recommended by the Berthoud Fire
Protection District; correct the dimensions to 20 feet on the eastern most private irrigation ditch
easement where it is dimensioned both as 10 feet and 20 feet on the plat; addition of a utility signature
block on sheet 6 of the construction drawings; and shift and adjust the size of the water line.

AGREEMENT FOR THE RELOCATION AND REALIGNMENT
OF A PORTION OF THE McINTYRE DITCH
A public hearing was held on October 25, 2000 at 10:00 a.m. for the purpose of hearing the application of
Harlen Schultz, c/o Landmark Engineering Ltd. The application requested a Change of Zone from the
Agricultural Zone District to the Estate Zone District for a parcel of land located in part of the W1/2 of the
SW 1/4 of Section 7,Township 4 North,Range 68 West of the 6th P.M.,Weld County,Colorado. The Weld
County Board of County Commissioners approved this request with conditions. The adopted Resolution
stated the following as one of the conditions of approval:
"The applicant shall enter into an Improvements Agreement regarding collateral for all onsite
improvements to the Minor Subdivision,and for all offsite improvements proportional to their share
of traffic on Weld County Road 1 as determined by a traffic study."
It was determined in the public testimony that the Weld County staff, Larimer County Engineering and
Harlen Schultz, the applicant, would work together to determine the "scope" of the abovementioned
Improvements Agreement regarding offsite roadway improvements and collateral. On March 3,2001,3:00
p.m. a meeting was held at Landmark Engineering Ltd. to determine what the "scope"would include. In
attendance were Harlen Schultz,Applicant;Don Schultz,attending with Applicant; Ken Merritt,Karl Matz
and Tiffane Moore, all of Landmark Engineering Ltd.; Drew Scheltinga, Weld County Engineering
Department; and Dale Miller, Larimer County Road and Bridge Department.
It was determined and agreed by those in attendance at the March 3, 2001 meeting, that the applicant's
requirements to meet the Board of County Commissioner's Condition of Approval for the proportional share
of offsite improvements to Weld County Road 1 would be as follows:
A. The applicant, with the approval of the McIntyre Ditch Company, shall relocate the
McIntyre Ditch so that it lies East of the proposed future 20-foot right-of-way reservation.
B. The applicant must provide a set of engineered construction drawings to the McIntyre Ditch
Company, Board of County Commissioners, and Weld County Planning and Engineering
for the relocation and realignment of the proposed new McIntyre Ditch for their review and
approval.

C. The construction drawings for the relocation and realignment of the ditch must be approved
by the McIntyre Ditch Company and Weld County Engineering.
D. Upon approval of the new ditch location and design, the applicant will coordinate the
construction of the new ditch with the ditch company. The applicant may begin construction
upon approval of the engineered construction drawings per the following conditions:
1. The applicant will not interfere or disturb the operation of the existing McIntyre
Ditch during construction of the new ditch.
2. The applicant must construct the new ditch so that it lies East of the proposed future
20-foot right-of-way reservation, per the approved construction documents.
3. The applicant must remove the existing trees and stumps located in the existing
McIntyre Ditch, so there are no remaining stumps located in the future road area.
4. The applicant must fill in the existing McIntyre Ditch to the existing grade of Weld
County Road 1.

The intent of this Agreement is to provide documentation describing the Agreement made on March 3,2001
between the parties involved in the relocation and realignment of a portion of the McIntyre Ditch located
along the West property line of Lot A and Lot B of Recorded Exemption No. 1061-07-3-RE 2668.

Dear Ms. Moore:
This letter is in response to your request for an updated water service commitment for up to 5
residential lots, in the proposed subdivision described as follows:
PORTIONS OF SEC.7, T4N, R68W -- WELD COUNTY, CO
Schultz First Subdivision
The District provides water service within its service area as defined by the District. The
provision of water service by extension of existing water lines of the District to the above property
and the installation of taps for lots is done under the terms of the Rules and Regulations of the District
established by the Board of the District from time to time. You may obtain a copy of the Rules and
Regulations from the District. This letter outlines the provisions of the Rules and Regulations,
however this letter does not change any provisions of the Rules and Regulations. The Board of the
District may alter and amend the Rules and Regulations at any time, and the provisions of this letter
are subject to alteration and amendment based on changes in the Rules and Regulations of the District.
We currently have a 10" diameter water line located along Weld County Road 1 with
additional capacity available Therefore, we can commit to provide service to the above property,
subject to the limitations in this letter, for one standard residential 5/8" X 3/4" water tap per lot; and
the following additional limitations on the provision of water service are:
1. In August of 1993 the Little Thompson Board implemented a "system impact" fee of
$1050 per lot for all lots to be added to the system. This is due upon completion of the
main line extension agreement.
2. All improvements to District facilities required to provide service will be the financial
responsibility of the developer in accordance with the District Rules and Regulations.
All improvements must conform to District Specifications.
3. Little Thompson Water District requires the transfer of one share of Colorado Big
Thompson water for each lot in the commitment and then to pay for the rest of the tap
fee as the water lines are put in service. The developer then has the taps to sell with the
lots at the price that he sets.
4. If a fire hydrant is required for the subdivision there is a $2,000 fire hydrant fee that
needs to be paid prior to installation of the fire hydrant. You will be responsible for
any improvements needed to meet the required fire flows in your subdivision.
5. You will be required to provide the needed water lines in the proposed subdivision.
6. The design, installation and total cost of the project will be the responsibility of the
developer.
This commitment letter will expire two years from the date of this letter if the laps have not
been purchased, paid for and installed by that date of expiration. The current fee for the domestic 5/8"
X 3/4" tap is $14,000.00. YOU ARE HEREBY ADVISED THAT THE RULES, REGULATIONS
AND TARIFFS OF THE DISTRICT ARE SUBJECT TO CHANGE WITHOUT NOTICE;
AND THIS LETTER IS ISSUED WITH THE SPECIFIC LIMITATION THAT THE
DISTRICT MAY CHANGE THE RULES, REGULATIONS AND TARIFFS APPLICABLE
TO THE ABOVE PROPERTY AT ANY TIME WITHOUT NOTICE TO YOU OR ANY
PERSON.
