RE : GRANT MOBILE HOME PERMIT NO. 424 FOR C . R. TUCKER FOR A THIRD
MOBILE HOME AS AN ACCESSORY USE ON AN AGRICULTURAL UNIT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, C. R. Tucker has applied to the Board of County Com-
missioners of Weld County, Colorado for a permit to place a third
mobile home on the following described real estate as an accessory
use on an agricultural unit and which is to be occupied in an
A-Agricultural Zone District, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, on the 18th day of March, 1981, considered the request
of C. R. Tucker for a third mobile home as an accessory use on a
parcel of land more particularly described as follows:
The Northwest Quarter of Section 29 , Town-
ship 8 North, Range 65 West of the 6th P.M. ,
Weld County, Colorado
WHEREAS, the Board of County Commissioners , having heard
the applicant, as well as the recommendation of the Department
of Planning Services , finds that said request should be granted
provided the applicant obtains a septic permit prior to making
application for a building permit for the mobile home.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the request of C. R.
Tucker for permission to place a third mobile home as an acces-
sory use on an agricultural unit in an A-Agricultural Zone District
be, and hereby is, granted provided the applicant obtains a septic
permit prior to making application for a building permit for said
mobile home.

COMMENTS:
Mr. Tucker has Mobile Home Permit 1145 and ZPMH-413. This 3rd mobile home will be
located in the same area. The setbacks from the roads and property lines are adequate.
There are other mobile homes in the area. Lone tree Creek is to the east of the
improvements. The Flood Plain Map does not include the NA of this section 080266-0480A.
The improvements are on a rise and I do not believe the Creek would cause a problem.
I recommend approval. _

Gentlemen,
In reply to your letter of August 1''7, 1970, you inforned ne that the
Weld County Board of Adjustments had granted me a temporary .ob le
home permit for one year end t et this perrit would be subject to
review and to any new rules and re ulntions.
I wish to i.nfor:° you et this tine that the type of permit you have issued
is not satiafgctory. We did not apply for a temporary perr:it. We applied
for a perr.,it as an accessory to the main business. This is covered on
Page 11 of the Zoning Resolutions es follows,
"6.1 Uses permited (2), obile fl 's CB)."

limited to one mobile Home per lot in any..1C, commercial
oistrict....where a •°obile home is needed to boast' en
employee on the vop9rty for the purpose cf protection or
control of the principal use of the lot."
I wish to make note st this time that you gertler:en es well as t' a citizens
of Weld County are to comply with the rules as set forth in the above
section quoted. I do not believe that these rules were written only for
the citizens. They are a guideline for you to follow es well as the
citizens.
At our neeting on !u gust 14, the county attorney, Mr. Sam lelep, advised
you that we were in compliance with the section quoted above and that the
psrnit should be issued in accordance thereof. You gentlemen hare taken
it upon yourselves to issue a ior7it other than what was applied far.
You do not have this authority; therefore, I sur :uat that you issue a
permit in accordance with the apniic tic- submitted. I have no intentions
of submitting to to the whims of the bocrd ehen several thcusgnd dollars
are involved in the purchase of a c obile 1 ore.
In closing, I wish to state that if it is necessary to take the natter
to court to protect i*' rights, this will be done.
