RESOLUTION RE: APPROVAL OF SPECIAL USE PERMIT FOR A DAIRY OPERATION FOR TED AND MARION KOOLSTRA, 30126 HIGHWAY 257, WINDSOR, COLORADO 80550 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 10th day of June, 1981 at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Ted and Marion Koolstra, 30126 Highway 257 , Windsor, Colorado 80550, a Special Use Permit for a dairy operation on the following described real estate, to-wit: Part of the SW4, Section 34, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, the petitionerswerepresent, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a dairy operation on the above described real estate, and WHEREAS, Section 3. 3 (E) (2) of the Weld County Zoning Resolution authorizes such a use in an Agricultural District upon approval by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the petitioners and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a dairy operation on the hereinabove described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado that the application of the petitioner for a Special Use Permit for a dairy operation on the hereinabove described tract of land be, and hereby is , 810498 LHR 2072 PZ 03617 Page 2 RE : APPROVAL OF SUP - KOOLSTRA (Continued) granted subject to the Development Standards as amended and contained in the following: 1. The development standards contained in the Special Use Permit and Development Standard #5 is hereby amended as follows: "5. The Dairy facilities (corrals, barn, and lagoon) shall be protected by a berm to prevent site runoff from leaving the property. Surface runnoff should be designed to be diverted to the lagoon. Refer to Soil Conservation Service recommendations for design requirements found in the Special Use Permit filed with the Weld County Department of Planning Services. " BE IT FURTHER RESOLVED by the Board that the reasons for approval contained in the Planning Commission recommendations dated April 21, 1981 be and hereby, are adopted as the findings of fact of the Board of County Commissioners in this matter. The Planning Commission recommendations for approval is conditional upon the following: 1. the attached Development Standards being recommended and adopted for the Special Use Permit. 2. Before installation of the new northern driveway, Colorado Department of Highways requires that a driveway permit be - obtained. 3. No building or electrical permits shall be issued on the Special Use Permit area until the Special Use Permit plat has been delivered to the office of Planning Services. • DEVELOPMENT STANDARDS _ THEODORE KOOLSTRA SUP-463 :81:9 1. The dairy operation on the hereon described parcel shall be limited to the facilities shown which are designed to handle a total of 80 cows and all other uses permitted by right under Section 3.3.B. of the Weld County Zoning Resolution. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, noise emission and sanitary disposal systems. 4. Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas as issued by the Colorado Department of Health, May, 1978. The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health, Water Pollution Control Division. 5. All plans, specifications and data pertaining to the dairy operation shall be submitted to the Weld County Health Department and/or the Colorado Depart- ment of Health for approval prior to operating the dairy operation. • 8, There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 9. The Special Use Permit shall be limited to the plans shown hereon and govern- ed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations frcm the plans and/or Development Standards, as shown or stated above shall require the approval of an amend- ment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 10. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Non- compliance with any of the above stated Development Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. VT:ra $19 6 COMMENTS THEODORE KOOLSTRA SUP-463:81:9 1. No response was made from the Fire District referral. 2. No response from surrounding property owners has been received except from a representative of Kodak. Concerns expressed are dealt with by the Development Standards. 3. The State Engineer reponied to the concern of the B. H. Eaton Ditch Company regarding water requirements by stating that livestock wells are not restricted to pumping restrictions. Facility is built for 150 head, but plans on only 80 head. A seep ditch flows along the east side of the property. 240' X 240' corrals are being built on the north end. Corrals on the south end will be abandoned. Slope of the land is to the northeast at 1% or less. There is a suitable site on the east end of the rr corrals for a holding pond, 240' X 120' triangle shaped. Wash water from the barn will i'� be - :_ped into an irrigation ditch west of the property and diverted into a holding 1: pond or into an irrigation system north of the property owned by Kodak. A honey wagon 'll is available from his brother if the holding pond needs to be emptied. s , SUGGESTED SOLUTION(S) A holding pond, 3' deep, is needed on the east side of the a � corrals to hold 0.55 AF of runoff and wash water for 90 days. A 16' berm and dike around the 240' X 120' holding pond should be constructed 2' high for freeboard and a CMP overflow pipe installed into the seep ditch at the NE corner. A diversion ditch is needed along the south side of the new corrals to divert foreign water and runoff from buildings and home site away frcm corrals and holding pond into seep ditch. The diversion ditch will need to carry 2.8 CFS and should have a culvert at the end going into the seep ditch. Holding pond should be fenced to keep animals and children away from it. *Check appropriate category April 13, 1981 To: The Weld County Planning Board SUBJECT: Special Use Permit for a Dariy Operation on a Parcel of Land Described as Lot A, RE202 , Part SWa Section 34, T6N, R67W for Theodore and Marion Koolstra Please consider the following comments on behalf of the B. H. Eaton Ditch Company: 1. Should the holding pond overflow for any reason it would probably flow into the seepage ditch on the immediate east edge of the holding pond. This would result in contamina- tion of the seepage ditch plus Pollution of the Poudre River into which the seep ditch flows about 1/3 of a mile north. The B. H. Eaton Ditch ends on Mr. Koolstra' s property and has an overflow device that intermittently also allows flow into the seepage ditch. We are concerned that if Mr. Kool- stra' s waste disposal system should fail or overflow, con- taminating the Poudre River, that the B. H. Eaton Ditch Company could in part be held responsible. This problem could result in a completely unjustified expense to the B. H. Eaton Ditch Company. Adequate preventive steps must be taken to assure there is no flow onto adjacent property or to the river. - 3 - be used for that purpose. Recognizing this, the B. H. Eaton Ditch Company, accepts no responsibility whatever for any damage arising out of Mr. Koolstra' s cattle drinking such water. 4. As for pumping excess wastes to the west into an irrigation ditch owned by another party, this privilege has not been granted to Mr. Koolstra. I am confident that no such privilege will be granted. 5. It also should be pointed out that contrary to the statement in the application all property surrounding the proposed dairy except that to the east is zoned A, ground to the north, east and west of the dairy property is zoned industrial. For the stated reasons we recommend that this special use permit not be granted until the above indicated inadequacies of the proposed operation are fully corrected. W. WaSrne Miller President B. H. We question whether or not the actual size of the holding pond is adequate to hold all the waste material that this proposed dairy operation could generate. According to the "Inventory and Evaluation" form the proposed holding pond is supposed to be 240 ' x 120 ' with a 16 ' berm and dike around it. The actual holding pond as shown on the pro- posed permit maps is about 160 ' x 75 ' with a less than 16 ' berm at the northeast corner. The berm does not extend around the entire pond. It appears that before the dike or berm becomes very effective, the liquid waste will be running out of the south end of the holding pond into the seepage ditch. 3. It should be pointed out that the water information furnished as to the daily consumption of the proposed operation is not added correctly - the correct total is 3200 gallons per day. We think this may be a conservative number, particularly using only 200 gallons per day for barn washing for a 60 cow herd. Based on 3200 gallons per day estimate of daily usage, annual consumption would approximate 3.4 acre-feet of water. This is more than twice the water available through the well permit fur- nished with the application which states Mr. Koolstra is allowed 1. 3 A/F annually from the underground alluvium. The use of the seepage ditch water or the B. H. The recommendations we provided to Mr. Koolstra on February 10, 1981 for a holding pond and storm water diversion were not the same as those submitted - with the plan. However, the quantities of required storage and pond sizing are still within reason for the design submitted in the SUP request. I have enclosed a map showing the location of needed embankments to properly divert storm runoff to its proper location. A dike, 1 foot in height is needed on the south and west sides of the corral areas to intercept and carry outside surface runoff away from the corrals. Diking is also needed along the east and north side of the corrals to intercept and carry corral surface runoff to the holding pond area. Height will need to be determined by the slope and grade needed to carry runoff to the pond. As stated in our inventory and evaluation, a holding pond of 240' X 120' X 3' will be needed to provide adequate 90 day storage for storm surface runoff and wash water from the dairy barn. Overflow protection will be required for the holding pond by means of a pipe through' the embankment of the pond to the field on the north side of the dairy in such a location that overflow will not return directly to the drainage ditch. This arrangement will probably require easements from adjoining landowners to allow the discharge.
