RE: Possible Conflict of Interest of Weld County Councilman
Robert Martin
WHEREAS , by letter dated May 4, 1978, the Weld County
Council received from Weld County Commissioner Norman Carlson a
request to investigate the possible conflict of interest of Weld
County Councilman Robert Martin because of his filing of a lawsuit
against employees and agencies of Weld County; and
WHEREAS, the Weld County .Council has held hearings and
investigated that question; and
WHEREAS , during said hearings and investigation the Weld
County Council has made the following findings of fact :
1 . On April 4 , 1978 , under Civil Action No. 29814 , Robert
P. Martin, Betty Martin and Mary J. Martin filed a claim against
the Weld County Department of Social Services, William Baird,
and Frankie Purdue.
2 . The Home Rule Charter for Weld County provides in
Section 16-9 as follows :
Section 16-9--Conflict of Interest .
( 1 ) General : No county officer , member of an
appointed board, or employee shall have any
interest in any enterprise or organization doing
business with Weld County which might interfere
with the unbiased discharge of his duty to the
public and the best interest of the county . This
restriction shall not apply where the officer ,
member of an appointed board, or employee ' s depart-
ment has no direct contact nor business transaction
with any such enterprise or organization.
3 . The filing of a lawsuit by Robert Martin against an
agency and employees of Weld County constitutes having an interest
in any enterprise or organization doing business with Weld County.
4 . The fact that Robert Martin does have an interest in
an enterprise or organization doing business with Weld County
might interfere with the unbiased discharge of his duty to
the public and, therefore, might not be in the best interest
of the county .
NOW, THEREFORE, be it resolved, that based upon the fore-
going findings of fact , a conflict of interest exists for Weld County
Councilman Robert P. Martin because of his participation in a civil

suit against the Weld County Department of Social Services and two
of its employees and his participation on the Weld County Council .
