RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 314 -
CLARENCE ANDERSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has approved
Recorded Exemption No. 314 for Clarence Anderson concerning
property described as the West half of the Southwest Quarter of
Section 18, Township 6 North, Range 65 West of the 6th P. M. ,
Weld County, Colorado, and
WHEREAS, Clarence Anderson has requested that Recorded
Exemption No. 314 be revised into parcels of . 613 acres and
79 acres, and
WHEREAS, the Board of County Commissioners has studied
said request to amend Recorded Exemption No. 314 and deems
it advisable to waive the one acre minimum lot size requirement
and approve the amendment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the hereinabove
amendment to Recorded Exemption No. 314 for Clarence Anderson
be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 29th
day of July, A. D. , 1981.

Re: Recorded Exemption #314 amended
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Clarence Anderson, et al for an amended recorded exemption.
The parcel of land on which this request has been made is described as
part of the SW1, Section 18, T6N, R65W of the 6th P.M. , Weld County,
Colorado. This property is located 1 mile west of Lucerne, Colorado.
The request is to revise the property into parcels of .613 acres and 79
acres.
The property is jointly owned by two family members, each with an additional
interest in a small tract and home. The revision of Lot A to a .613 acre
parcel equalizes the ownership interest. Section 9-4 A. (7) requires the
minimum lot size for a lot created by recorded exemption to be one acre.
The Department of Planning Service's staff feels that the purpose of the
one acre size is to permit domestic well and septic systems on the same
parcel. It appears the one acre standard is excessive in this request
and can be waived by the Roard's action.
Based upon information submitted with the request and referral responses,
the Department of Planning Service's staff recommends approval of the
amendment. Additionally, the staff recommends a waiver by the Board of
the one acre minimum lot size for the following reasons:
1. No change will occur from the purpose of the original exemption
to create conflicts with the land use policies or regulations of
the County; and
2. The Health Department has indicated no objection to the amendment
and therefore, the reduction of lot size to a .613 acre parcel.

Dear Commissioners:
We are enclosing our application for an amended Recorded Exemption
No. 0803-18-3-RE 314 for a parcel of land within the unincorporated area of
Weld County, State of Colorado.
When we built our home in 1978, an acre was taken from a part of our
farm. We did have to take some land on the east side of an irrigation ditch
to get the required amount of land to make up an acre in order to qualify
for the recorded exemption. That land on the east side of the ditch has been
used continually as farm land. The remaining part of the acre had been
pasture land and had never been used for farming crops. Since we use North Weld
Water instead of a well, and since our ceptic tank, leach field, and house are
well within one-half acre, we'd like to deed one-half acre back to the farm.
Earl and Luella Anderson took a half-acre from the farm soon after we did.
Their house, ceptic tank, and garage, which were already existing, are contained
in that half-acre. Since our farm is owned in partnership with Luella Anderson,
now a widow, we feel that we should equalize the amount of land taken from the
f arm.
We, Lucile and Clarence Anderson, would appreciate your giving your
approval to our filing for an amended recorded exemption.Sincerely,
