RESOLUTION
RE: APPROVAL OF SPECIAL USE PERMIT FOR A DAIRY OPERATION FOR
WALTER BAILEY, 24482 WELD COUNTY ROAD 55, KERSEY, COLO-
RADO 80644
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 27th day of February, 1980
at the hour of 2 : 00 o 'clock p.m. in the Chambers of the Board
of County Commissioners for the purpose of hearing the applica-
tion of Walter Bailey, 24482 Weld County Road 55, Kersey, Colo-
rado 80644 , for a Special Use Permit for a dairy operation on
the following described real estate, to-wit:
A parcel of land located in the Southwest
Quarter (SWa) of Section 34 , Township 5
North, Range 64 West of the 6th P.M. , Weld
County, Colorado being more particularly
described as follows :
Beginning at the West Quarter Corner (Wk Cor)
of said Section 34 ; Thence East along the
North line of said SWa Section 34 , 547 . 3± feet;
Thence South parallel to the West line of
said SWa Section 34 , 794 . 9± feet;
Thence West parallel to the North line of
said SWa Section 34 , 547 . 3± feet to a point
on the West line of said SWa Section 34 ;
Thence North along the West line of said
SWa Section 34 , 795. 9± feet to the Point
of Beginning.
Said described parcel of land contains 10 . 0
acres , more or less , and is subject to any
rights-of-way or other easements as granted
or reserved by instruments of record or as
now existing on said described parcel of land.
WHEREAS, evidence was presented in support of the granting
of the Special Use Permit for a dairy operation on the above-
described real estate, and
WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolu-
tion authorizes such a use in an Agricultural Zone District upon
approval by the Board of County Commissioners , and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those present,

has studied the request of the petitioner and the recommendations
of the Weld County Planning Commission and all of the exhibits and
evidence presented in this matter, and having been fully informed,
is satisfied that the request for a Special Use Permit for a
dairy operation on the hereinabove described real estate conforms
to the purposes of Section 3 . 3 (E) (2) of the Weld County Zoning
Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application of the
petitioner for a Special Use Permit for a dairy operation on the
hereinabove described tract of land be, and hereby is, granted
subject to the following:
1 . The Development Standards contained in the Special
Use Permit.
2. No building or electrical permits shall be issued on
the Special Use Permit area until the Development
Standards for the Special Use Permit have been placed
on the Special Use Permit plat and said plat has been
delivered to the Office of the Department of Planning
Services .
BE IT FURTHER RESOLVED by the Board of County Commissioners
that the reasons for approval contained in the Planning Commis-
sion recommendations dated January 15, 1980 be, and hereby are,
adopted as the findings of fact of the Board of County Commis-
sioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
February, A.D. , 1980 .

I hereby certify that pursuant to a notice dated January 21, 1980 and
duly published January 25, 1980 and February 14, 1980 in the Platteville
Herald a hearing was held on the request of WALTER BAILEY for a SPECIAL
USE PERMIT for a DAIRY OPERATION.
Tom Honn read the Planning Commission' s favorable recommendation with
development standards.
Walter Bailey was present and commented upon his request.
There was no one present in opposition to this request.
Commissioner Steinmark made amotion to approve the SUP for a dairy
operation for Walter Bailey with the development standards as recommended
by the Planning Commission. The motion was seconded by Commissioner
Dunbar and carried unanimously.

PLANNING COMMISSION RECOMMENDATION
January 15, 1980
2. It is the opinion of the Planning Commission that this proposed
operation is in compliance with the provisions of Section
3 . 3 (E) (2) of the Weld County Zoning Resolution. The proposed
use will be compatible with the surrounding area, in harmony
with the character of the neighborhood and existing agricultural
uses , compatible with the future development in the area and
the County. This determination is based upon the following
responses from the referral entities listed below. Each of
the following referral entities have reviewed this request and
have set forth no objections to it:
1 . Colorado Geological Survey
2. Weld County Extension Service
3 . Town of Kersey Planning Commission
4 . Weld County Health Department
5 . Weld County Engineering Department
6 . Soil Conservation Service
The concerns and/or recommendations of the individual entities
are incorporated into the attached Development Standards .
The Planning Commission recommendation for approval is conditional
upon the following:
1 . The attached Development Standards being recommended and approved
for the Special Use Permit .
2 . No building or electrical permits shall be issued on the Special
Use Permit area until the Development Standards for the Special
Use Permit have been placed on the Special Use Permit plat and
said plat has been delivered to the office of the Department of
Planning Services .

DEVELOPMENT STANDARDS
1. The dairy operation on the hereon described parcel shall be
limited to the facilities shown which are designed to handle
a total of 138 milking cows and all other uses permitted by
right under Section 3. 3.B. of the Weld County Zoning Resolution.
2. The Special Use Permit area shall be maintained in such a manner
so as to prevent soil erosion, fugitive dust, and the growth of
noxious weeds.
3. All phases of the operation shall comply with all County and State
Health Standards and Regulations pertaining to air quality, water
quality, noise emission, and sanitary disposal systems .
4 . Lagoons for wastewater retention shall be installed as per
Rules and Guidelines for Water Pollution Control at Livestock
Confinement Areas issued by the Colorado Department of Health,
May, 1978. The applicant shall be responsible for any additional
applicable directives or guidelines issued by the Colorado
Department of Health, Water Pollution Control Division.
5 . All accesses shall have the approval of the Weld County Engineering
Department. All accesses shall be constructed in accordance with
the recommendations and/or requirements of the Weld County
Engineering Department.
6 . All plans, specifications and data pertaining to the dairy operation
shall be submitted to the Weld County Health Department for
approval prior to obtaining a Building Permit for the dairy
operation.
7. There shall be no discharge of waste water into any streams,
other bodies of water, or adjacent drainage systems without
obtaining a National Pollution Discharge Elimination System Permit
from the Colorado Department of Health.
8. An on-site investigation of the soil shall be made prior to lagoon
construction to determine proper site constraints and sealing
requirements.
9 . The lagoon shall be of sufficient size to hold 2. 32 acre feet of
runoff plus one additional foot of depth for freeboard. If two
ponds are used they shall be of sufficient size to hold 2 .04 acre
feet of runoff plus one additional foot for freeboard.
10 . Manure shall be removed from the Special Use Permit area whenever
necessary or as required by the Weld County Health Department
to mitigate potential odor problems.
11 . The Special Use Permit shall be limited to the plans shown hereon
and governed by the Development Standards stated above and all
applicable Weld County Regulations. Any material deviations 1
from the plans and/or Development Standards as shown or stated
above shall require the approval of an amendment to the Special
Use Permit by the Planning Commission and the Board of County
Commissioners before such changes from the plans and/or
Development Standards shall be permitted. Any other changes
from the plans and/or Development Standards shall be filed in
the office of the Department of Planning Services.
12 . The property owner and/or operator of this dairy operation shall
be responsible for complying with all of the above stated
Development Standards. Noncompliance with any of the above
stated Development Standards shall be reason for revocation of
the Special Use Permit by the Board of County Commissioners.
COMMENTS :
1 . The Platte Valley Fire Protection District did not respond to
the referral sent to it.
2. The applicant submitted a petition in support of the request
containing the signatures of 3 adjacent property owners. A copy
of the petition is included in the attached materials.

The following is the soils and site information you requested for the SW1
of Sec. 34, Twp. SN, Range 64W, regarding your application for a Weld County
Special Use Permit, for a dairy expansion project.
The entire area is comprised of Vona sandy loam, 1 to 3 percent slopes (51B-B).
This is a deep, well drained soil on gentle plains and high terraces. Typically,
the surface layer is a grayish brown sandy loam 10 inches thick with a brown
fine sandy loam subsoil about 18 inches thick, with a sandy loam or loamy sand
to depths of 60 inches or greater.
This soil exhibits only slight limitations for building purposes, which indicates
that county specifications for footings design and construction should be adequate
for the site.
The soil does exhibit a moderate to severe limitation for installation of sewage
lagoon facilities due to rapid permeability in the soil substratum, which will
allow seepage and possible contamination of underground water. An on-site
investigation should be made prior to lagoon construction to determine proper
site constraints and sealing requirements.
The above comments are made from general site data from soil survey information
and does not preclude the need for an on-site investigation if conditions differ
from those cited above.

Subdivision Regulations . This was brought to the attention of the
Planning staff when Mr. Vaughn tried to get a building permit for a
modular mobile home on the property. Mr. Suckla site viewed the property
and distributed pictures to the Planning Commission he had taken of
the site. Discussion followed among the members .
MOTION: Be it therefore resolved to recommend approval to the Board of
County Commissioners for the issuance of a building permit on the
illegal parcel. Motion by Jerry Kiefer, seconded by Frank Suckla. A

DISCUSSION: Mr. Reese stated he is planning a 575 head swine operation
with total confinement-type buildings . Under the floor pits will be used
for waste disposal with a two-stage lagoon system. Because of the mean
air direction, odors from the operation should be carried away from any
neighboring houses in the area. Tom Honn read the Planning staff ' s
recommendation for approval along with the Development Standards into
the record. Dick Heine, surrounding property owner to the west, stated
his opposition to the proposal because he feels the size of the operation
is too large for the site, odors , and possible contamination. J. L.
Sears stated that when the applicant approached him for a site for the
operation that taking everything into consideration they felt this was
the best possible location.

DISCUSSION: This request is to excavate the gravel lying on a 9 . 9 acre
tract. The majority of the gravel extracted will be used as pit-run
material and excavated and loaded as required. Buildings and stockpiles
will be located toward the west end of the site near the access road.
The excavation will begin at the east end of the site and work toward the
west end of the site. Access will be to County Road 13. There being no
questions at this time Tom Honn read the Planning Staff ' s recommendation
for approval and the Operations Standards into the record. Darrell Todd
of the Division of Wildlife then stated the department ' s opposition to
this proposal because there is a permanent easement on this site. Mining
or any other activity that disturbs vegetation and/or changes the current
use of the land covered by the permanent easement is a violation of that
easement. Bob Bosley, attorney for the Frank ' s , stated that they will be
working with the Division of Wildlife and cooperate with them to resolve
the situation. Some discussion followed regarding access to the site.

DISCUSSION: This subdivision is proposed on approximately 8 acres
creating 34 lots . He stated he is in complete agreement with the
conditions of approval recommended by the Planning Staff, but would
request that item 6 .d. regarding dedicated public right-of-way in the
floodplain shall when constructed have their travel portions elevated
to equal or above the 100 year floodplain elevations in order that all
lots may have access during a 100 year flood be eliminated. This was
defined in a letter from the Colorado Water Conservation Board on
November 14, 1979 . He feels this is necessary because of the concern
for engineering and the effect that implementing such a recommendation
would have not only upon the adjacent landowner, but also upon the
lots themselves . Discussion followed in this regard. John Leichty,
attorney representing Mr. and Mrs . George Leggett, owners of Valley
Packing Company, stated that although they have no objection to the
proposed subdivision, they do have several concerns . These concerns
are that they would like to suggest diverting the existing sewer
easement so that it runs between Lots 28 and 29 instead of down the
middle of Lot 29 . He also stated that there could be some potential
problems with the existing packing plant near residential housing
and and impacts that could result. Discussion then followed regarding
the elevation of structures being at least 1 foot above the 1973 100
year flood elevation. It was suggested by Mr. Billings that this be
amended to state that top of footings of all structures shall
be at least 1 foot above the 1973 100 year flood elevation. . . instead
of first floor elevations. . .
MOTION: Be it therefore resolved to eliminate item 6 .d. of the Planning
Staff' s recommendation for condition of approval ; also to amend item
6.e. to state "top of footings" of all structures shall be at least 1

Consider a recommendation to amend Section 3. 3.E.4 . of the Weld County
Zoning Resolution which pertains to uses which are permitted upon granting
a Special Use Permit by the Board of County Commissioners, specifically
agriculturally service establishments.
DISCUSSION: Tom Honn stated that as a result of interest expressed by
the public during the past several months from individuals who either
operate or were interested in establishing agricultural service
establishments has encouraged the creation of an acceptable mechanism

to allow such uses in accord with the general concepts of the County
Comprehensive Plan. The recognition of the problem by the Planning
Commission and Board of County Commissioners prompted the staff to
research and recommend the amendment of Section 3. 3.e. , Special Use
Permit, in the Agricultural Zone District. Discussion followed in
regard among the Planning Commission members . It was suggested that
"on a fee or contract basis" be eliminated from this section also.
MOTION: Be it therefore resolved to recommend eliminating "on a fee
or contract basis" . Motion by Jim Gilbert, seconded by Don Billings .
All present cast a unanimous vote of "aye" .
MOTION: Be it therefore resolved to recommend approval of the

This is a deep, well drained soil on gentle plains and high terraces
at elevation of 4600 to 5200 feet. It formed in eolian and alluvial
deposits.
Included in this unit are some leveled areas. Also included were some
soils with loamy substratums and some soils that are noncalcareous
to depths of 60 inches.
Typically the surface layer is a grayish brown sandy loam about 10
inches thick. The subsoil is a brown fine sandy loam about 18 inches
thick. The substratum, to a depth of 60 inches, is a sandy loam or
loamy sand.
Permeability is moderately rapid. Available water capacity is moderate.
Effective rooting depth is 60 inches or more. Surface runoff is slow
and erosion hazard is low.
Where irrigated this soil is suited to all crops adapted to this area,
including corn, sugar beets, beans, alfalfa, small grains, and onions.
An example of a suitable cropping system Ls alfalfa 3 to 4 years follow-
ed by corn, corn for silage, sugar beets, small grain, beans and back
to alfalfa. Some conservation practices such as land leveling, ditch
lining and pipelines may be needed for proper water applications.
All methods of irrigation are suitable with furrow irrigation the most
� common type used. Barnyard manure and commercial fertilizers are needed
u>
��� for top yields along with maintaining good organic matter content.

, Windbreaks and environmental plantings are generally suited to this

soil. Soil blowing is the principal hazard to establishing trees and
shrubs. This hazard can be overcome by cultivating only in the tree
row and by leaving a strip of vegetative cover between the rows.
Supplemental irrigation may be necessary at the time of planting and
during dry periods. Trees that are best suited and have good survival
are Rocky Mtn. juniper, eastern redcedar, ponderosa pine, Siberian
elm, Russian-olive, and hackberry. Shrubs best suited are skunkbush
sumac, lilac and Siberian peashrub.
Wildlife is an important secondary use, with these soils best suited
for openland and rangeland wildlife. In cropland areas, habitat favor-
able for ring-necked pheasants, mourning doves, and many non-game species
l,.

y3 can be developed by establishing wildlife areas for nesting and escape
cover. For pheasants, the inclusion of undisturbed nesting cover is vital
and should be included in plans for habitat development; this is especially
true in areas of intensive agriculture. Rangeland wildlife, exemplified
by the pronghorn antelope, can be assisted and encouraged by develop-
ment of livestock watering favilities, proper livestock grazing manage-
ment, and range reseeding where needed.
This Vona soil has good potential for urban and recreational development
Lawns, shrubs and trees will do well. Its only limiting feature is the
rapid permeability in the substratum and the hazard of contamination
of the ground water from sewage lagoons.
