Home My WebLink About800546.tiff RESOLUTION RE: SUBMITTING TO THE QUALIFIED ELECTORS OF THE COUNTY OF WELD, STATE OF COLORADO, AN AMENDMENT TO SECTION 4-3A OF ARTICLE IV OF THE HOME RULE CHARTER FOR WELD COUNTY, COLORADO CON- CERNING THE FUNCTIONING OF THE HEALTH DEPARTMENT AND THE POWERS OF THE BOARD OF HEALTH. WHEREAS, the Board of County Commissioners of Weld County, Colorado, Pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of Health of Weld County has requested the Board of County Commissioners to place a proposed amendment to the Weld County Home Rule Charter on the November 4 , 1980 , general election ballot. WHEREAS, Section 30-11-506 , C.R.S . 1973 and Section 17-1 of Article XVII of the Home Rule Charter require that a resolution be adopted by the Board submitting the proposed amendment to the qualified electors, and WHEREAS, the Board of County Commissioners feels that the amendment proposed by the Board of Health is overly broad in its grant of power to the Board of Health, and WHEREAS, the Board of County Commissioners believe that the qualified electors of Weld County should have the opportunity to vote for a more specific delegation of powers to the Board of Health should they believe that the amendment proposed by the Board of Health is overly broad. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Weld County, Colorado: Section 1. At the next general election to be held on November 4, 1980, there shall be submitted to the qualified electors of the County of Weld, State of Colorado, for their approval or rejection the following amendment to the Home Rule Charter for Weld County, Colorado, to-wit : Section 4-3A of Article IV of the Weld County Home Rule Charter is hereby amended by the addition of a new paragraph (5) to read as set forth in Exhibit "A" , a copy of which is attached hereto and incorporated herein by reference. 800546 C2 Section 2 . Each elector voting at said election and desirous of voting for or against said amendment shall cast his vote as provided by law either "Yes" or "No" on the proposition: "Shall Section 4-3A of Article IV of the Home Rule Charter of Weld County, Colorado be amended by the addition of a new paragraph (5) to pro- vide that the Board of Health shall have the powers and duties set forth in state statute specifically providing however, that the Board of County Commissioners shall establish the budget and set fees for the Health Department, that the Health Depart- ment and its employees be a part of the Weld County personnel system, that purchasing, accounting and bookkeeping functions of the Health Department be performed by Weld County and that the salary of the Director of Public Health be set by the Board of County Commissioners?" Section 3 . The votes cast for the adoption or rejection of said amendment shall be canvassed and the result determined in the manner provided by law, and if a majority of the electors voting on the question shall have voted "Yes" , the said amend- ment shall become a part of the Weld County Home Rule Charter.
