RE : Request for Enforcement of Resolution Suspending Weld County
Commissioner , Victor Jacobucci
WHEREAS , on the 6th day of September , 1977 , the Weld County
Council passed a Resolution whereby Weld County Commissioner, Victor
Jacobucci was suspended from his position as Commissioner on the
Weld County Board of County Commissioners and all duties attendant
thereto , with full pay ; and ,
WHEREAS , said suspension is still in full force and effect and
members of the Weld County Council have learned by personal observa-
tion and reports that Weld County Commissioner , Victor Jacobucci ,
has failed to abide by said suspension and has been actively and
fully participating in all of his duties as a Commissioner on the
Weld County Board of Commissioners ; and,
WHEREAS, the Weld County Council has been informed by its legal
counsel that the District Attorney , in and for the Nineteenth Judici.a]
District , State of Colorado , is the proper party to bring an action
to prohibit Victor Jacobucci from , exercising any duties as a Commissioner
on the Weld County Board of Commissioners until the suspension has
been lifted .
NOW, THEREFORE , BE IT RESOLVED, that the District Attorney in
and for the Nineteenth Judicial District , State of Colorado , be , and
he hereby is , requested to bring an action pursuant to Rule 106 of
the Colorado Rules of Civil Procedure to prohibit Weld County Commissioner,
Victor Jacobucci , from performing any duties as a Commissioner on the
Weld County Board of County Commissioners until the aforementioned
suspension has been lifted .
BE IT FURTHER RESOLVED, that said District Attorney use all legal
methods available to expedite this matter including, but not limited
to , the possible use of a temporary restraining order , request for
preliminary injunction and request for permanent injunction .
The above and foregoing Resolution was , on motion duly made and
seconded, adopted by the following votes :
