' J J RESOLU 'I' I O N RE : Partial Suspension of Victor Jacobucci , Weld County Commissioner WHEREAS , members of the Weld County Council were informed that Weld County Commissioner , Victor Jacobucci , had been indicted on August 17 , 1977 , by the Weld County Grand Jury on one count of Failing to Disclose a Conflict of Interest , and two counts of First Degree Official Misconduct ; and, WHEREAS ,. the Weld County Home Rule Charter provides in Section 13-8-(5 ) in part as follows: In the event an elected official is formally charged or indicted for the commission of a crime , the council may suspend such officer , with or without pay , pending prosecution of the offense . ; and, WHEREAS , the word "crime" is defined in the Weld County llome Rule Charter in Section 16-10-(14) as follows : Crime - A felony or a class I or II misdemeanor as defined by state lam, or a' comparable fed- eral crime or crime in some other state . Does not include petty or traffic offenses . ; and , • WHEREAS , the Weld County Council considered the possible suspension of Weld County Commissioner , Victor Jacobucci , at its special meeting duly called and held on August 23 , 1977; and , WHEREAS , at said special meeting the Weld County Council made the following findings : 1 . Weld County Commissioner , Victor Jacobucci , was indicted by the Weld County Grand Jury on August 17 , 1977 , for one count of Failing to Disclose a Conflict of Interest , a class II misdemeanor, and two counts of First Degree Official. Misconduct , each also being a class II misdemeanor . 2 . The charges contained in the indictment relate directly to Commissioner Jacobucci 's position as Coordinator of the Department of Engineering Services of the Office of the Weld County Commissioners. NOW, THEREFORE, PE IT RESOLVED, that Weld County Commissioner, Victor Jacobucci, be, and he hereby is, suspended from his position as Coordinator of the Department of Engineering Services of the Office of the Weld County Commissioners. This suspension shall take effect immediately this 24th day of August, 1977, and shall remain in effect until such time as Victor Jacobucci has been acquitted of the charges rendered against him in the indictment handed down by the Weld County Grand Jury on August 17, 1977. Commissioner Jacobucci shall continue to receive full commissioner's pay during the period of suspension and shall continue to perform all of his commissioner's duties other than those from which he has been suspended as stated above.
