HomeMy WebLinkAbout810335.tiff RESOLUTION RE: ESTABLISHMENT OF ROAD AND BRIDGE ADVISORY COMMITTEE AND ADOPTION OF BY-LAWS FOR SAID ADVISORY COMMITTEE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado deems it advisable to establish a Road and Bridge Advisory Committee, the function of said Committee to be as follows: 1. To make recommendations to the Board of County Commissioners on priorities for capital and repair projects to be included in the annual and 5-year plans; to review the proposed annual and 5-year plans on a regular basis. 2 . To review the safety aspects of the County Road and Bridge system and to make appro- priate recommendations for improvements to the Board of County Commissioners. 3. Such other functions as may from time to time be defined by the Board of County Commissioners. WHEREAS, the By-Laws of the Road and Bridge Advisory Com- mittee have been presented to the Board of County Commissioners for approval, and WHEREAS, the Board of County Commissioners deems it advisable to adopt said Road and Bridge Advisory Committee By-Laws. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that a Road and Bridge Advisory Committee be, and hereby is, established. St inmark DATE PRESENTED: FEBRUARY 4 , 1981 February 2 , 1981 BY-LAWS OF THE WELD COUNTY ROAD AND BRIDGE ADVISORY COMMITTEE ARTICLE I - NAME OF COMMITTEE The Committee shall be called the Road and Bridge Advisory Camittee in conformance with the resolution of the Board of County Commissioners creating the Committee. ARTICLE II - FUNCTIONS OF THE COMMITTEE The functions of the Committee designed to guide its activities are as follows: A. to make recommendations to the Board of County Commissioners on priorities for capital improvement and repair projects to be included in the annual and 5-year plans; to review the prod annual and 5-year plans on a regular basis, B. . to review the safety aspects of the County Road and Bridge system and to make appropriate recommendations for improvements to the Board of Cb missioners, and C. such other functions as may from time to time be defined by the Board of Commissioners. ARTICLE III - BASIS FOR COMMITTEE RECOMMENDATIONS A. Before setting forth recommendations formulated as a result of the functions enumerated in Article II, the Cannittee shall determine that such recommendations are 1) consistent with the spirit of the Weld County Home Rule Charter and laws of Colorado, 2) consistent with sound maintenance management practices, and 3) consistent with the overall goal of protecting the health, safety, and welfare of the citizens of Weld County. B. Recommendations to be set forth by the Committee shall require the affirmative vote of a majority of the Committee membership, and shall be presented to the Board in writing or at a public Board meeting. ARTICLE IV - MEMBERSHIP OF THE COMMITTEE A. Membership - The Committee shall rnnsist of nine voting and three ex-officio members. As closely as possible, members shall be appointed to represent the six advisory board districts. There will be three at-large members. In adilition, members shall be appointed as closely as possible to the following criteria: One representative of the road construction industry. One Professional Engineer from the consulting business. One representative from the livestock industry. One representative from a Weld County irrigation company. One representative from a Weld County sub-division. One representative fran a Weld County school district. The three ex-officio non-voting unii,ers of the Committee are: Board of Commissioners Coordinator for Engineering Services Colorado Department of Highways representative Weld County Director of Engineering B. Appointment manbers - The members of the C ittee shall be appointed by the Board of County Commissioners. C. Terms of members - The terms of the members of the Committee shall be for 3 years, except for the initial membership which shall be appointed on a staggered term basis, with the actual terms fran 1-3 years. ARTICLE V - COMMITTEE OFFICERS A. The (i-nmittee,shall have a Chairman, Vice-Chairman, and Secretary. B. The Chairman and Vice-Chairman shall be elected by a majority vote of the Cannittee membership. These officers shall serve one year terms of office. Selection of these officers shall be accomplished at the first official meeting of the Cafmittee in each calendar year. C. Secretary - The functions of the Secretary shall be performed by the staff from the Department of Engineering. ARTICLE VI - DUTIES OF OFFICERS A. Chairman - The Chairman shall: 1. Preside at the meetings of the Committee. 2. Define duties of Cannittee members necessary to carry out the work of the Committee. 3. Appoint subca mittees composed of Committee members, when necessary to properly carry out the functions of the Committee. B. Vice-Chairman - The Vice-Chairman shall perform all the duties of the Chairman in the rasp of any temporary absence or disability of the Chairman. C. Secretary - The Secretary shall: . 1. Attend meetings of the Committee. 2. Complete and maintain minutes and other appropriate records of all meetings. 3. Prepare correspondence of the Committee and send out all notices, letters, and informational materials. ARTICLE VII - MEETINGS OF THE COMMITTEE A. Meetings 1. Time - Meetings of the Committee shall be held a minimum of once each quarter. 2. Meetings of the Cannittee chnll be held in the Third Floor Hearing Roam of the Weld County Centennial Center. 3. Notice - Notice of meetings shall be mailed to the Committee members by the Secretary no later than (7) days prior to regular meetings. 4. Special meetings may be held at any time upon the call of the Chairman or request of the Board of Commissioners, following at least 24 hours notice of the Committee members by the Secretary. B. Quorum - A majority of the members of the Cannittee entitled to vote chnll constitute a quorum for the transaction of business. C. Deadline for Agendas - Deadline for placement on the agenda for matters to be reviewed by the Comcittee shall be (10) work days prior to the consideration of the Committee. D. Absences by M ers - Each member of the Carmi 'e who has knowledges that he will not be able to attend a scheduled meeting shall .notify the Secretary at the earliest opportunity and in any event prior to 4:00 P.M. on the date of the meeting. The Secretary shall notify the Chairman in the event that the projected absences will produce a lack of quorum. ARTICLE VIII - SUBCOMMITTEES A. Appointment - When necessary to efficiently carry out the work of the Committee, the Chairman may appoint subcommittees to carry out specifically assigned tasks. B. Membership - Subcommittees may be composed of members of the Committee and may include members of the Department of Engineering staff. In those instances where staff members are assigned to a subcommittee, such staff members shall be ex-officio. The Chairman shall be an ex-officio member of all subcommittees. C. Dissolution of Subcommittees - The Cbp rman may dissolve such subcommittees when they are no longer necessary to the functioning of the Committee. ARTICLE IX - ROBERTS RULES OF ORDER Roberts Rules of Order are hereby adopted for the governing of the Committee in all cases not otherwise provided in these by-laws or resolutions of the Board of County Commissioners. ARTICLE X - AMENDMENTS OF BY-LAWS Recarmended changes to the By-Laws shall be submitted as necessary to the Board of Commissioners for approval. Hello
