RECITALS WHEREAS, the District is a statutory special district formed under the Laws of the State of Colorado and is a quasi municipal corporation; and WHEREAS, the District Enterprise was created by the District, in order to comply with the provisions of Section 20, Article X of the Colorado Constitution and Article 45.1 of Title 37 of the Colorado Revised Statutes, as applicable; and WHEREAS, the District owns, maintains and operates a system for the storage and distribution of potable water within Weld County and Larimer County, Colorado; and WHEREAS, the Developer desires to contract with the District for certain potable water supplies and services; and NOW, THEREFORE, in consideration of the premises and the covenants and agreements hereinafter set forth, it is agreed by and between the District and Developer as follows: ARTICLE 1 WATER SUPPLY / FACILITIES 1 .1 The District agrees to furnish an adequate supply of water for a total of 5-five taps. 1.2 The water to be furnished by the District shall be potable water, which complies with the Federal Safe Drinking Water Act and any other applicable drinking water regulations. No promise or guarantee of pressure is made by the District or is to be implied from anything contained herein. 1 2000-0924 1 1.3 The District shall use reasonable diligence to provide a constant and uninterrupted supply of water except for interruptions due to: (1) Uncontrollable Forces; (2) Operations or devices installed for water system protection; (3) Maintenance, repair, replacement, installation of equipment, or investigation and inspection of the water system, which interruption or reductions are temporary, and in the opinion of the District necessary. 1.4 The District shall install and own a meter vault at each individual lot. ARTICLE 2 COSTS AND EXPENSES 2.1 The Developer shall pay the full portion of the construct on of water lines within the development that will serve the individual taps. The Distric must approve engineering and construction of water lines. Once the District has approved the water line construction the District shall obtain ownership of the water lines. The Developer may use the Districts existing water lines to serve the individual taps, if the District approves that the line is accessible and has available capacity to serve the development. 2.2 The Developer shall pay the appropriate portion of any line extension needed to deliver water to the development (See Exhibit A). The Developer shall meet all requirements of the District as specified in Exhibit A. 2.3 The Dovolopor shall also bo roquirod to pay the Plant Investment Fee portion of the "tap fee" which shall be determined by the it of lots within tho dovelopment timos tho Curront Plant Invostmont Foo. Horizon Construction Services, LLC (HCS)performed percolation. (See attached summary). 7'he average percolation rates ranged from 25.6 to 160.0 minutes per inch. The County Planning has requested Mr. Bates provide leach field sizes for each individual lot and show there is adequate room to install two fields in each lot. It does not make sense to design each leach field until each homeowner determines the number of bedroom home they desire. Therefore, we have designed one system with the worse soil conditions to determine the size of the leach field. Lot 2 has an average percolation rate of 160.0 minutes per inch with groundwater encountered at a depth of four feet and three inches(4'-'3"). The average percolation rate does not meet the County regulation rates for a standard system. An engineer-designed system will be required due to the percolation rate and limiting zone. The system has been sized for a three bedroom single family residence. The house is designed to use a 1000-gallon two-compartment septic tank. The effluen: from the tank will go into a distribution box and be distributed into a 3849 square foot combination bed using 63 high capacity Infiltrator® units. The system was designed using the water balance method and can handle the flow. See enclosed calculations. EXHIBIT Totals Engineering Service, Inc. E 444 S. 2nd Street • LaSalle, CO 80645 • (970) 284-9240 Ms. Pam Smith January 28, 2000 Page Two The following criteria must be met: The combination bed will be constructed with high capacity 11-10 Infiltrator®units spaced six feet apart (see drawing) and installed in accordance to the manufacturer recommendations. Wicking sand will need to be placed between the units and a minimum of twelve inches over the units. A minimum of six inches(6") of native topsoil material will then be placed over the wicking sand. The system will need to be mounded so the bottom of the infiltrators will be at the existing surface. A minimum of a 3-mil plastic liner will be installed around the combination bed from the top of the wicking sand to one foot below existing grade. The Engineered Designed System was designed in accordance to Weld County Individual Sewage Disposal System Regulations. The owner will have to meet the required distance criteria as shown in Table II in the Weld County Regulations, enclosed. The Individual Septic Disposal Systems for each home should be designed on a lot by lot basis at the time each homeowner determines the number of bedrooms they wish to construct. The percolation test was performed by Horizon Construction Services, LLC (Horizon) on January 16, 2000. The average percolation rate was found to be 160.0 minutes per inch and is summarized on Table No. 1. The average percolation rate did not meet the County regulation rates for a standard system. A limiting zone of groundwater was encountered at the site at a depth of fou^ feet three inches (4'- 3"). See attached Soil Profile. It is our recommendation that an engineered designed septic system be required in accordance to the county regulations for the above referenced site. The Weld County Health Department retains the final approval authority for all I.S.D.S. evaluations. Your permit should be reviewed entirely prior to any construction of the I.S.D.S.
