MEMORANDUM OF AGREEMENT
THIS AGREEMENT, made and entered into this /(n day of , 19 %S'
by and between the NORTH WELD COUNTY WATER DISTRICT, hereinafter called First Party,
and hereinafter called Second Party,
WITNESSETH:
WHEREAS,the First Party is a legally formed water district in Weld and Larimer Counties,
Colorado, and;
WHEREAS, the Second Party is desirous of purchasing water taps from said District;
NOW, THEREFORE, in consideration of the premises and the terms of this Agreement, it
is mutually agreed as follows;
1. Second Party agrees to purchase / water tap(s) , class O/ from First Party at
the rate of$ </Qnn 60 per tap, or a total price of$_4/006,On . Further, Second Party agrees
to pay said sum of$ 1/InU On concurrent with the execution of this Agreement.
2. Further, in the event the Second Party desires to sell any of their Big Thompson Project
Water attached to their property for irrigation, they hereby agree to give First Party the first option
to purchase said water, at the then market price, and to execute all necessary documents in
connection therewith, including documents for the transfer of any such water.
3. Further, Second Party agrees to pay all costs and charges as set by First Party.
4. It is further mutually agreed that this Agreement shall extend to and be binding upon the
heirs, executors, administrators and assigns of the parties hereto.
IN WITHNESS WHEREOF, the parties hereto have hereunto and hereunder set their
signatures the day and year first hereinabove written.
