RE: CONFLICT OF INTEREST
Trevor Jiricek, Jeff Stoll, and Laurie Exby
WHEREAS, the Weld County Council has been notified of a relationship which
may have the appearance of a conflict of interest in Trevor Jiricek, Jeff Stoll, and Laurie
Exby's official duties as Weld County Health Department employees; and,
WHEREAS, it is Trevor Jiricek, Jeff Stoll, and Laurie Exby's private contract with
the City of Greeley to provide complaint investigation services pursuant to Chapter
9.52.025 of the City of Greeley Environmental Sanitation Code which may have the
appearance of a conflict of interest; and,
WHEREAS, Trevor Jiricek, Jeff Stoll, and Laurie Exby will only provide these
services to the City of Greeley in the evenings and weekends and their contract shall be
based upon a flat monthly fee; and,
WHEREAS, pursuant to Colorado Revised Statutes 24-18-110, Trevor Jiricek,
Jeff Stoll, and Laurie Exby have disclosed (in writing) a relationship which may have the
appearance of a conflict of interest in their official duties as employees of the Weld
County Health Department to the Secretary of State of Colorado; and,
WHEREAS, the Home Rule Charter for Weld County provides in Section 16-9-
as follows: Section 16--Conflict of Interest
"(1) General: No County officer, member of an appointed Board, or employee
shall have any interest in any enterprise or organization doing business with Weld
County which might interfere with the unbiased discharge of his duty to the public and
the best interest of the County. This restriction shall not apply where the officer,
member of an appointed board, or employee's department has no direct contact nor
business transaction with any enterprise or organization.;" And,
WHEREAS, the Weld County Council, in interpreting the Weld County Home
Rule Charter, does not find this matter to be within the purview of Home Rule Charter
Section 16---Conflict of Interest, providing that Weld County Health Department
employees Trevor Jiricek, Jeff Stoll, and Laurie Exby are paid upon a flat monthly fee;
NOW, THEREFORE, BE IT RESOLVED, that Weld County Health Department
employees Trevor Jiricek, Jeff Stoll, and Laurie Exby are not in a position of conflict of
interest in providing complaint investigations services to the City of Greeley.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted unanimously on the 21st day of October, 1997.
