High Plains Engineering conducted a preliminary investigation of soils on the Reynolds property located at 6828 Highway 66. A report dated November 20, 2002 is included in the Special Use Permit application materials. Two four-inch diameter borings were advanced to a depth of twenty feet at the southern-most area of planned construction for the proposed Aurora Dairy expansion. Silty gravel was identified at 13 to 14 feet below ground surface. Due to the proximity to the Saint Vrain River and other gravel operations located in the area, if recoverable gravel resources exist it would be located on the southern most portion of the site and that the gravel deposit thins to the north as elevation increases due to a shale bedrock shelf. Planned construction will occur on the higher shale shelf. According to State Statute 34-1-305,Preservation of Commercial Mineral Deposits for Extraction Part(2)states, 'After adoption of a master plan for extraction for an area under its jurisdiction, no board of county commissioners, governing body of any city and county, city, town, or other governmental authority which has control over zoning shalt by zoning, rezoning,granting a variance or other official action or inaction,permit the use of any area containing a commercial mineral deposit in a manner which would interfere with the present offuture extraction of such deposit by an extractor." Part(3)states, "Nothing in this section shall be construed to prohibit a board of county commissioners, a governing body of any city and county, city, or town, or any other governmental authority which has control over zoning from zoning or rezoning land to permit a certain use, if said use does not permit erection of permanent structures upon, or otherwise permanently preclude the extraction of commercial mineral deposits by an extractor from land subject to said use." No construction is planned for the southern portion of the site. The southern-most planned construction will consist of stormwater retention structures and fences for livestock. Should gravel extraction be viable,economic or necessary,none of the planned construction is permanent and would not impede exploration according to State Statute 4-1-305,parts(2)and(3)as outlined above. The site is comprised of two topographic areas;a southern area of heterogeneous alluvial deposits associated with the river and a northern upland terrace area underlain by clay, sandy clay, and/or weathered shale. Based on information in the engineering reports and topography of the site, I concur with your assertion that recoverable gravel resources most likely occur within the alluvium on the southern portion of the property below the river terrace. It is my understanding that no permanent structures are planned for the southern portion of the property. Storm water retention ponds and fences may be built, but neither these features nor the proposed agricultural operations on the northern portion of the property should preclude exploration or extraction of sand and gravel from the southern portion if the owner should chose to engage in mining operations. Based on our discussions and the information provided, it is my opinion that the proposed use of the property does not contradict the limitations cited in Colorado Revised Statute 34-1-305 concerning interference with present or future extraction of sand and gravel from the southern portion of the property If you have any questions or comments relative to this report, please contact our office. Schroeder, PE t 33548 jet o��sPONAI E���� PURPOSE: This report reflects a preliminary soils investigation from soil borings to determine the subsurface soil identification, and to determine the physical characteristics of the soil. The recommendations contained in this report are based upon the results of field and laboratory testing, engineering analysis, and experience with similar soil conditions. LOCATION AND SITE CONDITIONS: This report represents the results of the data obtained during the subsoil investigation at "Reynolds Feed Lot", for the proposed lagoon site at 6828 Highway 66, the East 1/2 of the NE '4 and the NE ' of the Southeast ' of Section. 30, T3N, R67W, of the 6`h P.M., Weld County, CO. The site is presently a large vacant parcel. This large parcel appears to have gently rolling topography, with approximately 1.0% to 1.5% slopes to the Southeast. — SUBSOIL CONDITIONS: Two, four-inch diameter holes were drilled to a depth of twenty feet at the building site on November 12, 2002, as shown on the attached site map. Samples of the soil were taken at two-foot intervals. These samples were analyzed in the field and laboratory to determine the characteristics of the • soil for identification and foundation design. In general, the soil profiles in the two test holes did not vary to a considerable degree, as the attached profile hole logs indicate. The Standard Penetration Test similar to ASTM D1586 showed a range of 10-11 blows for 12-inch penetration, at a depth of 4 feet and a range of 12-13 blows for a 12-inch penetration at a depth of 9 feet. Free water was encountered during the drilling operation at a depth of 19 feet. A secondary inspection indicated that the water remained at 19 feet two days after the initial drilling. SUBSURFACE ANALYSIS AND RECOMMENDATIONS: The clay layer from 4 to 14 feet may be excavated and possibly used as the lagoon liner. Additional testing would be required to determine if this material would meet the standard lagoon liner requirements. CONSTRUCTION DETAILS: In any soil investigation, it is necessary to assume that the subsurface soil _ conditions do not vary greatly from the conditions encountered in the field and laboratory testing. The accompanying report is presented using best professional judgment based on the limits of the extent of testing commissioned by the client. Our experience has been that at times, soil conditions do change and variations do occur. These may become first _ apparent at the time of excavation for the lagoons. If soils conditions are encountered which appear different from the test borings as presented in this report, it is recommended that this office be called to inspect the open excavation.
