HAYDEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 11th day of May, 1983 , at the hour of 2 : 00 o' clock p.m. in the Chambe s of the Board for the purpose of hearing the application of R. J. Hayden, 4529 Weld County Road 36 , Platteville, Colorado, 80651, for a Use by Special Review for a Dairy Operation, on the following described real estate, to-wit: Part of the SEa, Section 35, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado. WHEREAS, Section 24. 4. 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance; 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4. 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Comprehensive Plan in that policies of the plan promote agri- business so long as they do not create negative impacts on the environment or the County. No such impacts have been identified with this proposal. The proposal is consistent with the intent of the Agricultural Zone District. The use is both compatible with existing agricul- tural activity and with land use which is con- templated to be agricultural in the Comprehensive Plan. 3. The town of Mead has no objections to this proposal. 4 . No overlay districts affect the site. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the application for a Use by Special Review for a Dairy Operation on the hereinabove described parcel of land be, and hereby is, granted subject to the following con- ditions: 1. The attached standards for use by Special Review be adopted; 2 . The plat for the use by Special Review permit be placed on record by the Department of Planning Ser- vices staff prior to any building permits being issued on the site. The use shall be a dairy operation with a total stock population of four-hundred (400) head of cattle. 2. No runoff associated with the subject operation shall be allowed to flow off the use by special review area on the land of surrounding property owners without their written consent. 3. All phases of the dairy operation shall comply with all applicable County and State Health Standards and regulations pertaining to air quality, water quality and sanitary disposal systems. 4. Design Standards for Uses by Special Review, Section 24.5 et seq . of the Weld County Zoning Ordinance shall be complied with. 5. Operation Standards for Uses by Special Review, Section 24.6 et seq. of the Weld County Zoning Ordinance shall be complied with. 6. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards stated above, and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 7. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. M. , with the following present:: Chuck Carlson Chairman , Excused John Martin Pro Tern Gene Brantner. Commissioner Norman Carlson Commissioner Jacqueline Johnson Commissioner Also present: ., Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated April 25, 1983, duly published on April 28, 1983 in the LaSalle Leader a public hearing was held for the purpose of considering a Use by Special Review for a dairy operation for R. J. Hayden. Rod Allison, Planning Department representative, read the favorable :recommendations of the Weld County Planning Commission and the Department of Planning Services into the record.. The favorable reccm endations did contain conditions that were felt necessary for the proposal. Mr. Allison said that the applicant was ill and unable to attend this hearing. Commissioner Johnson asked about the letter fran the Soil Conservation District saying that the applicant has no plans for an animal waste management system. Mr. Allison said the applicant is working with the local Soil Conservation Service in order to work out a plan and they have indicated that the applicant will have a complete plan according to specifications.. After a short discussion, Mr. Bob Wilson came forward and said that the neighbors are very happy to have this operation in their area. Commissioner N. Carlson roved that this Use by Special Review for a dairy operation for R. J. Hayden be approved with the conditions as recommended. Commissioner Brantner seconded the motion and it carried unanimously. 'ARV . _'L t My commission expires My Commission expires Feb. 13, 1985 V DESCRIPTION OF PROPOSED DAIRY We have entered into a long term lease option agreement on a 22 acre feedlot, at 4709 Weld County Road 38, (SE Sec 35 T4N R6PW) The property is presently owned . by Ira Pepper and was utilized as a feedlot for up to 1800 head of cattle. We propose to convert this loner established feedlot into a dairy. This proposal. is consistant with the Weld county Comprehensive Plan RS it is in en agricultural zone and all the surrounding property is zoned agricultural. The property is not in a district which has flood hazards , airports or geological hazards. There are only four homes with in a mile radius and all of the home owners feel that the proposed dairy would help to vitalize the area. The dairy would primarly be a family operation, employing our two eldest sons full time and the younger two part time. We will also have one other full time man. They will heve a number of job descriptions ranging from feeding, milking and maintenance control. The cows will be milked twice a day. We will milk approximately two hundred head of cows and possibly have about 150 head of calves from these cows on the property. We plan to build a cinder block daity barn 25.8'x50 ' with a concrete catch pen 25.8'x60' utilizing the existing pens , feed bunks , and watering system. The vehicular traffic will consist of a milk truck (weight variable approximatly 34000 pounds loaded) , entering property every other day. The existing home has adequate sewage facilities and we have a septic tank permit for the proposed barn. Manure will be hauled to our farm which is 1 mile south of this prcperty and to adjacent farms to be utilized as fertilizer. Manure will be removed as often as necessary to maintain. a clean healthy enviroment for our cows. Drainage and waste from barn and corrals shall be handled as recommended by the Longmont Soil Conservation Service. These plans will comply with EPA requirements. They tentatively consist of underground. drainage pipes and two ponds , one sett- ling pond and one retention pond. It will take approximately 2.5 months to construct barn and drainage facilities.
