At that time we requested a continuance to allows us to address issues concerning Hill n Park Sanitation District. The issues have been addressed as follows: • The City of Evans has taken over the Sanitation District • Issues regarding Manhole overflow - any sanitation district will have an occasional plug- up and overflow,that appears to be the case here. When problems have been identified they are promptly handled. We do not have a record of a recant overflow. There was a case of an accidental discharge related to some construction at a manhole and that has been taken care of. Several instances over the past 3 years have involved an individual homeowner with a personal lift station. These back-ups were a result of the homeowner not paying attention or maintaining the lift station. We have contacted the homeowner and he understands and agrees that part of the connection from the Main to his home is his responsibility,this includes the lift station. • Hill n Park Sanitation and the City of Evans met with the State of Colorado Department of Health concerning issues related to the facility. As a result of this meeting a number of things have been done; increased aeration, upgraded chlorine facility,new flow meter, removed trees, other compliance issues addressed, and general maintenance. • City of Evans has determined that the system has the capacity to accept these lots and has issued taps for them. Should the subdivision not proceed these taps can be transferred to other locations. As described in the attached letter from the Colorado Department of Public Health and Environment, it is up to District officials, in this case the City, to determine If additional taps can be connected. By virtue of adopting the enclosed Supplemental intergovernmental Agreement, the City confirms that adequate capacity exists. The current plant capacity of the Hill N' Park wastewater treatment plant is 0,336 million gallons per day(MOD) and the present average flow is 0.26 MGD, thus there Is sufficient capacity to accommodate near term development Proposed Improvements within the next two to three years are planned to Increase the capacity to 0.4 MOD. Long term plans are to increase the ultimate capacity to 0.9 MOO, which is sufficient to handle a majority of the development west of the current City. In your letter you request that the Water Quality Control Division (the Division) approve the connection of an additional 20 taps. Pursuant to Colorado Law, C.R.S. 25-8-501 (Sd &e), the permiltee(in this case HW-N-Petit Sanitation District) is requited to initiate engineering and Onastelal planning for expansion of the wastewater Revetment facilities whenever throughput and treatment reaches eighty(g0)percent of design capacity. Whenever throughput and treatment reaches ninety-five(95)percent of the design capacity,the pemtlmsa shall commence construction of the necusuy treatment expansion. According to your analysis.it appears that the District's facilities have not reached the 50 percent capacity,therogere,it is up to the District oMaids to decide if they want to approve the connection of an additional 20 taps. In addition, its the owner's responsibility,or its agent.to meet discharge permit limits. As we discussed during out recent telephone conversation, I have scheduled an inspection for June 2, 1998 to evaluate the District's compliance with its discharge permit limits. At this point I would appreciate it if you would provide the following information regarding this system's permk compliance: a)Your design owluatien for Tsui detention,b)detention time for each cell, c) aeration capabilities for the total system, d) influent waste load,a) effluent quality, C chlorine chamber contact time, g)independent sampling you mentioned during our phone conversation,and any other information that may help me to perform a detailed evaluation of this system's ability to meet its discharge permit limits. RECITALS WHEREAS, the Intergovernmental Agreement provides for Evans to operate, maintain, improve, and expand the Hill N' Park sewage treatment plant and sewage facilities. subject to the terms and conditions set forth therein, which Intergovernmental Agreement is incorporated herein by reference; WHEREAS, Evans and the District have agreed that approval of a plan to improve and expand the District's sanitary sewer system and the WE N' Park sewage treatment plant is a condition precedent to implementation of the Intergovernmental Agreement; and WHEREAS, in accordance with paragraph 4 of the Intergovernmental Agreement, Evans engaged, with the consent and concurrence of the District, HDR Engineering, Inc. Letter from HDR dated February 19, 1998, providing for alternative cost allocations of improvement and expansion expenses (the "FIDR letter"); and 2. Letters from Picket Engineering Company dated May 4, 1998, and June 19, 1998, supplementing the HDR Report and providing information confirming various corrective procedures undertaken by the District and more precisely evaluating the existing system capacity; and WHEREAS,Evans and the District have agreed that Cost Allocation Method No. 1 set forth in the FIDR letter is the most equitable for cost allocations of improvement and expansion expenses; and WHEREAS,Evans and the District have confirmed that there is adequate capacity in the existing collection and treatment system to issue twenty (20) sewer taps to West Hill N' Park Fifth Filing, together with two adjacent properties; and WHEREAS, paragraph 4 of the Intergovernmental Agreement states that when approved by the Board of Directors of the District, the plan to improve and expand the 2 6/L'd %&291, 80E OQFJN010O '0NI 2idSN�A WUP2:TT 86, 1772 ale _ w ■ 600'd 0CIZ'ON xx/xi 8z:ot 86/vz/8o Districts sanitary sewer system and the Mill N' Park sewage treatment plant shall become a part of the agreement; and WHEREAS, Evans and the District have agreed and do hereby agree to implement the Intergovernmental Agreement as herein provided. IT IS THEREFORE AGREED: 1. The recitals set forth herein above are incorporated herein by reference. 2. The Board of Directors of the District approves the plan to improve and expand the District's sanitary sewer system and the Hill N' Park sewage treatment plant as set forth in the HDR Report, modified and supplemented as described in the recitals herein. 3. On or before July 1, 1998, the District shall transfer to Evans all funds held by the District, including all cash and tap fees, together with all accounts receivable. 4. Effective July 1, 1998, Evans shall take over the complete operation and maintenance of the District's.sanitary sewer system and the Hill N' Park sewage treatment plant pursuant to the Intergovernmental Agreement. 5. k is the present intent of Evans and the District that on or about July 1, 1999, they will explore the feasibility of and pursue if feasible the dissolution of the District in accordance with law.
