COMPANY:
WHEREAS, the Union Pacific Railroad Company has tendered an
agreement covering the installation, maintenance and operation of a
flashing light grade crossing protection at the intersection of Rowe
Avenue with the tracks of the Railroad Company at Pierce, Colorado;
said agreement being identified as Railroad Company' s C. D. No. 46615;
attached and made a part of this resolution, and
WHEREAS, after careful review and consideration, the Board believes
it to be to the best interests of the County to accept the terms of
said agreement.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners
Weld County, Colorado, authorize the Chairman to sign the Union Pacific
Railroad Company's agreement, identified as C. D. No. 46615.
The above and foregoing resolution was, on motion duly made and
seconded, adopted by the following vote:

THIS AGREEMENT, made and entered into this
27 day of JUNE , 1962,
;by and between UNfON PACIFIC RAILROAD COMPANY, a corporation
j of the State of Utah (hereinafter called "Railroad Company") ,
party of the first part, and COUNTY OF WELD, a municipal cor-
poration of the State of Colorado (hereinafter called 'County") ,
'party of the second part, WITNESSETH:
RECITALS:
The parties hereto desire the installation,
maintenance and operation of flashing light grade
crossing protection at the intersection of Rowe
Avenue with the tracks of the Railroad Company at
Pierce, Weld County, Colorado, and to set out the
terms and conditions attendant thereupon this
agreement is made.
AGREEMENT:
NOW THEREFORE, it is mutually agreed by and between
the parties hereto as follows:
Section 1. RAILROAD COMPANY TO FURNISH AND INSTALL FLASHING
LIGHT GRADE CROSSING PROTECTION.
As promptly as practicable after the execution and
delivery of this agreement the Railroad Company shall, at the
' joint expense of the parties hereto , furnish and install
flashing light type grade crossing signals at RoweAvenue in
(Pierce, Colorado , the estimated cost of furnishing and in-
stalling such protection being Eight Thousand Three Hundred
Forty-eight Dollars (48,34$.00) , but the actual cost shall,
'nevertheless, govern.
Section 2. COUNTY TO BEAR PORTION OF COST OF PROTECTION.
The County shall, upon rendition of bill therefor by
the Railroad Company, promptly reimburse the Railroad Company
for one-half the cost incurred by the Railroad Company for
furnishing and installing said flashing light grade crossing

protection , cost as used herein to be all assignable costs,
.material to be charged at its current value when and where
;used.
Section 3. MAINTENANCE OF PROTECTION.
Upon completion of the installation of said flashing'
light grade crossing protection the Railroad Company shall, at
;its own expense, maintain and operate the same.
Section 4 . SUCCESSORS AND ASSIGNS.
This agreement shall inure to the benefit of and be
binding upon the parties hereto , their successors and assigns. !
IN WITNESS WHEREOF, the parties hereto have caused
this agreement to be executed in duplicate as of the date firs
herein written.

RESOLUTION
WHEREAS, the UNION PACIFIC RAILROAD COMPANY has •
tendered to the COUNTY OF WELD, State of Colorado, an agree-
ment covering the installation, maintenance and operation of
flashing light grade crossing protection at the intersection
of Rowe Avenue with the tracks of the Railroad Company at
Pierce, Colorado; said agreement being identified as Railroad
Company's C.D. No, 46615; and
WHEREAS, the Board of County Commissioners of
County of Weld4 State of Colorado. has said proposed agree-
ment before it and has given it careful review and consider-
ation; and
WHEREAS, it is considered that the best interests
of said County of Weld. Statebof Colorado
will be subserved by the acceptance of said agreement;
THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
:COMMISSIONERS OF COUNTY OF WELD, STATE OF COLORADO;
That the terms of the agreement submitted by Union
Pacific Railroad Company as aforesaid be and the same hereby
;are accepted in behalf of County of Weld. State of fjo}grado.
That the Chairman of the Board of County Commission-
ers of said County hereby is authorized, empowered and direc-
ted to execute said agreement on behalf of said County, and
that the County Clerk hereby is authorized and directed to at-
test said agreement and to attach to each duplicate original

Dear Mr. Reed: a
You now probably have our inquiry dated August 23,
File: E-82-C, requesting advice as to whether we should now
proceed with the installation of flashing light protection
at Rowe Avenue, Pierce, Colorado.
You will probably recall the discussion between
members of the Weld County Commission and Railroad repre-
sentatives at a meeting April 30, 1962, at which time the
crossing protection for Rowe Avenue was considered.
At that meeting you also considered the closing of
Main Street in order that the grade crossing could be vacated
at the time flashing light protection would be installed at
Rowe Avenue.
If you plan Commission action in the near future to
vacate the crossing at Main Street in Pierce, we would suggest
that that be accomplished at the same time that flashing light
protection is put in service at Rowe Avenue.
Will you please advise relative to the above.

STATEMENT
B7 the Commission:
On January 7, 1963, Union Pacific Railroad Company (Union
Pacific) filed its application according to the rules of this Commis-
sion, seeking approval for the installation of flashing - light type
grade crossing signals at Rowe Avenue, where a crossing at grade is
made by said street over a north-south main-line of Applicant rail-
road at Pierce, Colorado.
Other explanatory material as submitted with the instant
application includes:
1. Copy of fully executed Agreement C.D. No. 46615 made
on June 27, 1962, between Union Pacific and Colorado
County of Weld (County) regarding installation, pay-
ment and maintenance of flashing light grade cross-
ing signals at Rowe Avenue, Pierce, Colorado.
2. Copy of Resolution of Board of Weld County Commis-
sioners at their meeting held on June 27, 1962, to
accept and execute the above agreement.
3. Sheet No. 67.2 of Signal Drawing B-4730 C, Union
Pacific Railroad Company Signal Department, to show
wiring plans and proposed installation of Flashing
Signals at Rowe Avenue, Pierce, Colorado.
With reference to the agreement herein, it appears the
estimated cost of furnishing and installing the proposed flashing
light signals is $8,348.00. However, the actual cost shall govern,
and upon receipt of billing, Weld County agrees to reimburse Union
Pacific for one-half of all costs, labor and material as assignable
to the crossing installation. When and after the proposed flashing
signals are installed, continued operation and maintenance thereof
will be by Union Pacific and at its own expense.
Upon investigation of the instant proposal, it appears
that Rowe Avenue is the city portion of an east to west access road
of the Weld County system. It is located at the northerly outskirts
of the Pierce railroad industrial yard. Only a single north-south
main track of Union Pacific is involved, since the grain elevator and
industrial trackage is all located to the south within the switching
yard.
Road crossing at the rail line is 27 feet wide and asphalt
paved as a part of the roadway section. Vision is open in three seg-
ments or quadrants at the crossing; some coal sheds and a grain ele-
vator on a west side industry track obstruct vision in the southwest
quadrant for motorists moving eastward over the tracks.
It appears that increased traffic volumes in this area have
required asphalt paving of some five miles of the roadway eastward
from the crossing. A concentration of school facilities at Pierce
has also produced additional school bus travel over the crossing.
Resulting then, from inquiries by local citizens, the Weld
County Commissioners and Union Pacific Railroad completed the joint
agreement as noted above, and the instant application is made for
Commission approval.
In further review of the proposal, the Commission forwarded
a copy of the Application, together with a Notice to interested
parties, including also the Mayor, Town of Pierce, to ascertain if any
other action was desired within the period of twenty (20) days as

designated in said Notice. No reply has been received by the Com-
mission.
After consideration of the instant proposal, it is the be-
lief of the Commission that effectiveness of automatic signal pro-
tection is accepted by the utility and the public agencies affected
herein. The signal installation will upgrade the crossing protec-
tion to meet the road improvements and increased use. Hence, it is
apparent the safety devices as sought here would be in the public in-
terest and protect traffic on both the highway and the railroad.
It is therefore the belief of the Commission that the pro-
posed change is compatible with the public interest, and the Commis-
sion determined to hear, and heard, said matter forthwith, without
further notice, upon the records and files herein.
FINDINGS
THE COMMISSION FINDS:
That it is informed in the instant matter, and the forego-
ing Statement, by reference, is made a part hereof.
That public safety, convenience and necessity require the
installation and approval of standard flashing type automatic cross-
ing signals at the grade crossing of Rowe Avenue over Union Pacific
rail line in Pierce, Colorado.
That the authority sought in the instant application should
be granted.
ORDER
THE COMMISSION ORDERS:
That Applicant, Union Pacific Railroad Company, be, and it
hereby is, granted a certificate of public convenience and necessity
to authorize and approve the installation, operation and maintenance
of standard automatic flashing-light grade crossing signals at .he
crossing of Rowe Avenue over Union Pacific rail line in Pierce, Colo-
rado.

That the work to be done, costs, installation and mainte-
nance of the protection devices, shall be as indicated in the pre-
ceding Statement, said Statement, Agreement and Wiring Exhibits are,
by reference, made a part hereof.
That the signal devices and installation shall all be in
conformance with the current Bulletin of the Association of American
Railroads' Joint Committee on Railroad Protection.
This Order shall become effective forthwith.
